From Chains To Handcuffs: Confronting The Racial Legacy Of Prison Labor And The Urgency Of Reform, Hibah Hasan

This article examines prison labor in the United States as a system rooted in the 13th Amendment’s exception clause and shaped by post–Civil War practices such as Black Codes and convict leasing. It argues that, although formally abolished, the racialized logic of forced labor persists through modern mass incarceration, where incarcerated individuals—disproportionately Black men—perform essential work for little to no pay and without basic labor protections. The article analyzes how this system reflects a continuation of historical exploitation and proposes reforms, including fair compensation, voluntary participation, and expanded labor protections, to align prison labor with principles of rehabilitation and justice.

Separate But Equally Funded: Reforming Education Savings Accounts For Homeschoolers, Matthew Mcguire

Public commodities require public access. I review twenty-one state-funded education savings accounts (ESAs) funded by general fund revenues to argue that limiting home-education access violates principles of public access—The General Availability Doctrine. To the dismay of many home-educated students, nine state-funded ESAs require parents to terminate their home-education status as a condition for public funds. At least five state-funded ESAs require public school attendance as a prerequisite to receive funds, thereby precluding homeschooling students. Three state-funded ESAs treat home-education negatively by reducing funding based on a student's home-education status. Last term, the Supreme Court – these days thought to be intensely interested in reviving a formalist separation of the branches of government – has finally abandoned the quintessence of that project, a revitalization of the nondelegation doctrine. This essay argues that the Court’s decision in FCC v. Consumers’ Research reflects a pragmatic turn: rather than rewriting the test for nondelegation, the Court retained the old test, gave up on formalist reform, and indicated that it will be looking elsewhere for separation of powers remedies. This article examines the legal distinction between U.S. citizens and noncitizen nationals, with a particular focus on American Samoa. While residents of other U.S. territories—such as Guam, Puerto Rico, and the U.S. Virgin Islands—are granted U.S. citizenship by legislation, American Samoa remains the only unincorporated U.S. territory whose inhabitants are recognized as nationals but not citizens. This distinction results in significant political disabilities for American Samoans even when residing in a state, as they may not vote, hold public office, or serve on juries. Geofence warrants are utilized as a surveillance tool to gather location data on every user within a specific area and are being integrated into policing without a stable legal framework. This integration threatens individual rights and disproportionately impacts people and communities of color. While these warrants are often scrutinized under the Fourth Amendment, this note argues that they significantly undermine the Fourteenth Amendment by granting law enforcement excessive discretion. This project undertakes the task of analyzing the historical and contemporary landscape of Jacksonville, Florida, the “Bold New City of the South,”1 from a multidisciplinary vantage point. It argues that the spirit of the overturned “separate but equal” holding of Plessy v. Ferguson2 and its bold segregationist ideologies reverberate today in both subtle and overt ways. This study examines Lebanon’s Law on the Organization of the Judicial Court System, adopted by the Chamber of Deputies on July 31, 2025, and returned to the Chamber by the President of the Republic for further discussion, on September 5, 2025. It represents one of the most significant judicial reform initiatives since the Taif Agreement of 1989. The independence of the judiciary in Lebanon, as constitutionally guaranteed, carries a particular meaning that is embodied exclusively in the judicial function performed by any sitting judge issuing rulings in the name of the Lebanese people. The Constitution that elevates the judiciary to the level of a power does not provide itself for guarantees akin to the legislative and executive branches. Defining and measuring the concept of judicial independence, often a source of contradictions, is crucial to ensure that the reform of the judicial system genuinely leads to the protection of the independence of judges and justice. This article puts forward three essential points: 1. Judicial independence is a measurable concept based on a set of specific guarantees; 2. It is also a complex concept, encompassing multiple facets that must be protected simultaneously; 3. Ultimately, it stems from legislative (and possibly constitutional) recognition of these complementary guarantees rather than from a moralizing discourse imposed on judges.
