Remarks Made At The Second Circuit Judicial Conference, September 8, 1989, Thurgood Marshall
Remarks Made At The Second Circuit Judicial Conference, September 8, 1989, Thurgood Marshall
Trotter Review
For many years, no institution of American government has been as close a friend to civil rights as the United States Supreme Court. Make no mistake: I do not mean for a moment to denigrate the quite considerable contributions to the enhancement of civil rights by presidents, the Congress, other federal courts, and the legislatures and judiciaries of many states. It is now 1989, however, and we must recognize that the Court's approach to civil rights cases has changed markedly. The most recent Supreme Court opinions vividly illustrate this changed judicial attitude. In Richmond v. Croson, the Court took …

System-Wide Title Vi Regulation Of Higher Education, 1968-1988: Implications For Increased Minority Participation, John B. Williams
Trotter Review
In 1964, 300,000 blacks were enrolled in the nation’s higher education system, most of them attending black colleges and universities in the South; 4,700,000 whites attended colleges during the same year. With passage of the 1964 Civil Rights Law, the federal government acknowledged an inequity in blacks’ opportunity to attend college and gave promise of becoming a major source of pressure for desegregating higher education. But the potential of Title VI, the promise of government intervention to accomplish greater equity, has never been fulfilled.
Specifically, Title VI renders discriminatory agencies and institutions, including colleges and universities, ineligible to receive federal …
The Peaceful Resolution Of Norfolk's Integration Crisis Of 1958-1959, Nancy Parker Ford
The Peaceful Resolution Of Norfolk's Integration Crisis Of 1958-1959, Nancy Parker Ford
History Theses & Dissertations
In 1958 Norfolk experienced one of the most serious crises in its long history when six of its public secondary schools were closed by the governor. The closings were a result of Virginia's massive resistance program and forced 10,000 students to seek alternative education for five months or abandon their education entirely. Interviews with major participants in the crisis as well as investigation of newspaper accounts and editorials, personal papers of participants, city and School Board documents, and major works on the period reveal the factors involved in Norfolk's peaceful approach to integration. A comparison with the situation in Little …

Affirmative Action: Problems And Prospects, James Farmer
Affirmative Action: Problems And Prospects, James Farmer
Trotter Review
We live in complicated times today, and one of the sparks that flies off from such complicated times involving difficult issues is that words have all kinds of meanings, and they tend to confuse. I was astonished to hear our president, Ronald Reagan, say that if Dr. King were alive he would agree with him in opposing affirmative action, because King was color-blind and so is Ronald Reagan. This was a stopper, really, a real stopper. Affirmative action has had an interesting history. I, with no attempted modesty, claim to have proposed the idea to Lyndon Johnson, in either late …
Some Observations On Closing The Gap, Jeremiah Cotton
Some Observations On Closing The Gap, Jeremiah Cotton
Trotter Review
James P. Smith and Finis R. Welch, along with fellow economist Richard B. Freeman, have been primarily responsible for the much accepted notion that there have been “dramatic” advances in the economic situation of blacks in the recent past. Closing The Gap: 40 Years of Economic Progress for Blacks (CTG) is just the latest installment and reworking of this optimism. Freeman attributed the alleged progress to a “collapse” of labor market discrimination caused by “governmental and related antidiscrimination activity associated with the 1964 Civil Rights Act.” Smith and Welch, on the other hand, have always been somewhat agnostic about the …

5. Social Inquiry: Instructional Manual To Accompany 'Mark', Matthew Lipman, Ann Margaret Sharp
5. Social Inquiry: Instructional Manual To Accompany 'Mark', Matthew Lipman, Ann Margaret Sharp
Secondary School Curriculum
The task of social studies as a discipline is to focus students’ already developed thinking skills upon the conceptual foundation of the social sciences. Students will think about these underlying concepts if they can talk about them, and they will talk about what they perceive as controversial or problematic. This, then, is what Mark and Social Inquiry aim to do: to identify selected root issues in the social sciences and expose to students the conflicting concepts at the heart of each issue.
4. Mark (Novel), Matthew Lipman
4. Mark (Novel), Matthew Lipman
Secondary School Curriculum
The high school has been vandalized, and Mark is arrested at the scene of the crime. He claims he is a “victim of society.” But what is society? What forces hold it together or work to pull it apart? These are questions to which Mark and his classmates address themselves. What they seek are ways of evaluating social institutions, rules and values, so as to determine how well society is able to live up to the ideals which, at one time or another, have been set for it. They pay particular attention to the nature of law and crime, tradition, …

The Body Of John Merryman: Ex Parte Merryman, A Case Of Executive-Judicial Conflict Over The Suspension Of Habeas Corpus, Eric Paul Anderson
The Body Of John Merryman: Ex Parte Merryman, A Case Of Executive-Judicial Conflict Over The Suspension Of Habeas Corpus, Eric Paul Anderson
All Master's Theses
At the outbreak of the Civil War the Federal military arrested certain people whose loyalty was suspect. One victim, John Merryman, attempted to free himself by petitioning for a writ of habeas corpus. However, President Lincoln authorized the military to suspend the writ in such cases. The matter came before Chief Justice Taney who disputed the president's authority to suspend the writ and ruled in Merryman's favor. This thesis recounts the history of the habeas corpus process in Anglo-American law and its inclusion in the Constitution, Merryman's role in the first hostilities, his arrest, and the attempt to free him. …
Ada Lois: The Sipuel Story, Ruth E. Swain
Ada Lois: The Sipuel Story, Ruth E. Swain
Women in History & the Law
Ada Lois Sipuel Fisher (1924-1995) applied to the University of Oklahoma College of Law in 1946. Her application was denied, and in Sipuel v. Board of Regents of the University of Oklahoma, the U.S. Supreme Court ruled that Oklahoma had to provide her with the same opportunities for a legal education as it provided other citizens. Rather than admit her to OU, the state established a law school specifically for her. She refused to attend, and her attorneys argued that the school did not afford the same educational opportunities as OU. The Oklahoma Attorney General conceded, and Fisher was …
