Lectures On The Conflict Of Laws And International Contracts, University Of Michigan Law School
Summer Institute on International and Comparative Law
The lectures contained in this volume were delivered at Ann Arbor in the course of the sessions of the Summer Institute on International and Comparative Law under the auspices of the University of Michigan Law School, August 5 to 21, 1949. As a part of the institute program that has been inaugurated with the encouraging support not merely of the Faculty of the Law School but also of many interested members of the bar - a program designed to supplement the ordinary course of legal studies through the exploration of "frontiers of the law" in lectures and discussions delivered or …

The Concept Of "Denial Of Justice" In Latin America, J. Irizarry Y Puente
The Concept Of "Denial Of Justice" In Latin America, J. Irizarry Y Puente
Michigan Law Review
Much of the credit for the present state of development of the concept of "denial of justice" must go to Latin America. Step by step the efforts of her statesmen, lawmakers and publicists in the spheres of diplomacy, legislation and doctrine, have given the concept a more definite juridical form, and outlined more clearly its frontiers of legitimate action. The concept, far from being now the occasion for diplomatic coercion which it formerly was, is narrowed down to a judicial connotation; and, in this sense, it means that justice has not been done where it should have been.

International Law - Validity Of Soviet Decrees
International Law - Validity Of Soviet Decrees
Michigan Law Review
The Soviet government, by a nationalization decree, confiscated all oil lands in Russia, among them the land of plaintiffs, Russian nationals, and sold oil extracted therefrom to defendant. Plaintiffs sought an accounting, claiming that the confiscatory decrees of the unrecognized Soviet government and seizure of oil lands thereunder had no legal effect. A communication from the State Department was introduced: "The Department of State is cognizant of the fact that the Soviet regime is exercising control and power in territory of the former Russian Empire and the Department of State has no disposition to ignore that fact. The refusal of …
Critical Examination Of Peace Agencies Since 1919, Gilbert Gidel
Critical Examination Of Peace Agencies Since 1919, Gilbert Gidel
West Virginia Law Review
I intend to consider the practical value of the various means aiming at the prevention of war that have been suggested or put into effect since 1919. Why since 19197 I do not think that international law was created in 1919. But, whether one wishes it or not, an effort, unprecedented until now, has been devoted to the study of the technique of peace. The struggle against war is no longer limited to sentimental effusions, or fireside dreams: it has become an object of science; even of applied science. The program of the technique of peace is generally formulated today …
The Recognition Of Russia, Edwin D. Dickinson
The Recognition Of Russia, Edwin D. Dickinson
Michigan Law Review
Revolution in Russia culminated, on March 15, 1917, in the abdication of the Romanoffs and the establishment of the Provisional Government. In November, 1917, the Provisional Government was overthrown by the Bolsheviki and the Russian Socialist Federated Soviet Republic was proclaimed. Thus in nine turbulent months authority in Russia passed from the autocracy of the Czars, through the ineffective hands of the moderates, to extreme radicals frankly committed to communism and the dictatorship of the proletariat.

H, an Englishman, married W in England. On separation H acquired a domicil in Germany. A child was thereafter born to Y, a woman with whom H was living in Germany. H subsequently divorced W in Germany and married Y. Whether the child was legitimate determined whether H had validly exercised a power of appointment in an English settlement. Held, legitimacy is to be determined by the law of the domicil, including its rules of private international law. Germany, referring the matter to English law, found a remittance which Germany accepted and applied German municipal law. The child, by …

International Standing In Court Of Foreign Corporations, Elvin R. Latty
International Standing In Court Of Foreign Corporations, Elvin R. Latty
Michigan Law Review
The Supreme Court of Mexico has recently pronounced a decision of more than passing interest to the American Bar, not only because of the legal basis upon which the decision was rendered, but also because of its probable far-reaching consequences. The plaintiff corporation, organized under the laws of Delaware, brought suit for infringement of its trade mark which had been duly registered in Mexico. The Supreme Court held that inasmuch as the plaintiff was not registered in Mexico it had no existence there for the purposes of bring suit. It does not appear that the plaintiff was engaged in business …

The Legal Position Of Foreigners In Soviet Russia, Leo Zaitzeff Dr.
The Legal Position Of Foreigners In Soviet Russia, Leo Zaitzeff Dr.
Michigan Law Review
The Soviet Government has replaced the entire previous legal order by legislation of its own; it is therefore not surprising that even in well informed legal circles outside of Russia very vague and indefinite notions exist regarding the legal situation there. In the last few years moreover, many states have considered it necessary to recognize the Soviet Government. Since this recognition or even before, there have been some economic undertakings within &met territory by foreign individuals, but even these persons for the most part were entirely unfamiliar with the Soviet laws.
Waiver Of State Immunity, Edwin D. Dickinson
Waiver Of State Immunity, Edwin D. Dickinson
Articles
"English and American courts have come to regard it as 'an axiom of international law' that foreign states should be immune from suit in the national tribunals unless they to the expressly or impliedly waive their immunity and submit to the jurisdiction.... Yet it has not been doubted that states may waive immunity and submit to the local jurisdiction if they wish. In practice they frequently find it advantageous to do so. Some difficult questions arise when it becomes necessary to define the requisites of a waiver or to determine its precise effect in a particular case."
Recent Recognition Cases, Edwin D. Dickinson
Recent Recognition Cases, Edwin D. Dickinson
Articles
"The prolonged interval during which the United States declined to recognize the government functioning in Mexico, and the still more protracted period during which recognition has been withheld from the de facto government in Russia, have produced some unusually interesting problems with respect to the appropriate judicial attitude toward an unrecognized de facto foreign government."
Permanent Court Of International Justice, Edwin D. Dickinson
Permanent Court Of International Justice, Edwin D. Dickinson
Reviews
"The author of this volume of collected papers and addresses is well known as the Bemis Professor of International Law in Harvard Law School, sometime member of the Legal Section of the Secretariat of the League of Nations, and the most efficient advocate of the new Permanent Court of International Justice in America. His enterprise as an advocate is sufficiently attested by the fourteen brilliant papers reproduced in this volume and the nine other titles of similar nature listed in the bibliography, all of them produced during the last three years....

Les Gouvernements Ou États Non Reconnus En Droit Anglais Et Américain, Edwin D. Dickinson
Articles
Professor Dickinson tackles the subject of non-recognition of governments or states in English and American law: "Pour conclure, voici les propositions de l'auteur. La reconnaissance d'un Gouvernement or Etat etranger est exclusivement une question politique. L'existence d'un Gouvernement ou Etat etranger est exclusivement une question de fait.... C'est une chose deja grave que de voir d'une menace dans les conflits diplomatiques..."
