An Exercise In Judicial Restraint: Limiting The Extraterritorial Appplication Of The Sherman Act Under The Act Of State Doctrine And Sovereign Immunity, Joseph J. Wielebinski
Syracuse Journal of International Law and Commerce
When a legal dispute involving a foreign nation is submitted to a United States court, the adjudication of rights and liabilities may prove problematic. Two formidable barriers, the act of state doctrine and sovereign immunity, limit the court's ability to resolve disputes which question the legality of sovereign acts. The circumstances under which a United States court should exercise its jurisdiction to consider the merits of a claim involving the application of domestic law to the acts of a foreign sovereign remains a controversial issue.

International Satellite Communications And The New Information Order: Distressing Broadcasting Satellites, Stephen E. Doyle

The author argues that the frantic debate over the use of direct broadcasting satellites (which he dubs “distressing broadcasting satellites”) is irrelevant because international broadcasting using satellites is very unlikely to occur due to prohibitive costs and technological barriers.

The purpose of this article is to inquire into the nature and function of contract law in a centrally planned economy. The economy chosen here is that of the Soviet Union. This study has been divided into two parts; the first part deals with the role of plan and contract in domestic trade, the second part deals with the place of contract and plan in the foreign trade of the Soviet Union.

An Examination Of The Antidumping Provisions Of The Trade Agreements Act Of 1979: United States Implementation Of The Antidumping Code Formulated In The Tokyo Round, Alan H. Silverman
Syracuse Journal of International Law and Commerce
The purposes of the antidumping provisions of the Trade Agreements Act are to discourage price discrimination practices and the sale of unfairly priced import goods in the United States, and to off er remedies for the injury suffered by domestic industry when such practices occur. It is, in essence, intended to be preventive and not punitive. Nevertheless the Act, which in both design and application will present undue hardships to foreign producers and developing countries, fails to adequately address the global operations of multinational corporations and is susceptible to protectionist designs.

Exportation Of Hazardous Products, Janet Berk

Allowing the exportation of hazardous products, even though they cannot be sold in the United States, creates a double standard. The exportation of domestically banned or restricted products also presents serious risks for 'American consumers.' Once a product is banned, there is no guarantee that it will not subsequently reenter the United States under the guise of an acceptable label. This Comment discusses why and how the double standard should be eliminated.

Commercial Space Activities Under The Moon Treaty, Martin Menter

This paper examines the apprehension of private enterprise to invest funds in a moon activity requiring sharing of profits with States that had not shared in the risks involved. In light of the Treaty's negotiated history, conclusions made are that the nature of the sharing has not yet been determined; that such must await a subsequent separate treaty negotiation for the governing international regime when exploitation "is about to become feasible," an eventuality perhaps thirty or more years from now; that in the interim, there is no moratorium on exploitation and States may authorize their governmental and nongovernmental entities to …
