In April 1994, the United States District Court for the Northern District of Illinois issued a preliminary injunction halting the "Operation Clean Sweep" program operated by the Chicago Housing Authority ("CHA"). 3 The court did so over the protestations of some of those most affected, the public housing residents subjected to the CHA's searches. 4 Pratt v. Chicago Housing Authority5 attracted the attention of the nation and President William Clinton, who requested that the Justice Department investigate ways to strengthen security in public housing without offending the Fourth and Fourteenth Amendments of the United States Constitution.

Past Is Present: Urban Real Property Rights And Housing Reform In The People's Republic Of China, William D. Soileau

Since the early 1980s China has embarked on an ambitious program of reform in the systems of urban real property rights and allocation. In many respects, these reforms recall the policies of private property rights protection which prevailed in the early post-Liberation period of P.R.C. history, but which were subsequently abandoned in the Great Leap Forward and Cultural Revolution. In the intervening thirty years, however, the system of "public" urban housing ownership and allocation deteriorated to such an extent that no one—neither the state, its agents, nor private individuals—had sufficient incentives to increase or even preserve these resources. Although the Mains Farm majority's conclusion that a group home for the disabled is neither a single-family dwelling nor a residential use is certainly questionable,7 this Note is neither intended as an addition to the "what is a family?" definitional debate, nor as a proposal that the issues decided in Mains Farm be re-litigated. The last few years have witnessed a quantum leap in the enforcement of fair housing and fair lending legislation. The 1988 Fair Housing Amendments Act gave new enforcement powers to the U.S. Department of Housing and Urban Development (HUD) and the Department of Justice. For example, HUD can how initiate complaints against housing agents who discriminate. Moreover, several events, including release of the Home Mortgage Disclosure Act data, which show wide disparities in loan acceptance rates between whites on the one hand and blacks and Hispanics on the other, have led financial regulatory agencies such as the Federal Reserve Board …

Although mortgage lending discrimination and the laws that forbid it have been a part of the American landscape for over two decades, it has only been in recent years that this subject has captured the attention of the public, Congress, and federal enforcement officials. The result has been a tremendous upsurge in interest in this field. Still, there are relatively few cases that have been litigated to a conclusion on the merits, and fewer still that have resulted in plaintiff's victories. This article examines the government efforts to respond to affordable housing issues and summarizes the criticisms of these policies and programs. The author focuses on the privatization movement which pushes for a reduction in government participation in public housing activities in order to transfer control and responsibility to the private sector. The article also reviews European policies such as the concept of social housing. The article stresses that careful attention must be paid to the privatization mechanisms selected and emphasizes that shared expectations, shared values, and shared commitment can bring about a successful affordable housing strategy. ON LEGIS. 33 (1986), to review and document housing energy problems at the federal and local levels. It offers concrete proposals for a revised federal utility allowance system that, while recognizing technological

In this Article, Professor Yelnosky responds to Professor Clark's critique of his previous article, Filling an Enforcement Void: Using Testers to Uncover and Remedy Discrimination in Hiring for Lower-Skilled, Entry-Level Jobs. Professor Yelnosky first clarifies that Professor Clark has adopted several of the points Professor Yelnosky originally made in his earlier article. He then responds to the portions of Professor Clark's article that challenge his prior conclusions. Redevelopment Redefined: Revitalizing The Central City With Resident Control, Benjamin B. Quinones

Misguided redevelopment has been both a symptom of, and a means for achieving, inappropriate urban development goals. Requiring resident control will improve the redevelopment process itself, and simultaneously redirect the development goals towards which it channels its energy. One hopes that by shifting control of the redevelopment process, we also would shift the goals that redevelopment would pursue and the development forms it would take. Presumably, this would result in urban development designed to benefit residents of the urban core.

In Shaff v. SkahilP the District of Columbia Court of Appeals held that arbitrators' awards may only be reviewed if the moving party alleges a violation of the District of Columbia Uniform Arbitration Act.2 From a policy perspective, this decision may be read as subverting the very objective it purports to support encouraging the use of arbitration.3 In brief, this decision may discourage homeowners from agreeing to arbitrate disputes and appears to penalize those who do. Furthermore, this decision may be read as weakening the Home Improvement Business Act4 by providing a loophole for unlicensed and unbonded de facto contractors. …
