The Future Of District Of Columbia Home Rule, Philip G. Schrag

Georgetown Law Faculty Publications and Other Works

This article begins by briefly reviewing the recent historical development of home rule. Next, it explores the ways in which the people of the District might obtain a greater voice in the national legislature and more genuine home rule. Finally, it suggests that the District's citizens may have to make a political choice, which they have until now avoided, between seeking gradual improvements in their political rights and pressing strongly for statehood.

Untangling The Market-Participant Exemption To The Dormant Commerce Clause, Dan T. Coenen

Michigan Law Review

This article explores the market-participant rule. Part I traces the rule's evolution and shows how it has proven less rigid than some initially feared. Part II probes the roots of the rule by challenging justifications for it suggested by other observers. Part III offers an alternative theory of the market-participant doctrine, arguing in particular that it rests on a cluster of rationales that properly have led· the Court to uphold marketplace preferences as the "general rule." Part IV builds on Part III to advance a new, four-part framework for evaluating market-participant issues. Part V then uses that framework to apply …

One Century Of Constitutional Home Rule: A Progress Report, Michael Monroe Kellogg Sebree

Washington Law Review

Despite constitutional and statutory provisions providing for home rule, Washington municipalities continue to lack meaningful local autonomy. The author examines the need for home rule and its genesis in the United States and Washington. In addition, the author analyzes Washington case law in this area and concludes with constitutional and judicial proposals designed to increase municipal self-governance.

Territoriality And The Perils Of Formalism, Mark P. Gergen

Recently in this journal Donald Regan published a pair of essays on CTS Corp. v. Dynamics Corp. of America. Much of the first essay elaborates his theory that what the Supreme Court should be doing and what it is doing under the dormant commerce clause is checking state laws adopted with a substantial protectionist purpose. The rest of the first essay and all of the second essay develop a different check on state lawmaking power in interstate affairs: a rule that states may not regulate conduct beyond their borders.
