Reforming International Institutions To Improve Global Environmental Relations, Agreement, And Treaty Enforcement, Steven M. Anderson

The number of international environmental agreements has increased dramatically over the last several decades. Unfortunately, signed global accords have not always translated into ratified, fully enforced treaties. Several factors contribute to this dilemma including: the constraints of international law, recurring debates between lesser developed countries and their northern neighbors over standard setting and treaty administration, overburdened treaty implementation bodies, and-as evidenced by the U.S. example-domestic politics.

Reforming the current international environmental legal structure can help resolve enforcement difficulties. This Note examines existing international environmental organizations- with particular focus on the Global Environment Facility-and points to procedures and practices which have …

Abuse Of Diplomatic Immunity: Is The Government Doing Enough?, Rina Goldenberg

"Diplomatic immunity covers many things, but failing to pay $400,000 rent is not one of them, a federal judge said as he ordered the Zaire mission to the United Nations to be evicted from its offices."' However, only a few months later, the Second Circuit Court of Appeals overruled the judge by holding that diplomatic immunity does extend to this case and that the mission cannot be evicted.

Privatization At The Crossroad Of Latvia's Economic Reform, Sandra Berzups

Latvia regained its independence from the former Soviet Union in August 1991. Since then, it has begun the slow and arduous path of replacing the centrally-planned, socialist system with an economic structure based on free-market principles. Latvia began this transition "in a difficult environment characterized by macroeconomic imbalances inherited from four decades of central planning and disruptions caused by a sharp contraction of trade with Russia and other states of the former Soviet Union."

The International Court of Justice (ICJ) has a dilemma. Imagine the Utopian States' positions a $236 million satellite system in the geosynchronous orbit to broadcast Utopian programming into Atlantis. Atlantis is outraged. Atlantis believes that Utopian programming not only destroys the cultural identity of Atlantis, but also advocates the overthrow of the Atlantian government. Despite protests by Atlantis, the Utopian States assert that international freedom of speech protects the broadcast.

Fundamental Constitutional Rights In The New Constitutions Of Eastern And Central Europe, Rett R. Ludwikowski

Scholarly Articles

The goal of this article is to review the efforts of the drafters. This study analyzes the process of drafting the new bills of rights against the background of the Western experience. The paper consists of two parts. The first examines the genesis of American and European constitutional protection of human rights, including the socialist concept of the bill of rights. The second is an analysis of basic constitutional rights as provided in several new constitutions and constitutional drafts of the countries of former Soviet dominance.

The article also examines the actual records of these countries in human rights protection. …
