Recall Of Judges And Of Judical Decisions, Howard Weist
Recall Of Judges And Of Judical Decisions, Howard Weist
Michigan Law Review
We live in an age when courts are attacked, judges condemned for obeying the constitution, and representative government is ridiculed and sought to be destroyed. The wish of socialists has become the political ethics of near-socialists and many other citizens. It has become popular to rail against the authority 'of courts; to demand that courts shall no longer be conservators of constitutional guarantees; that judges shall serve under the fear of recall; and representative government shall give way to an absolute democracy. Has political wisdom waited for the year 1912, only to offer us socialism and the worn out and …
The New Federal Equity Rules, Robert E. Bunker
The New Federal Equity Rules, Robert E. Bunker
Articles
On November 4, 1912 the Supreme Court of the United States, by formal order, adopted and established a code of rules for the courts of equity of the United States, which should take the place of all rules theretofore prescribed by the Supreme Court and then in force. Rule 81 provides: "These rules shall be in force on and after February 1, 1913, and shall govern all proceedings in cases then pending or thereafter brought, save that where in any then pending cause an order has been made or act done which cannot be changed without doing substantial injustice, the …
Judicial Criticism Of Legislation By Courts, Charles G. Haines
Judicial Criticism Of Legislation By Courts, Charles G. Haines
Michigan Law Review
In the application of the doctrine of judicial review of legislative acts, the federal courts of the United States have not infrequently been criticised for usurping part of the functions of the legislature. The criticisms have increased to such an extent as to raise an issue of national significance. Recently, charges against the judiciary for the usurpation of legislative functions have been made rather frequently by the justices of our federal Supreme Comt. The late Associate Justice Harlan, dissenting in part from the reasoning of the majority of the court in the Standard Oil case, brought such a criticism against …

Cases On Procedure, Annotated. Trial Practice, Edson R. Sunderland
Books
“The present volume is intended to develop and disclose the rational basis for the main principles of practice employed in the trial of civil actions at law. Recourse has been had to the whole body of American case law, and the choice of cases has been determined by the clearness with which the court has shown a logical justification for the decision made….
“The cases have been very freely edited, and everything not germane to the subject for which the case was chosen has been omitted….” --Preface

Preserving A Special Appearance, Edson R. Sunderland
Preserving A Special Appearance, Edson R. Sunderland
Articles
No personal judgment against a defendant is valid unless the court which renders it has first obtained jurisdiction over the person of such defendant. This is elementary and fundamental, and goes to the essence of the judgment. And such jurisdiction must be secured through the actual service of process upon the defendant against whom the judgment is sought or through his voluntary appearance in the action.
The Reasons For Some Legal Fictions, Sidney T. Miller
The Reasons For Some Legal Fictions, Sidney T. Miller
Michigan Law Review
In this age of fact, fancy is at a discount. Consequently legal fictions, which required the play of some fancy in their beginning, have fallen not only into disuse but also into disfavor. Many of them, however, have done good work in the past, and some are doing it now. Therefore it may not prove uninstructive to consider some in a discursive way. A legal fiction is probably best defined as "a legal assumption that something is true which is, or may be, false-being an assumption of an innocent and beneficial character, made to advance the interests of justice."1 From …

The Federal Constitution Is Not Violated By A State Law Compelling One Accused Of Crime To Testify Against Himself, James H. Brewster
The Federal Constitution Is Not Violated By A State Law Compelling One Accused Of Crime To Testify Against Himself, James H. Brewster
Articles
A case has been recently decided by the Supreme Court of Colorado, upon a condition of facts which it seems, has not an exact parallel in any of the reports. After being in litigation for more than eleven years the question involved was finally settled by the court of last resort of that state. In effect the decision goes to the extent of saying, that when a note is endorsed specially and afterwards comes back to the party making such special endorsement, and the party reissues the same without striking out his endorsement, no new endorsement is necessary, since the …

The Trial Brief, Edson R. Sunderland
Book Chapters
Professor Sunderland writes in introduction to his chapter: "As this is not a book of practice, an extended discussion of the general subject of 'Preparation for Trial' would manifestly be out of place.... The purpose of this part is to outline a course of investigation suitable in preparing a case for trial and to suggest methods for making the materials so obtained readily available." [p.207]

Prosecuting And District Attorneys, Henry M. Bates
Book Chapters
Professor Bates defines his subject matter "Prosecuting and district attorneys are judicial officers of the state, within their respective districts, although not officers of the state at large. Under some statutes they are county officers, while under others they are not, but are circuit or district officers.... Like other attorneys, prosecuting and district attorneys are officers of the court; but they are not a part of the court because of their office." A two-page outline precedes the entry.
Process, Edson R. Sunderland
Process, Edson R. Sunderland
Book Chapters
Professor Sunderland's chapter on Process: "Process, in the sense in which it is employed in the present title, means the writ, notice, or other formal writing, issued by authority of law, for the purpose of bringing defendant into a court of law to answer plaintiff's demands in civil action, although in a more technical and limited sense the term is frequently applied only to those writs or writings which issue out of a court." The chapter features an 8-page outline introductory.

Professor Sunderland's 780-page chapter on Pleadings: "Pleadings are statements, in logical and legal form, of causes of action and grounds of defense, terminating in a single proposition affirmed on one side and denied on the other. They are intended to form the foundation of the proof to be submitted on the trial, and should advise the parties to an action what the opposite party relies upon either as a cause of action or defense or objection as the case may be." Preceded by a 41-page outline.
The Proposed Court Of Patent Appeals, Otto Raymond Barnett
The Proposed Court Of Patent Appeals, Otto Raymond Barnett
Michigan Law Review
Experience has demonstrated that nowhere was the foresight and wisdom of the framers of the Federal Constitution more clearly shown than when they embodied in that instrument the provision that to encourage progress in science and the useful arts, Congress should have authority to secure to writers and inventors for limited times, exclusive rights to their productions. When the Federal Constitution was drafted, the manufacturing industries of this country were insignificant. Since then the industrial progress of the United States has been one of the marvels of the world's history and this progress and the supremacy of American manufacturers have …

Labor Organizations In Legislation, Jerome C. Knowlton
Labor Organizations In Legislation, Jerome C. Knowlton
Articles
During the first months of the current year, the Supreme Court of the United States handed down three decisions on important questions in labor legislation.1 The Employers' Liability Act was declared unconstitutional, but on grounds that may be avoided by subsequent legislation; the boycott was decided to be an unlawful conspiracy against interstate commerce, and in violation of the Anti-Trust Act and the congressional enactment providing criminal punishment for the discharge of an employee because of his membership in a labor organization was also held unconstitutional. These decisions have been unjustly spoken of by some, as unreasonably severe on labor …
