You Can Be Innocent—Or You Can Be Free: Prosecutorial Power And Dark Pleas In Innocence Litigation, Tori Simkovic, Craig Trocino

This Article examines the phenomenon Justice Michael P. Donnelly has termed the “dark plea.” A dark plea is a post-conviction guilty plea extracted from defendants who maintain their innocence but accept freedom over exoneration. Through the lens of State of Florida v. Lawrence K. Johnson, this Article exposes how dark pleas operate at the precise moment when newly discovered evidence threatens to unravel a conviction and expose actual innocence in a nearly two decades old wrongful conviction. Science—a seemingly compelling and infallible adjudicative element—plays a pivotal role in criminal trials, serving as a cornerstone for evidence interpretation and decision-making. However, the perceived infallibility of scientific evidence often masks its inherent limitations and vulnerabilities. Forensic methods, widely regarded as objective and precise, can suffer from a plethora of inconspicuous constraints—including flawed methodologies, human error, and biases—which undermine their reliability. The American public and legal system frequently place undue trust in forensic evidence and experts, influenced by portrayals of their certainty in media and popular culture. Presumed Guilty By Proximity: How Geofence Warrants Undermine The Fourteenth Amendment, Radha Patel

Geofence warrants are utilized as a surveillance tool to gather location data on every user within a specific area and are being integrated into policing without a stable legal framework. This integration threatens individual rights and disproportionately impacts people and communities of color. While these warrants are often scrutinized under the Fourth Amendment, this note argues that they significantly undermine the Fourteenth Amendment by granting law enforcement excessive discretion. This unchecked discretion allows systemic bias and racial profiling to influence criminal investigations, creating the potential for wrongful convictions. This project undertakes the task of analyzing the historical and contemporary landscape of Jacksonville, Florida, the “Bold New City of the South,”1 from a multidisciplinary vantage point. It argues that the spirit of the overturned “separate but equal” holding of Plessy v. Ferguson2 and its bold segregationist ideologies reverberate today in both subtle and overt ways. Yet, that reality has not come without the resilience and perseverance of pioneering natives who have resisted such ideals in bold ways. On December 22, 2023, the Law “Amending Some Provisions of the Social Security Law and Establishing the Retirement and Social Protection System” was enacted. This law introduces the pension system to replace the end-of-service indemnity. Despite the advantages of adopting indexed periodic payments over lump sum compensation, it is clear that the transition to the new system is threatened by the on-going end-of-service compensation crisis. What stands out is the contradiction between the approach adopted to address the end-of-service compensation crisis and the mechanisms stipulated in the 2023 Law. Genocide embodies the ultimate transgression of international law and exposes the limits of its effectiveness. Based on the 1948 Convention, its legal framework rests on two constitutive elements, – material and mental – whose interaction determines the recognition of the crime. Recent jurisprudence and contemporary cases in Gaza highlight the tension between legal clarity and political failure. A constitutional “right” is a legal technology designed to protect the weak from the strong. In the twenty-first-century United States, however, constitutional rights have increasingly been interpreted and deployed, by both litigants and courts, to secure the ability of the strong to dominate the weak. It is quickly becoming standard practice among right-wing American populists to claim that the deployment of rights in ways that limit the ability of the strong to dominate those weaker than themselves is to make victims of the strong. Freedom, in the imagination of American populists, means the freedom to dominate disfavored others.

Mangrove ecosystems are indispensable to climate resilience, yet traditional environmental governance has repeatedly failed to prevent their decline. This Note employs a comparative framework to examine Panama and Miami, two rapidly developing coastal regions facing parallel pressures of urbanization and sea-level rise, to demonstrate that mangrove loss persists not because law is absent, but because existing frameworks structurally authorize regulated degradation. Panama’s 2022 Rights of Nature Law, which grants ecosystems legal personhood and enforceable rights, represents a departure from anthropocentric environmental regulation. Who Will Hear My Case?: The Backdrop Of Hameed V. Canada And Its Impact On Canada’S Judicial Vacancy Crisis, Adrian T. Peraza

In 2016, the Supreme Court of Canada issued a landmark ruling in R v. Jordan, requiring prosecutors to try their case within eighteen months in provincial courts and thirty months in the superior courts. Through its holding, the Court sought to protect a defendant’s right to be tried within a reasonable time, a privilege enshrined in the Canadian Charter of Rights and Freedoms. However, at the time of the decision, the Canadian judicial system faced a vacancy crisis. A total of forty-three judicial vacancies existed in the federal courts, a figure that would later rise to eighty-six in August 2023. …

Air-raid sirens have become part of the daily soundscape in Ukrainian cities. They interrupt meals, classes, conversations, and sleep. When they blare, people gather what they can and move quickly sometimes to shelters, sometimes to basements, sometimes nowhere at all. Families lock their doors without knowing whether they will ever turn the key again. Children carry backpacks filled with whatever seemed important in the moment: a photograph, a stuffed animal, a book pulled hastily from a shelf. Around them, buildings that once anchored everyday life—churches, museums, historic neighborhoods— have been damaged or destroyed.

This Article makes an argument that should be obvious. The best way for governments to right the wrongs of cannabis prohibition is to give money to people with cannabis offenses. Nonetheless, this straightforward reform has been consistently overlooked, dismissed, or minimized by policymakers and scholars alike, eschewed in favor of other social equity programs that do not right those wrongs nearly as effectively. Governments have indeed invested hundreds of millions of cannabis tax dollars in social equity licensing programs and community reinvestment initiatives. These programs—while often worthwhile—do not benefit the vast majority of people with past cannabis offenses.

As companies increasingly embrace carbon-neutrality commitments, many rely on the voluntary carbon market to offset their emissions rather than reduce them directly. Regulatory and consumer scrutiny has focused on the widespread use of “phantom” carbon credits, i.e., credits that fail to produce meaningful climate benefits. But less attention has been paid to what this Note terms “colonial” carbon credits: those that may technically reduce emissions but do so at the expense of communities abroad.
