The Banking Secrecy Law, adopted in Lebanon in 1956, formally prohibited banks and their personnel from disclosing any information relating to their clientele to any public or private party. The purpose of enacting this law was to attract financial inflows to Lebanon in the 1950s and 1960s, a period that coincided with the oil boom in Gulf countries, and nationalization processes in neighboring Arab countries, especially Egypt and Syria, as well as later from wealthy Gulf oil monarchies. In international law, the concept of neutrality refers to the situation of a State that intends to remain uninvolved in armed conflicts. It is linked to the law of war and follows a specific legal framework that includes rights granted to neutral countries as well as duties imposed upon them, primarily abstention and impartiality. However, neutrality can be dissociated from war and can consist, in times of peace, of avoiding any actions that could draw a State into a conflict or a dispute between foreign powers. This paper addresses one of the conditions for the recognition and enforcement of foreign judgements in the United Arab Emirates, namely verifying the jurisdiction of the foreign court that issued the judgment. In this regard, the UAE Civil Transactions Code provides that the Emirati enforcement judge cannot order the enforcement of a foreign judgment before verifying that the Emirati courts do not enjoy exclusive jurisdiction over the dispute that had led to the issuance of the judgment or the order, and that the foreign court that issued the judgment or the order enjoys jurisdiction under the international jurisdiction rules laid …

The importance of the "qawaed kulliya" (Fundamental Rules) lies in the fact that they are recognized in the various laws due to the values they represent, arising from sound logic. They are called kulliya because they are the source from which legal provisions derive, and they help in understanding the causes and aims of rules allowing for deduction and analysis. The recent COVID-19 pandemic has sparked a renewed interest in the concepts of force majeure and economic hardship, which both deal with unforeseen and unavoidable events disrupting the performance of a contract. Despite many overlapping features between the two concepts, major divergences exist, both in conditions and effects. This article examines how force majeure and hardship are approached in the UAE Civil Transactions Code by analyzing their constitutive elements and comparing their consequences on contract performance and liability.

The general conditions for the formation of the contract in the Lebanese case law The Lebanese lawmaker enacted the general conditions for the formation of the contract in Articles 186 and following of the Code of Obligations and Contracts. However, here as elsewhere, the legislative work had to be supplemented by case law.
