The blackout of August 2003 was a massive dislocation of American life, with millions of people in eight states and Canada losing power and a cost estimated in billions of dollars. As many as fifty million people were affected by the blackout. While the ultimate cause of the blackout is still being investigated, the implications for national policy may not be fully known for decades. The blackout was a wake up call and a watershed event that calls for reevaluation of just about every facet of the electric utility industry. We tend to think of a "wakeup call" as something …

Rethinking Regulatory Democracy, Mariano-Florentino Cuellar

This article empirically examines democratic participation in three different regulatory proceedings, involving financial privacy, nuclear regulation, and campaign finance. It then uses that analysis to critique -- and suggest alternatives to -- existing mechanisms to achieve public participation in the regulatory state. The current mechanism for structuring public participation in regulatory decisions (or “regulatory democracy”) relies on demand-driven procedures like the Administrative Procedure Act’s notice and comment process. Organized interests and others who decide they have sufficient resources and interest to do so comment on regulations. While some observers consider this process close to ideal, others instead seem to accept …

During the second half of 2003, Russia announced plans to build barges carrying two nuclear reactors capable of supplying electricity to a town of fifty thousand people. Rapidly developing countries seem particularly interested in this proposal, as these reactors can meet their growing power needs. In addition, these floating nuclear reactors provide an alternative to coal, oil and natural gas, all sources of energy that contribute to global warming. These reactors, however, pose a substantial risk to the environment, particularly in light of Russia's lax environmental policies, and the design of the barges themselves make them susceptible to a wide …

Federal Permitting Issues Related To Offshore Wind Energy, Using The Cape Wind Project In Massachusetts As An Illustration, Thomas A. Utzinger

Cape Wind Associates, LLC in Massachusetts intends to build a 130-turbine wind park off of Cape Cod, Massachusetts, in federal waters. The wind park would generate an average output great enough to power about three-quarters of the Cape’s energy needs.

Construction of this project required two permits from the U.S. Army Corps of Engineers: one for a single data tower, and one for the overall wind park. To date, the Corps has granted the data tower permit. This has been the subject of litigation in Massachusetts state and federal courts.
