Music To Everyone's Ears: Binding Mediation In Music Rights Disputes, Matthew H. Ormsbee
Music To Everyone's Ears: Binding Mediation In Music Rights Disputes, Matthew H. Ormsbee
Cardozo Journal of Conflict Resolution
Litigation has been the mainstay of copyright disputes since America's earliest copyright statute first permitted a cause of action for copyright infringement in 1790. While alternative dispute resolution ("ADR") has become more prevalent in other areas of the law, many copyright attorneys and their clients do not typically consider ADR processes a viable option because these processes are still relatively new to copyright law.
This Note proposes greater use of binding mediation, a specialized ADR process, in music rights disputes, which are fundamentally copyright infringement disputes. Section I discusses the background of copyright litigation and modern application of ADR in …
The Adventures Of 'Superman': A Narrative Worth Mediating, Jeffrey Zeman
The Adventures Of 'Superman': A Narrative Worth Mediating, Jeffrey Zeman
Cardozo Journal of Conflict Resolution
Summer, 2013. The world will believe, again, a man can fly. Most likely, anyway. Maybe. Fingers crossed.
The rights to Superman and his stories are the subject of a long-developing and heated dispute between publisher DC Comics ("DC") and the estate of Jerry Siegel, co-creator of the iconic character. While a much-talked-about reboot of the movie franchise enters preproduction, the latest round of lawsuits involves DC suing the Siegel family's attorney. The publisher claims attorney Marc Toberoff has wrongfully interfered with "contractual rights and other interests" by advising the families of Siegel and his cocreator, Joe Schuster, to reclaim the …

This has been a very rich opening panel to what promises to be a terrific conference. The panelists' comments go in such varied directions that it is a challenge to be both a commentator and summarizer, especially when I have just a few minutes to speak. What I plan to do is say a little bit to draw together some of the themes that the panelists have been talking about that are connected to a couple of topics I have been working on while at the same time trying to look forward to some of the things I hope we …
Culture, Creativity, & Copyright, David A. Simon
Culture, Creativity, & Copyright, David A. Simon
Cardozo Arts & Entertainment Law Journal
Recent literature in copyright law has attacked the traditional theory that economic incentives motivate people to create. Although the onslaught of criticism has come from different directions, it all shares a similar goal. to move copyright law in a direction that reflects actual creative processes and motivations. This Article adds to and diverts from these accounts, arguing that creativity may be a product of memes: units of culture, analogous to genes, that replicate by human imitation.
A memetic theory of creativity focuses on memes as the reference point for thinking about creativity. Under this view, the creator is a brain …

He's So Gay ... Not That There's Anything Wrong With That: Using A Community Standard To Homogenize The Measure Of Reputational Damage In Homosexual Defamation Cases, Abigail A. Rury
Cardozo Journal of Equal Rights & Social Justice
The note examines the role of the community standard in determining defamation, particularly in cases involving false claims of homosexuality. It argues that the current application of the community standard often lacks clarity and may reflect judicial biases, leading to inconsistent rulings. The note proposes reforms to enhance the accuracy and transparency of defamation analysis by adopting a contemporary community standard, similar to that used in obscenity law, which considers specific geographic and social contexts.

Pharmaceutical Patent Bargains: The Brazilian Experience, Bruno Salama, Daniel Benoliel
Pharmaceutical Patent Bargains: The Brazilian Experience, Bruno Salama, Daniel Benoliel
Cardozo Journal of International and Comparative Law
In the backdrop of the strict patent regime flatly adopted by the World Trade Organization (WTO) for all countries, a few countries constantly challenge this system through aggressive patent bargains. Within the pharmaceutical sector, noticeably, some countries now threaten to issue or otherwise actually issue compulsory licenses that may sway large pharmaceutical companies into selling drugs with large discounts or into granting voluntary licenses domestically. That is conspicuously the negotiation strategy adopted by Brazil in its negotiations with big international pharmaceutical companies.
This paper explains Brazil's aggressive bargaining approach based on an analysis of two aspects of its political economy. …

In The Shadow Of Innovation, Gaia Bernstein
In The Shadow Of Innovation, Gaia Bernstein
Cardozo Law Review
We are in the midst of the intellectual property wars. Scholars, judges, legislators, corporations, creators, and inventors disagree about the role of intellectual property rights. Yet, surprisingly everyone agrees about innovation - everyone loves innovation. Innovation appears everywhere: in legal scholarship, case law, legislative hearings, newspapers, and blogs. It is uniformly admired and aspired to - though almost never questioned.
Innovation is often assumed to have historically held a central role in the technology regulating legal regime. This Article presents a study of case law, which demonstrates that contrary to common belief, the celebration of innovation is, in fact, a …

Proving Fair Use: Burden Of Proof As Burden Of Speech, Ned Snow
Proving Fair Use: Burden Of Proof As Burden Of Speech, Ned Snow
Cardozo Law Review
Courts have created a burden of proof in copyright that chills protected speech. The doctrine of fair use purports to ensure that copyright law does not trample rights of speakers whose expression employs copyrighted material. Yet those speakers face a burden of proof that weighs heavily in the fair use analysis, where factual inquiries are often subjective and speculative. Failure to satisfy the burden means severe penalties, which prospect quickly chills the free exercise of speech that constitutes a fair use. The fair-use burden of proof is repugnant to the fair use purpose. Today, copyright holders are exploiting the burden …

On The Decline Of The Doctrine Of Equivalents, Lee Petherbridge
On The Decline Of The Doctrine Of Equivalents, Lee Petherbridge
Cardozo Law Review
The doctrine of equivalents is a judicial creation that allows patentees to exclude others from the use of subject matter beyond the textual scope of a patent's claims. This venerable - and extremely controversial - doctrine is tolerated (or promoted) on the theory that it is fundamentally necessary to protect the incentive structure of the patent system.
The perceived importance of the doctrine of equivalents makes all the more remarkable recent scholarly arguments that this ancient doctrine is a dead letter in American patent law. One recent empirical study argues that the doctrine is dead but hypothesizes that it did …
