Finding New Constitutional Rights Through The Supreme Court’S Evolving “Government Purpose” Test Under Minimum Scrutiny, John H. Ryskamp

By now we all are familiar with the litany of cases which refused to find elevated scrutiny for so-called “affirmative” or “social” rights such as education, welfare or housing: Lindsey v. Normet, San Antonio School District v. Rodriguez, Dandridge v. Williams, DeShaney v. Winnebago County. There didn’t seem to be anything in minimum scrutiny which could protect such facts as education or housing, from government action. However, unobtrusively and over the years, the Supreme Court has clarified and articulated one aspect of minimum scrutiny which holds promise for vindicating facts. The Challenge Of Inner-City Education, Lois Libby

There are two Connecticuts described in public education circles: One Connecticut includes a set of school systems that are suburban, educating primarily white and/or Asian students. The other set of Connecticut schools systems is urban, comprised primarily of students of color, and of low socio-economic status. The purpose of this chapter is to focus on the latter set of schools, provide some history of their development, look at the indicators of poor progress in more detail, review options of ameliorating the urban school systems, including assessments of state efforts so far, and offer some perspectives and conclusions.

This article proceeds as follows. Because it is first necessary to recount some of the history of the Little Rock school cases, Part I discusses the origins and early steps in the long-running litigation. Part II considers the period from 1982 until 2004 when Richard Arnold was a member of the appellate panel assigned to the school cases. This part identifies three critical points of the Eighth Circuit's intervention under Judge Arnold's leadership. In Part III, I suggest how Arnold's motivations for his decisions in the Little Rock school cases related to both his particular view of the limitations of …

The spiraling cost of education, the spread of technology, and the competitive nature of the job market have changed the very notion of what education should be and who should pay for it.

This chapter proposes a series of practical reforms, designed to work within the existing structure of higher education. The underlying assumption is that higher education in Connecticut is best served by allowing the natural forces of the market to determine the direction of growth and development. Minimal government interference will mean the greatest amount of choice and the highest quality of education for students in the state.

Since 1972, the volume of federal litigation involving faculty and their institutions has escalated. Tenure denial litigation, too, has increased. Prior to 1972, there were no published federal tenure denial decisions involving private colleges and universities. Since 1972, the number of published tenure denial decisions in the private institutional setting has increased steadily. Higher education administrators need to understand the risks that are involved in the tenure review process. These risks include the possibility of a protracted and costly lawsuit. The Americans with Disabilities Act (ADA) requires that persons with disabilities be integrated to the maximum extent possible, and that these persons cannot be excluded from participation. Intramural directors need to be proactive in this area. The benefits of intramural sports are vast, and they help many students become part of the college community.

The U.S. Supreme Court announced March 29 that it will intervene in the "culture wars" raging in academia by considering whether public university students have a constitutional right to block use of their student activity fees by student organizations of which they disapprove. Lesbian and gay studies programs, such as CLAGS, are at the heart of these culture wars, as right-wing groups raise public controversies about the discussion of sexuality in the academy and question the very legitimacy of lesbian and gay studies as an academic discipline.

Mirroring a cultural shift that brought the American middle class from the Victorian era into the modern era, women's intercollegiate sports encountered stiff resistance from the two overlapping social groups. Mabel Lee, a woman physical educator, brought firmly held Victorian beliefs about feminine propriety and moderation to the University of Nebraska when she was hired as the head of the women's physical education department in 1924. Louise Pound, an English professor at the University, had for years excelled in highly competitive athletics as a member of the new modern middle class. Although each of us is defined by race and gender, those of us who are neither white nor male often experience invisibility as a result of our dual subordinate status.... Black women have been disproportionately located at the lower end of the economic hierarchy and, therefore, have been unable to afford private golf, swimming, or tennis lessons. Brown vs. Board of Education established more than the unconstitutionality of the separate but equal doctrine in public education. Brown also gave the importance of education a constitutional dimension. Involuntary racial segregation creates a stigma wherever it exists which indisputably affects all children's self-esteem by possibly undermining that of children of color and by artificially inflating that of White children. Unfortunately, more recent cases that raise questions about the right to a public education seem less willing to acknowledge the importance of education and the importance of integration in public education.
