The United States faces growing pressure – both from domestic and international sources – to adopt a mandatory greenhouse gas reduction program to address the risk of global climate change. If policy-makers decide to establish such a program, they could end up creating an environmental regulatory regime of potentially unprecedented scope and impacts. A domestic greenhouse gas program could break ground in other ways too. Many policy-makers are considering innovative market-based approaches to regulation, including a multi-billion dollar economy-wide “cap-and-trade” program. A debate between advocates of command and control regulation and advocates of economic incentives has dominated environmental legal scholarship over the last three decades. Both sides in the debate implicitly embrace the premise that regulatory measures should be directed almost exclusively at large industrial polluters. This Article asserts that for many pollutants the premise is no longer supportable, and that much of the focus of regulation in the future should turn to individuals and households. Examining a wide range of empirical data, the Article presents the first profile of individual behavior as a source of pollution. The profile demonstrates that …

This article analyzes the various regulatory incentives for renewable energy development in the various states, and their possible Constitutional shortcomings. Almost half the states have enacted renewable portfolio standards, which create monetized renewable energy credits that are tradable credits for sustainable energy development compliance. About one-third of the states have developed system benefit charges and renewable trust funds to subsidize selected renewable energy projects. Each of these states have defined differently what is a qualifying renewable energy project. Some of the states, to further in-state interests, have established programs that impermissibly violate the Commerce Clause of the Constitution. Others come …

In 2001, California's electric sector deregulation exploded, and with it the state economy and the state political structure. The Governor of California, just recently reelected was recalled by the population, and replaced with Arnold Schwarzenegger. Workshop on Directional Drilling in the Rocky Mountain Region (November 13)

The Rocky Mountain region is seeing a large increase in the amount of exploration and production of oil and gas resources. Many people are interested in the use of directional and horizontal drilling technology but not much is understood about these technologies outside of the oil and gas industry. Many hold out the promise that directional drilling can minimize environmental impacts and the footprint of development. The technological, environmental, legal and policy implications of directional drilling for oil and gas in the Rocky Mountain region are the focus of this workshop.
