'We Only Want To Plant Oil Palm": An Ethnohistory Of Illegal Peasant’S Oil Palm Plantations In Muaro Jambi, Jambi Province, Indonesia, Yudi Bachrioktora
International Review of Humanities Studies
The increasing global demand for vegetable oils and biofuels is a determining factor in increasing oil palm expansion in Indonesia. The current studies of Indonesia's oil palm expansion focus on companies' large-scale land acquisition. In this process, often called land grabbing, small peasants are excluded from the acceleration of oil palm expansion. This research focuses on the rarely discussed topic of the participation of small peasants in the palm oil production chain. Employing ethnohistory, this research unfolds the impact of oil palm expansion on small peasants and indigenous people, especially those who expand their plantations into the forest in Jambi …

The Strategy Of Featuring The Game Honor Of Kings Through Characterization In The Drama Series You Are My Glory (2021), Bella Homario, Adi Kristina Wulandari
International Review of Humanities Studies
The drama series You Are My Glory (Nǐ shì wǒ de róngyào你是我的荣耀), directed by Wang Zhi (王之), aired in 2021 and consists of 32 episodes. This research focuses on the first 14 episodes, which showcase the popularity of the game Honor of Kings-HoK (Wángzhě róngyào王者荣耀) through the interactions and dialogue between the two main characters, Yu Tu (于途) and Qiao Jingjing (乔晶晶). The integration of the popular online game HoK with the drama, starring top actors and actresses, represents a novel strategy that warrants further study. The analysis is conducted intrinsically by examining the characterizations of …

Designing Contracts For A Modern Classroom: The Abcs Of Cbas, Elizabeth Chu, Molly Gurny, Tong Koh, Evan Stone, Chiara Grabill, Jill Mclaughlin

Although teacher contracts (commonly, collective bargaining agreements or CBAs) provide critical workforce protections for teachers and govern much of the profession, they remain an underutilized lever for enabling strong teaching and learning, elevating the teaching profession, and equipping school systems with tools and capacities to confront the challenges of a rapidly changing, increasingly uncertain world.
Drawing on research spanning states, school systems, and time periods, this report sets forth a conceptual framework that draws attention to teacher contracts — both what they say and the ways they are built — as a potentially powerful, already-embedded, forward-looking mechanism for professionalizing teaching …
Critical Race Theory Bans And The Changing Canon: Cultural Appropriation In Narrative, Susan Ayres
Critical Race Theory Bans And The Changing Canon: Cultural Appropriation In Narrative, Susan Ayres
Faculty Scholarship
Thirty-five states have enacted critical race theory bans at the level of elementary and secondary public education, and seven states have extended these to the university level. One way to resist these attempts to repress a healthy democracy by whitewashing history is through a pedagogy of antiracism, including literary works. The question of what that would look like involves questions of cultural appropriation, which occurs when one takes from another culture, such as a writer creating a narrative about a character outside of the writer’s cultural identity. This Article considers the story of Ota Benga, brought from the Congo to …
Tightrope Walking: Balancing Theatre Teachers’ Academic Freedom Of Expression With The Implementation Of Florida’S Stop Woke Act And Don’T Say Gay Bill, Kimberly Adams
Barry Law Review
Florida’s Individual Freedom Act (IFA) and Education Equality Act (EEA), better known as the Stop Woke Act and the Don’t Say Gay bill, respectively, are contentious topics in the United States today. One side argues that parents have the ultimate right to choose what their child learns and how a teacher should deliver that instruction while believing that lessons that address systemic racism divide children and make them feel uncomfortable. The other side argues that our students will be unprepared when they graduate high school to contribute to our multi-racial society and will suffer from a limited worldview. From the …
Home For Good: How The Opt-In Element Added To Hb 547 Negatively Impacts Low-Income Homeschool Students In Texas, Nadine Cox
The Scholar: St. Mary's Law Review on Race and Social Justice
This comment addresses the relationship between a parent’s constitutional right to educate their child as they see fit and a child’s interest in receiving a robust education. The idea of a parent’s right to raise their child is a fundamental and long established one. However, activist have also raised concern regarding children who are educated at home. The concern centers around the idea that children have little to no access to extra-curricular activities, socialization, or other educational opportunities. Access to extra-curricular activities leads to a well-balanced education that prepares the child for whatever career the child desires. A child does …

