Surrogacy And Citizenship: A Conjunctive Solution To A Global Problem, Caitlin Pyrce

People around the world are turning to surrogacy when they are unable to conceive by traditional means. When surrogacy turns traditional notions of parentage upside down, however, countries struggle to find efficient regulations that protect their own citizens, while still recognizing the increasingly global nature of modern society. Children born through surrogacy arrangements between Thai surrogate mothers and Australian intended parents have been confronted with the consequences of inadequate regulation. This note argues that in addition to revising surrogacy legislation to reflect the increasingly transient nature of society, countries must make mirror citizenship reform so children born through surrogacy are …

Amina is from Aleppo, where she was a math teacher. She is married with four boys. Her family fled to Turkey from Syria after losing their home in the war. Amina and her youngest son then sailed on an inflatable boat to Greece. Using cars, buses, and trains, they traveled from Greece to Macedonia, then on through Serbia, Croatia, Slovenia, and Austria before finally arriving in Germany. Part II of this paper will examine and compare how the LGBT asylum process has evolved—specifically vis-à-vis identity and discretion—in the United States and Australia, which can help highlight some of the issues driven by improper application of Western essentialist LGBT definitions on asylum claims. Part II will also analyze the concepts of refugee and asylum law internationally, as well as the concerns of the gay international community with respect to asylum law globally. After her husband’s death 16 years ago, her husband’s first wife and children took all the husband’s belongings as their own, including the house and land. In Afghanistan, Lima worked as a teacher, and her husband worked (and continues to work) for the government as an agricultural manager. She has a fourteen-year-old son who is deaf and has related speech problems; he could not be treated for them properly in Afghanistan. Because her uncle was very wealthy, Lima received daily threats that her son would be kidnapped and held for ransom. Her uncle went to Germany with his own children and her son to protect them from the kidnapping threats.

Disability arises from the dynamic between people’s physical and mental conditions andthe physical and attitudinal barriers in the environment. Applying this idea aboutdisability to United States and Canadian immigration law draws attention to barriers toentry and eventual citizenship for individuals who have disabilities. Historically, NorthAmerican law excluded many classes of immigrants, including those with intellectualdisabilities, mental illness, physical defects, and conditions likely to cause dependency.Though exclusions for individuals likely to draw excessive public resources and thosewith communicable diseases still exist in Canada and the United States, in recent yearsthe United States permitted legalization for severely disabled undocumented immigrantsalready in the …

Of Mice And Men: On The Seclusion Of Immigration Detainees And Hospital Patients, Stacey A. Tovino

Scholarly Works

With a special focus on federal provisions strictly regulating Medicare-participating hospitals' use of seclusion, this Article uses developments in health law as a lens through which the uses and abuses of seclusion in immigration detention centers might be assessed and through which the standards governing detention centers might be improved. In particular, this Article argues that the unenforceable standards governing seclusion in immigration detention, including the most recent version of ICE's Performance-Based National Detention Standards, were incorrectly modeled on correctional standards developed for use in jails and prisons with respect to convicted criminals. This purpose of this case study was to examine the employment experiences of Latino immigrants in the California Central Valley. The case study was conducted to determine why Latino immigrants in this location leave or stay in places of employment and whether federal and state immigration and employment laws and policies affected their employment status. The study included the obstacles Latino immigrants encountered during their search for employment. A qualitative case study research design was used gather detailed data from participants about their employment experiences in the California Cantal Valley.
