Estate Tax--Life Insurance--Section 2035 As A Basis For Including Life Insurance Proceeds In The Gross Estate Of An Insured Who Paid Premiums On A Policy Owned By Another Person, Michigan Law Review
Michigan Law Review
If a decedent possessed any of the incidents of ownership of a life insurance policy, or if the policy proceeds were payable to his executor, the entire amount of the insurance proceeds is included in his estate for estate tax purposes under section 2042 of the Internal Revenue Code of 1954 (Code). However, if the decedent had transferred ownership of the policy to another person in a transaction that both met the requirements of section 2042 and was not regarded as "in contemplation of death," but continued to pay the insurance premiums until his death, it is unclear whether any …

Driver Behavior And Legal Sanctions: A Study Of Deterrence, Roger C. Cramton
Driver Behavior And Legal Sanctions: A Study Of Deterrence, Roger C. Cramton
Cornell Law Faculty Publications
What are the consequences of the application of legal sanctions? How can these consequences be determined? This Article attempts to explore these questions in the limited field of highway safety, examining the available evidence and indicating areas where further investigation is essential. Although conclusions with respect to the general deterrent effect of traffic laws do not emerge, the parameters of the problem are defined and plausible hypotheses suggested.
Competition As A Means Of Regulating Insurance, Jason C. Blackford
Competition As A Means Of Regulating Insurance, Jason C. Blackford
Cleveland State Law Review
The sole thesis of this paper is that competition among insurers, tempered by state supervision of their financial control, is a workable alternative to active state control of the business of insurance. It is not the purpose of this analysis to question the basic concept and the workability of affirmative government control of insurance. To test this thesis, a case study will be made of the rating process used in the business of automobile liability insurance in the State of Ohio.
Burden Of Proof For Recovery On Accident Policy Where The Defense Is Suicide-Virginia's Answer
Burden Of Proof For Recovery On Accident Policy Where The Defense Is Suicide-Virginia's Answer
University of Richmond Law Review
When the defense of suicide is raised in opposition to a claim for recovery on a life insurance policy, on a double indemnity provision for accidental death therein, or on an accident policy, courts are troubled by the allocation of the burden of proof. If the claim is made on a standard life insurance policy, suicide must be expressly excluded to be a valid defense. If so excluded, the defendant-insurer bears the burden of proving that the death was suicidal. On the other hand, if the claim for recovery is on an accident policy or on a double indemnity provision …

Book Review Of Daniel G. Baldyga's: How To Settle Your Own Insurance Claim, Joseph A. Page
Book Review Of Daniel G. Baldyga's: How To Settle Your Own Insurance Claim, Joseph A. Page
Georgetown Law Faculty Publications and Other Works
How to Settle tries to exploit the same vein mined in spectacular fashion by Norman F. Dacey, who parlayed deep dissatisfaction with the probate system and popular resentment of lawyers into a runaway best-seller. It would seem, up to this point anyway, that people more readily worry about the inevitability of death and its legal consequences than the possibility of personal injury caused by the legal fault of another. Nonetheless, How to Settle does merit some attention, at least within the confines of a specialized journal and under circumstances unlikely to promote a sales backlash, so that all its shortcomings …

A Survey Of Financial Responsibility Laws And Compensation Of Traffic Victims: A Proposal For Reform, Lorence L. Timm
A Survey Of Financial Responsibility Laws And Compensation Of Traffic Victims: A Proposal For Reform, Lorence L. Timm
Vanderbilt Law Review
One of the most acute socio-economic and legal problems confronting society today concerns the compensation of traffic victims. In 1966, there were 52,500 persons killed as a result of traffic accidents,'which constituted nearly one-half of all accident fatalities. In addition, 868,000 persons were injured, and the total cost of motor vehicle accidents was estimated at ten billion dollars. As a result of the steadily rising accident toll, there has been increased concern over means of insuring that victims of automobile accidents will be compensated. This concern has been aggravated by the continued presence of the financially irresponsible motorist. The problem …
Crisci's Dicta Of Strict Liability For Insurer's Failure To Settle: A Move Toward Rational Settlement Behavior, Jonathan A. Eddy
Crisci's Dicta Of Strict Liability For Insurer's Failure To Settle: A Move Toward Rational Settlement Behavior, Jonathan A. Eddy
Washington Law Review
This comment attempts to explore the interests of the insurer and insured under the insurance contract, to differentiate between different tests applied by the courts, and to determine what effect these different tests will have on insurer's conduct. Finally, the comment examines what courts have actually done in their process of defining insurer duties and presses for a more conscious exercise of their role in facilitating rational settlement behavior. Adoption of a rule of strict liability is advocated.

Prepayment Health Care Plan Enabling Acts - Are Their Restrictive Features Constitutional?, John M. Campfield
Duquesne Law Review
Illness is something which afflicts the rich as well as the poor, the affluent as well as the downtrodden. It does not choose its host according to social position, educational background, or economic status. In this century the medical sciences and the medical professions have minimized the hazards of illness. Yet the costs of preventing or curing illness, and the financial burden placed upon the victim, persists and grows.

Basic Protection And The Future Of Negligence Law, Robert E. Keeton
Basic Protection And The Future Of Negligence Law, Robert E. Keeton
University of Richmond Law Review
Coming to full flower only in the nineteenth century,' negligence law is still a tender young plant among the hardy redwoods of legal history. Yet the jeopardy in which it stands is due not to its youth but to its aging inflexibility-to its failure to adapt to the era of the automobile. This is not to say that its end is at hand. Rather, a future of some kind for negligence law seems assured. The questions in doubt are what kind and for how long. The surest way of causing it to be inglorious and brief is to continue to …
