Toward Building A Legal Knowledge-Base Of Chinese Judicial Documents For Large-Scale Analytics, Amarnath Gupta, Alice Z. Wang, Kai Lin, Haoshen Hong, Haoran Sun, Benjamin L. Liebman, Rachel E. Stern, Subhasis Dasgupta, Margaret Roberts Jan 2017

Toward Building A Legal Knowledge-Base Of Chinese Judicial Documents For Large-Scale Analytics, Amarnath Gupta, Alice Z. Wang, Kai Lin, Haoshen Hong, Haoran Sun, Benjamin L. Liebman, Rachel E. Stern, Subhasis Dasgupta, Margaret Roberts

Faculty Scholarship

We present an approach for constructing a legal knowledge-base that is sufficiently scalable to allow for large-scale corpus-level analyses. We do this by creating a polymorphic knowledge representation that includes hybrid ontologies, semistructured representations of sentences, and unsupervised statistical extraction of topics. We apply our approach to over one million judicial decision documents from Henan, China. Our knowledge-base allows us to make corpus-level queries that enable discovery, retrieval, and legal pattern analysis that shed new light on everyday law in China.

Calling All The Statesmen: The (Not) Mubarak Trial, Lama Abu-Odeh Jan 2017

Calling All The Statesmen: The (Not) Mubarak Trial, Lama Abu-Odeh

Georgetown Law Faculty Publications and Other Works

I read the decision that exonerated ex-Minister of Interior of Egypt and his assistants from the charge of giving orders to kill demonstrators textually. Shortcomings known to lawyers and journalists who were following the case about failure of performance on the part either of prosecutors, lawyers, or the judge overseeing the trial are not considered in my reading. You might call it a close reading—specifically, a reading of the rationalizing language used by the judge writing the decision to explain his verdict.

Fallacies In The Current Methods Of Prosecuting International Commercial Bribery, Ira Handa Dec 2016

Fallacies In The Current Methods Of Prosecuting International Commercial Bribery, Ira Handa

Cardozo Law Review

The note argues that the current legal framework for prosecuting international commercial bribery is inadequate and inconsistent compared to the robust regime established for international public bribery under the Foreign Corrupt Practices Act (FCPA). It advocates for comprehensive federal legislation specifically addressing international commercial bribery, modeled after the FCPA but tailored to the private sector, to bridge this gap and address the significant harms caused by such bribery.

Rubbing The Rabbit's Foot: Gallows Superstitions And Public Healthcare In England During The Eighteenth And Nineteenth Centuries, Roberta M. Harding

Law Faculty Scholarly Articles

Superstitions possess an ancient pedigree. With the passage of time thematic superstitions developed; for example, some solely addressed the public’s health care needs. In fact, as far back as the fifth century many English subjects believed magical spells and jewels had curative properties. Law was another context that generated a body of superstitions. Capital punishment was one area that generated many superstitions. In fact, so many that a specific category was established: gallows superstitions. With hanging as the primary method of execution in England for centuries, this group of superstitions became a relatively large one. By merging the health care …

Rape And Sexual Violence: Questionable Inevitability And Moral Responsibility In Armed Conflict, Katherine W. Bogen Apr 2016

Rape And Sexual Violence: Questionable Inevitability And Moral Responsibility In Armed Conflict, Katherine W. Bogen

Scholarly Undergraduate Research Journal at Clark (SURJ)

Wartime sexual violence is a critical human rights issue that usurps the autonomy of its victims as well as their physical and psychological safety. It occurs in both ethnic and non-ethnic wars, across geographic regions, against both men and women, and regardless of the “official” position of commanders, states, and armed groups on the use of rape as tactic of war. This problem is current, pervasive, and global in spite of the status of wartime sexual violence perpetration as a crime against humanity and the capacity of the international criminal court to indict offenders. Though some scholars have argued that …

Redefining The Rico Statute: Potential Avenues For Improvement, David Scouten Apr 2016

Redefining The Rico Statute: Potential Avenues For Improvement, David Scouten

Senior Honors Theses

The civil application of the Racketeering Influenced and Corrupt Organizations Act (RICO) has been misapplied by the lower courts, but the statute can be improved by incorporating elements that will make the statute a better tool for justice. It is evident from examining the procedural limitations of the statute and important case law that the securities fraud gap, terrorism financing, and difficulties for indirect victims are three critical subjects that need to be addressed by enhancing RICO. Flaws and shortcomings of the RICO statute have led to inconsistencies in court rulings. The expansive language of RICO can be limited to …
