A Practical Approach To Representation Of A Client During A Federal Antitrust Grand Jury Investigation, Carl L. Steinhouse
A Practical Approach To Representation Of A Client During A Federal Antitrust Grand Jury Investigation, Carl L. Steinhouse
Cleveland State Law Review
Generally, in white-collar crime situations, particularly antitrust, the first time a client may know he is under investigation is after the grand jury proceedings have commenced. The client will usually find out about the investigation through the industry grapevine, through the receipt of a subpoena by his employer or through a subpoena ad testificandum to an individual in his company. It is necessary for an attorney to understand the investigative process in order to properly represent his client in the antitrust proceedings that follow.

This article will evaluate the intent issue in several steps. First, Gypsum and its progeny will be examined to place the issue in context. Next, the article will consider the status of and reasons for a requisite mental element for criminal condemnation. Emphasis will be placed on the common law development of strict criminal liability. The focus will then shift to the evolution of strict liability in the Supreme Court. Against this background, the Sherman Act's criminal provisions will be analyzed to see if they may be appropriately considered strict liability offenses under common law or federal judicial precedent. Finally, …
Misprision Of Antitrust Felony, Robert J. Hoerner
Misprision Of Antitrust Felony, Robert J. Hoerner
Cleveland State Law Review
When an attorney discovers clear evidence that his corporate client has committed an antitrust felony, he and his client are immediately confronted with an interrelated tangle of extraordinarily difficult questions. There has been much concern over these questions, particularly since violation of sections 1, 2 and 3 of the Sherman Act became indictable as felonies on December 21, 1974. Little has been written, however, on the misprision issue. Antitrust practitioners are not ordinarily trained in the contours of 18 U.S.C. § 4, the federal misprision statute. Our criminal practice is typically in rarified and antiseptic economic fields, and does not …

Corporations-Officers And Directors-Liability For Representative Acts Under The Sherman Act, Leon E. Irish
Michigan Law Review
An indictment brought under section 1 of the Sherman Act charged appellee and the corporation that employed him with conspiracy to eliminate price competition in the greater Kansas City milk market. Appellee was charged solely, in his capacity as officer, director or agent of the corporation. The district court dismissed the indictment on the ground that natural persons are indictable under section 1 of the Sherman Act only for acts done on their own account. On direct appeal to the Supreme Court, held, reversed and remanded. A corporate officer is liable under section 1 of the Sherman Act whether …

Antitrust Administration And Enforcement, John T. Chadwell
Antitrust Administration And Enforcement, John T. Chadwell
Michigan Law Review
The importance of the nation's antitrust policy requires that administration and enforcement powers and techniques be equal to the huge task of effectively safeguarding competition. The recommendations of the Attorney General's Committee represent a statesmanlike effort to balance the need for effective enforcement with the need for the preservation of fairness and the conservation of time and resources in antitrust litigation. Some of the recommendations will undoubtedly engender heated controversy; others seem relatively uncontroversial.
Many individual topics are dealt with in the Report of the committee and space does not permit comment upon all of them. The following discussion is …
The Right Of A Businessman To Lower The Price Of His Goods, Stanley D. Rose
The Right Of A Businessman To Lower The Price Of His Goods, Stanley D. Rose
Vanderbilt Law Review
The present actions being taken to mark the transition from cold to hot war are settling a number of problems and creating a host of others. The direction of our national effort within the economy will shift to production; our normal interest would be in distribution. This shift will not mean that the antitrust laws will be entirely suspended. There remain certain vital functions of protecting whole classes of citizens during the coming years of stress and for that day when once again we return to our new two-cars-for-every-family ideal.
'But it cannot be denied that a discussion of lowering …
