In 1860, British colonizers codified Section 377 into the Indian Penal Code. 377 is an anti-sodomy law based on Victorian/Judeo-Christian values which criminalizes homosexuality through judicial interpretation and the manipulation of ambiguous language. On August 15^th, 2017, India celebrated 70 years of independence from British control, yet 377 still exerts oppressive control over the safety and freedom of Indian LGBTQI communities. Defining queerness as perversion has caused LGBTQI individuals to become victims of false accusations, blackmail, harassment, housing and workplace discrimination, familial rejection, forced “conversion therapy”, assault, rape, torture, and even murder because of this power imbalance and …

Multilateral human rights diplomacy is a product of the triad relationship between intergovernmental organizations (IGOs), civil society organizations (CSOs), and states. This paper examines the emergence of LGBT rights within the context of the UN human rights system. Recently, the global debates around LGBT rights have become much more public and increasingly complex: Ministers, leaders, and even the UN Secretary-General routinely call on states to do more to protect sexual minorities. How were women involved in Egypt’s 2011 revolution/uprising? What role did they play vis-à-vis male activists? To what degree were Egyptian women “equal” during those 18 days in Tahrir Square? These questions will be explored within the context of interviews conducted by this writer in Cairo during and following Egypt’s 18-day revolution (uprising). This essay will explore the public/private sphere split, political consciousness-raising, and gender equality within the context of the stories of Egyptian women on the front lines of protest.

In the past fifteen years, there has been huge emphasis on the need for gendered mechanisms dealing with both forced migration and peacebuilding. The UN landmark resolution on Women, Peace and Security (S/RES/1325) and the gender-mainstreaming of the 1951 Refugee Convention have urged all actors to increase the participation of women in peacebuilding and their protection in instances of displacement. Since 2015, an unexpected number of migrants have rushed to the European Union in hopes of improving their lives. Contrary to their expectations, asylum-seekers realized that the EU is neither prepared nor willing to host them. This paper follows the progression of the EU’s asylum policies, beginning with the 1951 Geneva Convention and the principle of non-refoulement. After establishing the criteria necessary for a migrant to be legally recognized as a refugee, the paper will look at how the EU evaluates individual applications for asylum. This article critically reviews the use of ICTs for human rights crisis research. While focusing on two specific technologies—satellite imagery and mobile phone technology—it proposes a general framework for analyzing the added value of ICTs. The author suggests that their added value in mass atrocities research arises from their ability to reduce information uncertainty, a challenge that is exacerbated in the digital age. This is different from delivering “truth”, an inaccurate description that only leads to unfulfilled expectations and hopes. Merging literary criticism and political theory, this project explores the representations of refugees in contemporary fiction and human rights law. Through a close reading of reports and press releases published by human rights organizations, I trace how NGOs’ moral and expert authority creates a narrow emphasis on refugees’ fear and victimhood. As novels by Dave Eggers, Susan Choi, Caryl Phillips, and Chris Cleave show, literature is not bound by the same constraints. These novels reveal the internal borders that continue to compromise refugees’ belonging after resettlement. This work discusses Italy's migrant reception system including its flaws and their effects. Furthermore, this work explores an alternative, sustainable model of migrant reception created in Riace, Calabria, that has been successful in varying towns across Italy. Ultimately, this work argues that this system, which is beneficial to both Italians and incoming migrants — specifically asylum seekers — can and should be implemented nationally to counter the current flawed system.

After years of negotiations, the Colombian government and the Revolutionary Armed Forces of Colombia have reached an unprecedented peace agreement. The agreement, rooted in transitional justice, contains a strong and nuanced focus on political amnesty for rebel forces. The scope and nature of the agreement has garnered international attention and praise. Of particular interest is whether the amnesty provision under the peace agreement is compatible with international law. This legal brief tracks the contours of existing international law on amnesty for political crimes—specifically under Additional Protocol II to the Geneva Conventions—to analyze this compatibility. Working closely with women's testimonies from the genocides in the former Yugoslavia and Rwanda, this chapter aims to widen space in contemporary human rights discourse for discussion about sexuality--and in particular about the ways sexual violence functions as one of the forces of sovereign power. There is an intimate and largely non-visible strategy that sovereign power has at its disposal to cleave a subject from their capacity to live a human life, namely, by attacking the individual’s sense of sovereignty over her own body.

In this dissertation I argue that, since the 1980s, French airports have been designed to exclude people from legal, human and refugee rights. The particular space where this happens has been successively called “international zone”, “transit zone” and “waiting zone” and its scope has been significantly extended overtime. I contend that French authorities have used the concept of extra-territoriality in concert with the material design of the airport to sustain exclusion. People find a world of reasons to run marathons: to fight cancer, to raise money for a charity, to fulfill a promise. But Antonio Tizapa runs for the reason that has dictated his every waking moment for more than two years: finding his son. The story is presented through a written piece and a video short documentary. It follows Tizapa through events and races in the New York City area.

According to US Customs and Border Protection, over 59 thousand unaccompanied minors from the Northern Triangle (Guatemala, Honduras and El Salvador) have been detained at the US border, of those 59 thousand, 17 thousand are from El Salvador. El Salvador is home to some of the most dangerous and ruthless gangs of the twenty-first century. Their ruthlessness comes from 1980s guerrilla warfare experience. In addition, El Salvador serves as a transshipment point for illicit substances from South America into Mexico. This inquiry focuses specifically on administrative (local official) narratives that speak to contentious issue contexts of social conflict. Specifically, it draws upon a theoretical connection between hermeneutics and the sociology of knowledge to interpret narrative passages of local officials and others related to a contentious public action—the Detroit Water and Sewerage District’s stepped-up water-discontinuation efforts (2014 and 2015) that left thousands of inner-city residents with “delinquent” accounts and no access to water service. This study examines the shifting landscape of social and economic inequalities in the remittance-dominated region of southern highland Ecuador, focusing on the transformations brought about by increased international migration since the early 2000s.
