Eustitia: Institutionalizing Justice In The European Union, Helen Elizabeth Hartnell
Eustitia: Institutionalizing Justice In The European Union, Helen Elizabeth Hartnell
Northwestern Journal of International Law & Business
Madame Guigou's prediction that a "single judicial space" might be in place by the year 2020 signals a brave new horizon for the rule of law in the European Union. Yet even her dramatic claim fails to convey the range, depth, and momentum of changes wrought by the Treaties of Maastricht and Amsterdam in the realm of justice. The European Union is installing new infrastructure upon which to build a "genuine European area of justice." This "European judicial area" constitutes a key component of the "area of freedom, security and justice" ("AFSJ"). The Amsterdam Treaty added the AFSJ as a …

The fixing of hearing fees in state Shariah Courts has been provided in a written form as laid down in Rules of Costs and Fees. Practically, in Selangor the determination of hearing cost is stipulated in the Rules of Costs and Fees 1991. This dissertation is aimed at focusing on the details of fees and cost scale as provided in the Rules. This research finds that the cost taxation by Shariah Court judge in Selangor is based on his discretionary power and most of decisions are concerning the attendance fees.

The Power Of A Federal Appellate Court To Direct Entry Of Judgment As A Matter Of Law: Reflections On Weisgram V. Marley Co., Robert A. Ragazzo
The Journal of Appellate Practice and Process
Federal district court judges have several mechanisms for controlling civil jury functions. One mechanism is the entry of judgment as a matter of law. Federal appellate courts are able to reverse and direct entry of judgment as a matter of law. This article examines the appropriateness of such authority.

Civil Justice Reform Symposium: Introduction, James F. Hogg
Civil Justice Reform Symposium: Introduction, James F. Hogg
Faculty Scholarship
Many people in the United States are not happy about the way in which litigation proceeds. In a country sometimes thought to be overpopulated with lawyers, either one party or both parties in a significant percentage of civil cases apparently cannot afford, or decline to retain, legal counsel. Financing for legal aid seems to be less than adequate, pro bono services are helping to some extent, but the administration of civil justice is in danger of sinking in the swamp of pro se ("do-it-yourself') litigation. The articles in this symposium discuss ideas for reform, such as introductory resources directed at …

LLM Theses and Essays
With the increase of foreign trade, there has also been an increase in the number of foreign manufacturers and distributors involved in product liability litigation in the United States. In many cases, the products from these foreign manufacturers and distributors reach the forum states through the stream of commerce, and are distributed to the customers by regional distributors, wholesalers, and retailers. Therefore, in many product liability cases where defective products from these foreign manufacturers and distributors cause injuries to people in the United States, those foreign companies do not have a direct relationship with the forum states. In these cases, …

Hypnotic Memories And Civil Sexual Abuse Trials, Jacqueline Kanovitz
Vanderbilt Law Review
In the next few paragraphs, the reader will eavesdrop on a psycho- therapy session. During this session, the therapist uses hypnosis, a common technique in clinical practice today. In the past, the legal system has paid little attention to the memory retrieval techniques used in psychotherapy because statutes of limitations have prevented patients from using memories of childhood wrongs uncovered in adult psycho-therapies to bring suit. However, recent changes will force the legal system to examine whether the memory restoring techniques used in psychotherapy can produce memory that is trustworthy enough for the legal system to accept. What follows is …
