Jurisdiction To Zone Indian Reservations, Robert D. Wilson-Hoss

This comment will examine one of the most critical aspects of the civil jurisdiction issue—tribal jurisdiction to exercise land use planning and zoning control. With such jurisdiction, a tribe may regulate or prohibit the development of reservation lands, and thus exercise a measure of control over the future of its reservation. Without zoning jurisdiction, most tribes would be forced to submit to the judgments of non-Indians about the uses of reservation lands. An introduction to the history and patterns of land ownership on Indian reservations is important to an understanding of the clashes between Indian and non-Indian reservation residents. Equally …

In April 1977 a Ninth Circuit panel in Yakima I 5 ruled that R.C.W. ch. 37.12 violates the equal protection clause of the fourteenth amendment. The Supreme Court, in accepting review, has instructed the parties to prepare briefs on both the equal protection challenge and the issue of Washington's compliance with PL-280.17 Several Washington tribes have contended that R.C.W. ch. 37.12 fails to comply with PL-280 because (1) Washington failed to amend its constitution in order to remove a disclaimer of jurisdiction on Indian lands 18 and (2) PL-280 does not permit the assumption of partial jurisdiction by a state. …

This document, dated September 30, 1978, is the final report of the United States (US) Indian Claims Commission which operated from 1946 to 1978. The Claims Commission served as an intermediary between Indigenous people in the United States and the US Court of Claims to help process the volume of claims filed against the United States. Following the “Indian Citizenship Act” (An Act to Authorize the Secretary of the Interior to Issue Certificates of Citizenship to Indians) in 1924, an increasing number of Indigenous people were filing suit with the Court of Claims over treaty violations and other grievances about …

Native American Water Rights Settlement Project
Federal Legislation: Ak-Chin Indian Community Water Rights Act of 1978. (PL 95-328, 92 Stat. 409) This Act provides emergency irrigation water in face of a declining water table brought on by US failure to prevent mining of groundwater and to avoid litigation. The Ak-Chin has an agricultural based economy. The US will construct a well field and water delivery system from nearby Federal lands for 85,000 afa to meet Ak-Chin’s emergency irrigation needs. US will provide a permanent supply of water in a fixed amount by a date certain (Ak-Chin 1984 Amendment PL 98-530 sets Jan. 1, 1988 ) in …

In April 1973, the Native Courtworkers and Counselling Association of British Columbia held t he first evaluation since its founding in October 1973. The two major objectives of the evaluation were (a) t o provide the Association with a detailed overview of the work of the courtworkers, the head office and the Board of Directors; (b) and to provide information for use in future planning of the Association. In April, 1975 the Native Legal Task Force was approached by the Board of Directors of the Native Courtworkers and Counselling Association of British Columbia for assistance in performing their first program evaluation since the founding of the association in October, 1973. After consultation, · it was agreed that such an evaluation would be undertaken by a Task Force staff researcher in conjunction with a legal consultant having knowledge of para-legals and experience in administration and evaluation.
