In the early months of 2020, COVID-19 had a swift and profound impact on public health, the economy, state and local governments, and businesses across the United States. In response, on March 27, 2020, the United States Congress passed the Coronavirus Aid, Relief, and Economic Security Act (“CARES Act”) to protect the American people from the worsening public health crisis and mitigate the resulting economic downturn. I was unhappy, but not surprised, to see Canopy Forum including Dobbs v. Jackson Women’s Health Organization, the case that overruled Roe v. Wade, in a call for submissions under the rubric, “Law and Religion in Pressing Supreme Court Cases.” I was not surprised because, for years, many critics have labeled pro-life opposition to Roe a purely religious viewpoint. But there is nothing inherently religious about qualms concerning abortion, nor is there anything specifically religious in the Dobbs majority opinion.

This dissertation argues that John Stuart and Harriet Taylor Mill were the first constitutional technocrats.

“Constitutional technocracy” is obviously not a new idea given that I found it in the Mills’ 163-year-old work. But “constitutional technocracy” is a new name for an unusual set of ideas: a set of ideas that many prior scholars have labeled “muddleheaded” when reading the Mills’ oeuvre.

The source of the “muddleheaded” critique is the apparent tension between technocracy and liberalism. Historically, “technocracy” is a system of anti-liberal political institutions: the complete consolidation of power in scientific experts who can discover and implement objectively correct …

For a country that has been declared a democratic nation since it gained independence, Indonesia still faces the real challenge of maintaining democratic values. Currently, Indonesian legal regulations do not provide a clear standard for when speech is protected and when it can be considered actionable defamation. The obscure scope of the law means that it can affect some kinds of speech, such as opinion or criticism, and render that speech punishable as a crime.

The U.S. Supreme Court’s decision in New York State Rifle & Pistol Association v. Bruen puts the Court firmly in charge of U.S. firearms policy. The decision also marks the beginning of a new era in which constitutional litigation will replace state and federal legislation as the primary means of resolving deep and enduring disagreements over how to regulate guns.

The Court’s Bruen decision contrasts with its decision in Dobbs v. Jackson Women’s Health Organization, overruling Roe v. Wade, where it declared that “the authority to regulate abortion is returned to the people and their elected representatives.” The …

Abstract

In 2014, Indonesia implemented measures relating to the importation of horticultural products, animals and animal products which were seen as a trade barrier in the form of quantitative restrictions imposed through the import licensing system. This article analyze whether the panel and appellate body decision in the case of Indonesia - Importation of Horticultural Products, Animals and Animal Products is in accordance with the provisions contained in the WTO legal framework. Indonesia’s policies cannot be justified under WTO legal framework, though there are some exceptions of the quantitative restriction provision.
