Public Perceptions Of The Use Of Artificial Intelligence In Voir Dire, Carson Snyder Apr 2026

Public Perceptions Of The Use Of Artificial Intelligence In Voir Dire, Carson Snyder

Honors Projects

Attorneys have increasingly utilized AI tools to improve efficiency, and one area of application is in jury selection, or voir dire. Public concerns involving AI can have negative implications on how the use of AI tools in voir dire would be received. This study seeks to answer how an attorney’s use of AI in voir dire impacts the public’s perception of the process. Previous research is limited, though findings relating to privacy being a leading concern, increased perception of risk for when error outcomes are more serious, and historical abuse of peremptory challenges outline potential reasons for public disapproval of …

You Can Be Innocent—Or You Can Be Free: Prosecutorial Power And Dark Pleas In Innocence Litigation, Tori Simkovic, Craig Trocino Apr 2026

You Can Be Innocent—Or You Can Be Free: Prosecutorial Power And Dark Pleas In Innocence Litigation, Tori Simkovic, Craig Trocino

University of Miami Race & Social Justice Law Review

This Article examines the phenomenon Justice Michael P. Donnelly has termed the “dark plea.” A dark plea is a post-conviction guilty plea extracted from defendants who maintain their innocence but accept freedom over exoneration. Through the lens of State of Florida v. Lawrence K. Johnson, this Article exposes how dark pleas operate at the precise moment when newly discovered evidence threatens to unravel a conviction and expose actual innocence in a nearly two decades old wrongful conviction. Johnson’s case illustrates the coercive dynamics of this type postconviction “bargaining.” After eighteen years of incarceration, compelling DNA recantation evidence, and an appellate …

Glossip’S Road Map To Nowhere, Vida Johnson Apr 2026

Glossip’S Road Map To Nowhere, Vida Johnson

Georgetown Law Faculty Publications and Other Works

The Supreme Court’s 2025 decision in Glossip v. Oklahoma was heralded as a victory for the defense. This essay argues that the 2025 Glossip decision does little to fix the myriad problems that led to Mr. Glossip’s wrongful conviction. While ultimately the Supreme Court reached the correct outcome this time, the ordinary judicial process and its purported safeguards were not what saved Mr. Glossip’s life. Rather, it was random chance that came to Mr. Glossip’s aid.

Ten years earlier, the Supreme Court, with many of the same Justices on the bench now, paved the way for Mr. Glossip’s execution. The …

Fit To Be Tried By Jury, But Not To Be A Juror: The Dilemma Faced By “Adults” Under Age 21, Kenneth Bell

SLU Law Journal Online

This article, “A Time To Speak: A Lifer’s Assessment of the Sentence of Death by Imprisonment” appeared in the 2025 Special Edition of The Writer’s Block under the longer title, “A Time To Speak: A Lifer’s Assessment of the Sentence of Death by Imprisonment and the Application of Roper v. Simmons and Miller v. Alabama.”  It is a four part discussion of the nature and continued viability of the sentence of life without parole particularly the need to end the imposition of that sentence upon persons between the ages of eighteen and twenty-one, i.e., emerging adults. This shorter piece extends …

Reel It In: Untangling The Circuit Split On The Constitutionality Of Geofence Warrants Under The Fourth Amendment, Kate P. Risser

Washington and Lee Journal of Civil Rights and Social Justice

This Note examines geofence warrants and their ongoing threat to constitutionally protected rights such as privacy, speech, and assembly. Part I will provide background information on geofence warrants and examine the prominent justifications for the use of the warrants. Part II will examine how law enforcement’s use of geofence warrants threatens citizens’ constitutionally protected fundamental rights like privacy and reproductive rights. Specifically, Part II addresses how geofence warrants disproportionately target and affect women, people of color, and low-income individuals. Part III will detail the history of the Fourth Amendment tracing its roots to before the Founding Era then exploring applicable …

A “Consistent And Ongoing” Right: The Sixth Amendment Right To Counsel At Initial Bail Hearings, Gemma Sunnergren Apr 2026

A “Consistent And Ongoing” Right: The Sixth Amendment Right To Counsel At Initial Bail Hearings, Gemma Sunnergren

Cardozo Law Review

Despite the potentially devastating consequences of pretrial incarceration and the complexity of modern bail applications, many individuals charged with crimes across the country are not appointed counsel to guide them through their bail hearings. Traditionally, application of the Sixth Amendment’s right to counsel in various pretrial proceedings has been evaluated under the “critical stage” framework, finding defense counsel necessary when a proceeding puts one’s trial rights at risk or is sufficiently trial-like—i.e., adversarial and requiring complex legal arguments. In the absence of a clear Supreme Court ruling, states have been left to conduct their own analysis, with many declining to …

(Mis)Judging Suspicion, Sherri Lee Keene Apr 2026

(Mis)Judging Suspicion, Sherri Lee Keene

Georgetown Law Faculty Publications and Other Works

Twenty-five years ago, the Supreme Court decided Illinois v. Wardlow, a Fourth Amendment case that allowed the high-crime nature of a location to be considered in determinations of whether there was reasonable suspicion to support a police stop. In making these determinations, courts rarely acknowledge the role that race can play in decisions that factor in the nature of a location as context. Yet even when the race of a defendant is not mentioned, high-crime area designations can act as a proxy for race inviting racial bias into courts’ analyses. Reasonable suspicion analysis involves the interpretation of a suspect’s …

Fixing Forty Years Of Failure: Objective Solutions To Batson’S Subjective Shortfalls, Katherine E. Donoghue Apr 2026

Fixing Forty Years Of Failure: Objective Solutions To Batson’S Subjective Shortfalls, Katherine E. Donoghue

Cardozo Law Review

It is a sunny afternoon in rural Georgia. A young Black man goes for a jog. On his route, he crosses the train tracks and heads into a predominantly White neighborhood. As his sneakers rhythmically hit the pavement, he hears the rev of a pickup truck behind him. Shortly after, he hears a second truck. The young jogger picks up his pace, but so do the trucks. The trucks chase him and eventually surround him. Two White men get out with shotguns. One stands ready, barrel raised. The other approaches the jogger and fires a bullet into his chest.

That …

The Multi-Hatted Court: Community Courts As Boundary Organizations, Peter Dixon, Hadar Dancig-Rosenberg

Northwestern University Law Review

As a variety of the problem-solving court model, community courts have received significant scrutiny and debate. Do they help individuals by addressing the underlying needs that contribute to criminal behavior? Do they extend an unjust criminal legal system by making help conditional upon judicial involvement? This Article moves beyond such debates to ask how community court professionals and the communities who engage with them manage these and other tensions that are inherent to the model itself. As the second in a series of articles drawing on semi-structured interviews and focus groups with diverse stakeholders at the Red Hook Community Justice …
