The World Trade Organization: Environmental Police?, Jane I. Yoon
Cardozo Journal of International and Comparative Law
The note examines the tension between the World Trade Organization's (WTO) primary goal of promoting free trade and its efforts to address environmental concerns. While the WTO has established mechanisms like the Committee on Trade and Environment (CTE) to reconcile trade and environmental issues, critics argue that its framework prioritizes trade over environmental protection. The note concludes that the WTO's environmental aspirations are commendable but ultimately impractical due to the inherent conflict between trade liberalization and environmental goals.

Cardozo Journal of International and Comparative Law
The article explores the intersection of law, religion, and human suffering, drawing parallels between the unpredictability of legal outcomes in Holocaust-related litigation and the theological themes of the Book of Job. It argues that the legal system, like the biblical narrative, grapples with the challenge of assigning meaning to seemingly random events, particularly in cases involving state sovereignty and human rights. The analysis highlights the tension between the doctrine of state immunity and the pursuit of justice for victims of persecution, ultimately suggesting that legal outcomes often appear arbitrary, much like the suffering depicted in the Book of Job.

Finding A Conflicts Issue In International Copyright Litigation: Did The Second Circuit Misinterpret The Berne Convention In Itar-Tass?, David E. Miller
Cardozo Journal of International and Comparative Law
The article critiques the U.S. Court of Appeals for the Second Circuit's decision in Itar-Tass Russian News Agency v. Russian Kurier, Inc., arguing that the court misinterpreted the Berne Convention by creating a conflicts issue where none existed. The court's novel approach of applying Russian law to determine copyright ownership and U.S. law for infringement contradicts the principle of national treatment, which traditionally requires the law of the forum country to govern both issues. This decision, based on weak legal reasoning, ignored historical context, scholarly consensus, and relevant precedents, potentially leading to complications in international copyright litigation.

The essay humorously argues that suing the Devil is a viable legal strategy, challenging the perception of his invincibility. It provides a guide on navigating the procedural and substantive legal challenges involved, suggesting that the Devil's legal vulnerabilities make him a feasible target for litigation.