Factors Impacting Bsn Degrees In Community Colleges In Illinois And Exploring Community Colleges To Address Nursing Education Reform: A Mixed Methods Study, Lovelle Reynolds
College of Education Theses and Dissertations
This dissertation investigates the implementation of Bachelor of Science in Nursing (BSN) programs in Illinois community colleges, focusing on Associate Degree in Nursing (ADN) faculty perceptions. Utilizing an explanatory sequential mixed-methods design, the study first conducted a survey among full-time ADN faculty across Illinois community colleges to assess their support for BSN program offerings. An overwhelming 85% of respondents supported or strongly supported this offering, recognizing the potential benefits for meeting the complex demands of modern healthcare roles. Following the survey, in-depth interviews with volunteered faculty members provided deeper insight into the implementation challenges. These challenges included the need for …

OKPLAC, Inc. v. Statewide Virtual Charter School Board
From the Introduction
Plaintiffs' opposition to the motions to dismiss distills their challenge to the State's approval of St. Isidore of Seville Catholic Virtual School to its essence: Plaintiffs believe that Oklahoma may never allow a religious organization to operate a charter school because (they contend) any faith-based school would violate the Charter Schools Act and the Oklahoma Constitution. Their other arguments-alleging technical errors in the State's decision to contract with St. Isidore and baseless speculation about how they predict the school might one day violate the law-grow from this …

To Essa And Beyond: Arc Of Education Policy Bends Toward Local Authorities & Holistic Approaches, Adam Tanielian
St. Mary's Law Journal
This Article presents a mixed-methods, interdisciplinary study on educational policy and practice to offer solutions to fossilized problems extant across the United States’ elementary and secondary schools. Analysis of historic Supreme Court decisions and statutes unveil compelling trends that have shaped the legal landscape over the latter half of the twentieth century. Linguistic comparisons of two milestone revisions of the 1965 Elementary and Secondary Education Act—No Child Left Behind (NCLB) and Every Student Succeeds Act (ESSA)—show Congress granted more flexibility and authority to local districts and states under ESSA, which reflected trends in Supreme Court opinions over several decades.

Opportunity And Oversight: The Nil And College Football Through The Lens Of Ole Miss, Emma Harrington
Honors Theses
Since 2021, student-athletes have been reaping financial benefits of the commercialized use of their name, image, and likenesses (NIL). In addition to engaging in direct endorsement contracts with third party businesses, student-athletes are likewise working with NIL collectives to secure novel forms of funding opportunities. In this thesis, the current system of Name, Image, and Likeness (NIL) utilized in collegiate athletics will be examined. While NIL can be a beneficial source of income and exposure to student athletes across the country, the set of rules, or lack thereof, in effect is not substantial enough to maintain a safe and healthy …

Standpoint Epistemology, The First Amendment, And University Affirmative Action, Paul Gowder
William & Mary Bill of Rights Journal
Egalitarian legal scholars understandably might have been troubled by the end of June 2023, when, on two successive days, the Supreme Court appeared to put an end to public as well as to private university affirmative action on a theory of race discrimination in Students for Fair Admissions v. Harvard, then appeared to put an end to the application of anti-discrimination law to any private enterprise that could be characterized as “expressive” in 303 Creative LLC v. Elenis. Yet the June 30 case, I shall contend, has the potential to undermine the negative impact of the June 29 …

