Insurance-Incontestability Clauses-What Will Amount To A Contest
Insurance-Incontestability Clauses-What Will Amount To A Contest
Michigan Law Review
The incontestability clause is quite common at present in life insurance policies, and is the source of much litigation. The insurance policy has usually contained many statements or representations by the insured, and it was a common experience that after the insured had paid premiums on a life insurance policy, perhaps for years, and had died in the belief that his family was well provided for, the insurance company avoided payment on the ground that the insured had made a misrepresentation in the policy, or had committed a breach of warranty. As a result, a feeling grew up that all …

Insurance-Effect Of Mortgage Foreclosure Clause
Insurance-Effect Of Mortgage Foreclosure Clause
Michigan Law Review
Plaintiff, the mortgagee, applied for insurance on the mortgaged property in his own name and only consented to the policy being made in the name of the mortgagor with "loss-payable" rider in his favor upon representation of the insurance agent that it was the only form of policy the company used and would accomplish the same result. In the body of the policy there was a clause rendering the policy void upon foreclosure of the mortgage. At the time of issuance of the policy, the debt was overdue and the insurance company had knowledge of this fact. Held, the …
Insurance-Liability Of Insurance Company For Negligence In Exercising Its Option To Settle Or Defend
Insurance-Liability Of Insurance Company For Negligence In Exercising Its Option To Settle Or Defend
Michigan Law Review
In a recent New Hampshire case, the plaintiff had insured with defendant company against liability for personal injuries to plaintiff's employees not exceeding $5,000.00. The policy under the title of "Service" provided that defendant would investigate all claims and settle them "according to the law". The defendant insurer also agreed to defend such suits as might be brought against plaintiff because of such injuries. One of plaintiff's employees was injured and though he offered to settle for $1,300.00, the defendant refused the offer. Thereupon the employee sued and recovered $13,500.00 in an action defended by defendant company according to their …

Subrogation--A Chapter In Modern Legal History
Subrogation--A Chapter In Modern Legal History
Michigan Law Review
The equitable doctrine of subrogation, perhaps over-refined in some of its applications, is inherently sound and in its application between principal and surety deserves thorough development. The principal should of course pay in the first instance, in exoneration of the surety. If the surety is compelled to pay, subrogation but serves to work out the same result as if the principal had paid. The course of the decisions never has run smooth, but in 1805 Sir William Grant was justified in saying that "the surety had precisely the same right that the creditor had; and was to stand in his …

Admiralty - Workmen's Compensation - Is a Hydroplane a Vessel? - Claimant was employed in the care and management of a hydroplane which was moored in navigable waters. The hydroplane began to drag anchor and drift toward the beach, where it was in danger of being wrecked. Claimant waded into the water and was struck by the propeller. Held, claimant is not entitled to compensation under the Workmen's Compensation Law, since a hydroplane while on navigable waters is a vessel, and therefore the jurisdiction of the admiralty excludes that of the State Industrial Commission. Reinhardt v. Newport Flying Service Corp. …

Recovery Of Life Insurance When Insured Died In Military Service, Ralph W. Aigler
Recovery Of Life Insurance When Insured Died In Military Service, Ralph W. Aigler
Articles
A group of very recent cases, representative no doubt of many others pending, involve an interesting and important question as to the construction of military and naval service clauses in life insurance policies. These clauses which have been common in policies, at least in those issued in the last few years, while varying in wording-and these variations may be vitally important,-provide in general that if the insured meets death while engaged in military or naval service the liability of the insurer shall be limited to the premiums paid, unless permission to engage in such service shall have been obtained from …

The Supreme Court of the United States, in the recent case of Cohen v. Samuels, 38 Sup. Ct. 36, has put an end to a method, approved by some of the lower Federal Courts, whereby a person could create a fund which would be completely under his control but which would nevertheless be protected against any claim on the part of his trustee in bankruptcy. The circumstances in the principal case were as follows: Samuels had taken out ordinary life insurance policies, with the usual provisions as to loan and surrender values, payable to certain of his relatives as beneficiaries, …

Estates in Fee Tail - Quite generally estates in fee tail under the STATUTE DE DONIS were recognized by the states as a part of the common law. Statutory provisions in the way of modification and abolishment of such estates, however, are very common. The nature and scope of the statutory provisions have varied. See the states classified according to the character of the legislation in BREWSTER, CONVEYANCING, § § 142, 143.

Recovery of the Purchase Price Before Title Has Passed - In an action recently instituted' by The General Electric Co. to recover on a contract to manufacture certain machinery for the defendant, which machinery the defendant had refused to accept, the trial court adopted the contract price as the measure of damages. The upper court approved this measure of damages, rejecting the argument that the measure should have been the difference between the market value and the contract price, and dismissed, as no longer appropriate to modern conditions, the decisions in Bement v. Smith, 15 Wend. (N. Y.) 493, and …
