Countering Chinese Influence In Sudan, Ali Wyne

It is difficult to imagine a more poisonous symbiosis than that between China and Sudan. The former requires a continuous flow of low-cost oil imports to satisfy its soaring oil demand, and the latter requires sufficient economic support to immunize itself against international interventions and preempt potential internal uprisings. Sudan supplies 64 percent of its oil to China (meeting seven percent of the economic power’s demand in 2006), and China, for its part, has invested heavily in Paloich, one of the country’s central oil-producing areas.

Migrant workers face special problems in terms of qualifying for, and receiving payment under, national social security systems. In an effort to mitigate these problems, many states coordinate their social security systems. This paper explores how coordination schemes work in regional mechanisms such as the European Union, in international conventions adopted by the International Labour Organisation, and in multi-lateral treaties such as the Andean Social Security Instrument.

At the November 2006 symposium presented by the University of Maryland Law Journal of Race, Religion, Gender and Class, the panelists discussed various issues regarding human trafficking. One entity at the forefront of the fight against human trafficking is CASA of Maryland. This article contains remarks originally made by the author that focused the topic of human trafficking on one particular group of workers: domestic workers. That particular group provides an interesting study because of the many race and gender issues that are wrapped up in the treatment of domestic workers under the law.

Profitability Versus The Public Interest: Is International Patent Law Hindering Third World Countries Access To Hiv/Aids Medications, Karen Godnick

Richmond Public Interest Law Review

Strong patent protection limits access to HIV/AIDS drugs in developing countries where over five million people are in immediate need of these drugs. This comment summarizes the history of HIV/AIDS drugs and international patent law, how laws affect distribution of the drugs, and concludes by discussing public and private partnerships which could afford more access in developing countries.

This Article analyzes the events predicating the Kimberley Process and examines the validity of the Kimberley Process in relation to international trade obligations. Part I describes the background of conflict diamonds and their role in African wars. The section outlines the need for regulation in the diamond industry and examines how other attempted measures at curbing the illicit diamond trade have fallen short. Part II details the Kimberley Process and its guidelines. This section analyzes the relevant U.S. legislation passed in 2003, the Clean Diamond Trade Act. Patent law has been described as "the Price of Life". This can most strikingly be seen when applied to developing countries' access to HIV/AIDS drugs. Since the explosion of the HIV/AIDS epidemic in the 1980's, the disease referred to as the "Modern Black Death" has devastated large parts of populations in several developing countries. Because of several reasons, including strong patent protection advocated and implemented by developed countries through TRIPS and the resulting high price of medicines, these developing countries cannot afford the price of the HIV/AIDS drugs. The majority of medicines used to treat this disease are patented. As …

Customary International Humanitarian Law And Multinational Military Operations In Malaysia, Drew R. Atkins

The International Committee of the Red Cross published a study in 2005 identifying rules of customary international law applicable to armed conflict and theoretically binding on all nations. This study found that customary state practice has come to encompass and in some cases exceed protections contained in the Additional Protocols of 1977 to the Geneva Conventions of 1949, regardless of their applicability to a given conflict. These findings may impact the domestic law enforcement practices of states not parties to Additional Protocol II, which regulates non-international armed conflict. The most pertinent aspects of this topic include: who is trafficked, causes of trafficking, and the steps that have been and need to be taken to combat trafficking. Obtaining comprehensive immigration reform is one of the most important legal issues facing the Latino community today. For the nation, virtually every family, business, and community is touched by immigration. In 2006, when millions marched for comprehensive immigration reform, prospects for federal action increased. During the summer of 2006, as the U.S. House failed to move forward to complete legislative action, frustrations by anti-immigrant activists led to a small number of cities and towns attempting to enact restrictions and prohibitions against illegal immigrants at the local level. Terrorism within Europe, until 2004, was limited to internal, historical conflict between the state and dissenting factions, such as Spain’s Euskadi Ta Askatasuna (ETA) or the Irish Republican Army (IRA) in the United Kingdom. Islamic violence was strongly linked to the Middle East, as well as to America’s “War on Terror” initiative following the attacks of September 11. However, after the Madrid bombings in 2004 and the London subway bombings in 2005, Islamist terrorism has not only become a very real threat, it has also developed into an issue with which Europeans identify personally. However, transitions toward more democratic forms of governance and market economies have faced many obstacles, and have not necessarily facilitated the protection of such rights.