A Qualitative Exploration Of Social Capital And Its Influence On Baccalaureate Degree Completion Of First-Generation African American Men At The University Of Louisville., Joseph Marshall Goodman Iii
Electronic Theses and Dissertations
This qualitative dissertation was designed to examine influences which various forms of social capital have on post-secondary degree attainment of first-generation individuals who self-identify as African American men. Additionally, the sample population consisted of Black men who successfully matriculated to earn baccalaureate credentials across differing academic disciplines at a public historically White institution located in the mid-south region of the United States. The research data was extracted from one-on-one, semi-structured interviews using authentic dialogue through open-ended questions. Theoretical paradigms of the study involved a phenomenological approach and an ontological philosophical assumption, integrated with critical theory, critical race theory and social …
The Right To Preschool: Once A Wartime Necessity, Now A Fundamental Step Towards Educational Equity, Alex Raskin
The Right To Preschool: Once A Wartime Necessity, Now A Fundamental Step Towards Educational Equity, Alex Raskin
Journal of Law and Policy
The most vital time for cognitive development is the first five years of a child’s life, impacting everything from language skills to social and emotional abilities. This makes access to high-quality universal preschool a necessity, as increasingly more families are without stable childcare in America. Preschool tuition now averages $10,000 annually and without paid parental leave, millions of children are left without formal learning or adequate supervision before kindergarten. This disproportionately impacts Black and brown students and students with disabilities, while continuing cycles of poverty and the gender wage gap. The only time the U.S. government provided high-quality universal preschool …
Parity In Higher Education In Prison Programs: Does It Exist?, Michael Lee Griggs, Vianey Luna
Parity In Higher Education In Prison Programs: Does It Exist?, Michael Lee Griggs, Vianey Luna
Electronic Theses, Projects, and Dissertations
The expansion of college-in-prison (CIP) programs, especially in California, where incarcerated college enrollment increased from 11,472 students to over 15,000 in two years, has spotlighted higher education for incarcerated individuals. This increase, supported by legislation that expands funding for CIP programs and allows time off sentences for successful course/degree completion, is further bolstered by the restoration of Federal Pell funding for incarcerated students after a 28-year ban. Despite the acknowledged benefits of CIP programs in reducing recidivism and enhancing post-release outcomes, existing research highlights the need for additional exploration into the quality of CIP programs. Senate Bill 416 further emphasizes …

Honors Projects
Adolescent sexual abuse and dating violence are serious issues that have life-changing impacts on victims. Sex education in the United States does place an emphasis on sexual assault and dating violence prevention curriculum to be provided for students. These programs have the potential to equip students with the knowledge to lead healthy relationships and prevent violent acts from happening. This review details 25 studies that provided these prevention programs to students and the impacts they had. It was found that the programs had positive impacts on preventing sexual assault and dating violence victimization and perpetration, as well as promoting healthy …
Silent Today, Conversant Tomorrow: Education Adequacy As A Political Question, Yeju Hwang
Silent Today, Conversant Tomorrow: Education Adequacy As A Political Question, Yeju Hwang
Northwestern University Law Review
When the Supreme Court declined to recognize the right to education as one fundamental to liberty, and thus unprotected by the U.S. Constitution, state courts took on the mantle as the next best fora for those yearning for judicial review of inequities present in American public schools. The explicit inclusion of the right to education in each state’s constitution carried the torch of optimism into the late twentieth century. Despite half a century of litigation in the states, the condition of the nation’s public school system remains troubling and perhaps increasingly falls short of expectations. Less competitive on an international …

