US Government Documents Related to Indigenous Nations

This report, dated April 2008, from the United States (US) Army Corps of Engineers (Omaha District, Nebraska) explains the potential transfer of unused lands from the Garrison Dam Project to the Three Affiliated Tribes of Fort Berthold Reservation. The land transfer proposed to return a portion of land out of the 153,000 acres taken by the US Government for the construction of the Garrison Dam. The authority of this transfer is granted by the Fort Berthold Mineral Restoration Act of 1984 (Public Law 98-602). Tribal commerce created the current highways that stretch from coast-to-coast in North America today. The roads that are traveled by semi-trucks full of cargo, grocery produce, and all manner of commercial goods are on top of the ancient trade routes Natives have traveled for centuries. Unfortunately, the history and sophistication of Native commercial activities have been largely suppressed and left out of the story of the North American continent as Euro-Americans rewrote the continent’s history to reflect the glorification of colonization. In virtually every respect imaginable—economic, political cultural, sociological, psychological, geographical, and technological—the years from the creation of the United States through the Harding administration brought massive upheaval and transformation for native nations. Everywhere, U.S. Indian law (federal and state)—by which I mean the law that defines and regulates the nation's political and legal relationship to indigenous nations—aided and abetted the upheaval.

The court's most recent salvo in the Long case is no exception. I wrote about this case in April in this paper when the court had just heard oral arguments. My column was titled "A Matter of Disrespect" because in reading the transcript of the oral arguments, it was plainly evident in the questions raised by Chief Justice John Roberts and Justice Antonin Scalia that they had very little respect for the legitimacy of tribal courts or their decisions.

The concepts of self-determination and sovereignty, from an Indigenous perspective, embrace values, attitudes, perspectives, and actions. Of course, as a result of the historical phenomenon known as colonialism, in which expansive European states sought to dominate the rights, resources, and lands of aboriginal people worldwide, one cannot discuss Indigenous self-determination and sovereignty without some corresponding discussion of how states and their policy makers understand these politically charged terms as well.

The Declaration on the Rights of Indigenous Peoples was adopted by the General Assembly on 13 September 2007, after more than twenty years of negotiations between states, indigenous representatives, lawyers, and academics. Although the resulting document is controversial and complex in its treatment of several important issues, its ambiguous characterization of the collective legal right of indigenous peoples to self-determination has been chosen as the focus of this work because it is the primary right from which all other rights, and problems, are derived.
