Jurnal Hukum & Pembangunan

Digital technology and modern telecommunications have been and will continue to be key factors in the emergence of various innovative products. The initiative to issue Digital Rupiah also responds to global trends and the public's need for secure, efficient, and sustainable payment instruments.

Law enforcement must ensure that the justice process operates in accordance with the principles of true justice. The criminal justice system in Indonesia emerged as a response to public dissatisfaction with the performance of law enforcement agencies that overly emphasized formal law and order alone, without regard for human dignity. The preamble of the Criminal Procedure Code (KUHAP) affirms that this system aims to protect human dignity, thus substantive justice must be prioritized. In this context, human rights, particularly the protection of crime victims, become crucial. However, in practice, victims are often marginalized, especially regarding compensation for immaterial damages that …

Dekolonisasi Hukum Perdata Indonesia: Kritik Terhadap Warisan Kolonial Dan Implikasinya Terhadap Pembangunan Hukum Berkeadilan, R. Mustar Lofi
Jurnal Hukum & Pembangunan

My hypothesis posits that AI is capable of independently committing acts of terrorism, a classification derived from the study of terrorism known as lone-wolf terrorism. To address these dual issues, this article adopts a criminological approach, which is further elaborated through an examination of lone-wolf terrorism and the advancement of artificial intelligence. As is widely recognized, contemporary terrorist organizations have harnessed technological advancements in the realm of information and communication to perpetrate acts of terrorism within the digital sphere. …

They operate with higher autonomy and tight supervision, enabling quicker responses to market changes. In terms of governance, Indonesia applies …

Observing the workings of law in Indonesia is very intriguing, particularly regarding corporations in the era of globalization. In this context, the refunctionalization of law in the enforcement of corporate law is interpreted as a process of legal renewal and a part of a progressive and reformative legal political process. In this regard, the legal interpretation of corporate liability principles becomes the main focus of this dissertation. It appears that corporate liability, which is key to prosecuting corporations, still requires more serious efforts to be articulated in practical terms, leading to fair judicial decisions for both the corporation itself and …