A New Hope: Perez V. Sturgis Public Schools Opens The Courthouse Doors To Children With Disabilities, Richard Marsico
Belmont Law Review
This article addresses what happens when the exhaustion
requirement for IDEA claims intersects with the exhaustion requirement for
related federal laws. Specifically, compensatory monetary damages are
not available for IDEA violations but are available for violations of
related federal laws. This raises a question: if a plaintiff wants to file a
complaint pursuant only to the related federal laws alleging disability
discrimination and seeking monetary damages for actions that also arguably
violate the IDEA, must the plaintiff exhaust the IDEA administrative
process first?
From Garcetti To Kennedy: Teachers, Coaches, And Free Speech At Public Schools, Emily G. Waldman
From Garcetti To Kennedy: Teachers, Coaches, And Free Speech At Public Schools, Emily G. Waldman
Belmont Law Review
This Article analyzes Kennedy’s implications for educators’ free speech rights at school. It is important to note, at the outset, that the Kennedy majority’s description of the actual facts at issue is highly debatable. Indeed, the majority presented a sanitized account of what actually occurred on the ground, minimizing the highly public nature of Kennedy’s prayers and the football players’ involvement in them. That said, if we take the facts as the majority presented them, and then move to the majority’s assessment of those facts, we emerge with an interesting gloss on Garcetti. Synthesizing Garcetti and Kennedy points toward a …
Too Young To Suspend: Ending Early Grade School Exclusion By Applying Lessons From The Fight To Increase The Minimum Age Of Juvenile Court Jurisdiction, Peggy Nicholson
Too Young To Suspend: Ending Early Grade School Exclusion By Applying Lessons From The Fight To Increase The Minimum Age Of Juvenile Court Jurisdiction, Peggy Nicholson
Belmont Law Review
In many respects, the evolution of juvenile court reform and school discipline reform follow similar trajectories. This Article begins by tracking those respective evolutions. Part I outlines the evolution of the juvenile court system in the United States and focuses on the fledgling system’s distinction of children from adults and its “rehabilitative ideal” that children could outgrow challenging behavior if given the right treatment and services. After a long period of “adultification” of the juvenile court in response to rising crime rates, more recent reform efforts have focused on returning to the early court’s rehabilitative model, including policies that would …

"Exceedingly Unpersuasive" - Discrimination, Transgender Students, And School Bathrooms, Mark Dorosin
Belmont Law Review
In 2015, the St. Johns County School District adopted a policy which prohibited transgender students from using the restroom matching their gender identity and required that they use either single stall restrooms or the multi-stall restroom corresponding to their gender listed on their birth certificate (their “biological” sex). Similar policies targeting transgender students had been implemented by school districts across the country; and like many of them, St. Johns’ policy was quickly challenged by a transgender student who asserted that the policy violated his civil rights. In late December 2022, a divided Eleventh Circuit Court of Appeals, sitting en banc, …
Democracy And State Education Governance, Quinn Yeargain
Democracy And State Education Governance, Quinn Yeargain
Belmont Law Review
This Article lays out the hundred-year-plus trajectory of state constitutional and statutory changes that transitioned education from a near universally democratized area of policymaking into one that unevenly balances democracy and professionalization. Part I begins by sketching out the starting position of democracy in state education governance: the initial creation of elected state education administrators and the pressures to reform these systems in the early twentieth century. Then, Part II explores the slow process by which the structure of statewide education governance shifted, discussing the methods by which reforms were proposed and the content of the proposed changes. Part III …
What Will Happen To Cleo In The Wave Of Affirmative Action Litigation, Erin Lain
What Will Happen To Cleo In The Wave Of Affirmative Action Litigation, Erin Lain
Belmont Law Review
The Students for Fair Admission (“SFFA”) decision has upended how law schools conduct admission, changing the decades-old practices of considering race as one of many factors in the admissions process. Despite the narrow use of race in the admission process, the legal profession is still almost 81% white, suggesting the use of affirmative action has not been a substantial boost to minority enrollment in law school. Despite the low impact, the United States Supreme Court proceeded with a sweeping decision declaring the use of racial checkboxes unconstitutional and limiting the use of race in admissions to evidence of nonracial attributes …

Maximizing The Educational Choice Wave By Rethinking State And Local Regulations, Shaka Mitchell
Belmont Law Review
This Article will first survey the flurry of education choice activity in 2023, touching on several of the factors that drove legislation. Next, it will examine both the dispositional and practical impediments to choice reforms. This Article concludes with recommendations for modernizing local and state policy to best achieve the goals of recently enacted educational programs.
