Lisette Balint v. Carson City, Nevada

On Appeal from the United States District Court for the District of Nevada
No. CV-N-96-00141-HDM

From the Argument

In Balint v. Carson City, Nevada, 144 F.3d 1225, 1229 (9th Cir. 1998), a panel of this Court held that an employer who uses an "existing, bona fide seniority-based shift-bidding system" is never required to accommodate an employee's religious needs, no matter how great the burden that system imposes on an employee's faith or how slight the burden an accommodation would impose on the employer. This ruling, if sustained, would insulate the basest …

Robert Bagley v. Raymond School Department

On Appeal from the Cumberland County Superior Court

From the Argument

This is a straightforward case. Under Maine law, parents who live in cities and towns without government-run public schools may send their children to private schools at public expense. The plaintiffs are parents who live in such a town and who desire to send their children to Cheverus High School, a well respected Catholic school in Portland, Maine. The defendants refuse to pay for the plaintiffs' children's education for one reason and one reason only: Cheverus is a religious school. …

The Dream Of Diversity And The Cycle Of Exclusion, Stephanie M. Wildman Jan 1998

The Dream Of Diversity And The Cycle Of Exclusion, Stephanie M. Wildman

Trotter Review

The racial transformation of society envisioned in Martin Luther King's dream has been an emotional and powerful ideal. That vision has gone through its own transformation: it was first described as "integration," then "affirmative action," and then "diversity" and "multiculturalism." As each of these phrases acquired negative connotation from reactionary, conservative backlashes, a new phrase has had to be invented to carry forward that transformative vision. Yet the cycle of exclusion that gives privileges to the dominant cultural status quo continues.

Doris Simmons-Harris v. John M. Goff, Sue Gatton v. John M. Goff

On Appeal from the Court of Common Pleas for Franklin County

From the Argument

In United States v. Lopez, 514 U.S. 549, 552 (1995), the United States Supreme Court reminded us to "start with first principles." Accordingly, the Court reaffirmed just last summer in Agostini that it is a fundamental "first principle" of constitutional law that the First Amendment's Religion Clauses require government neutrality -- not hostility, fear, or suspicion -- towards religion. See 117 S.Ct. at 2014. Ohio's Pilot Program, which increases individual freedom …

Out Yet Unseen: A Racial Critique Of Gay And Lesbian Legal Theory And Political Discourse, Darren L. Hutchinson Jan 1997

Out Yet Unseen: A Racial Critique Of Gay And Lesbian Legal Theory And Political Discourse, Darren L. Hutchinson

Faculty Articles

The symbolic meaning of the phrase "tongues untied" has grown to identify a small, yet expanding, cultural, intellectual, and artistic "movement" aimed at revealing - or ending the silence around - the interactions of race, class, gender, and sexuality, what one participant in the movement described as "the transformation of silence into language and action." The work of this movement contrasts starkly with that of the "dominant" gay and lesbian culture and scholarship, where issues of racial and class subordination are neglected or rejected and where a universal gay and lesbian experience is assumed. The work of this movement highlights …

The Martinsville Seven: Virginia's Most Controversial Court Case, 1949 - 1951, Michael Dean Plemmons

History Theses & Dissertations

In January, 1949 seven black youths were arrested and charged with brutally beating and raping a white woman in Martinsville, Virginia. The judicial process lasted over two years and gained national and international attention. The defendants were ultimately found guilty and sentenced to death for their ruthless crime. The conviction came as no surprise. The evidence was overwhelming, but the verdict created controversy. Some claimed the youths were victims of Jim Crowism while others believed the punishment was just.

This study explores the events of the case and determines why Martinsville was unique given patterns of racial unrest throughout the …

Race And Political Empowerment: The Crisis Of Black Leadership, William E. Nelson Jr. Jan 1996

Race And Political Empowerment: The Crisis Of Black Leadership, William E. Nelson Jr.

William Monroe Trotter Institute Publications

W.E.B. Du Bois demonstrated poignant insight into the character of American society when he predicted in 1901 that the fundamental problem of the 20th Century would be the problem of the color line. Du Bois was writing in the aftermath of the first reconstruction that saw the institutionalization of Jim Crow and white dominance across the South. This period was symbolized by the infamous Plessy v. Ferguson decision in 1896. It was also marked by the capitulation of white Republican custodians of Reconstruction to the racist demands of southern politics, including the massive ejection of Black politicians from public office, …

Beyond The Civil Rights Agenda For Blacks: Principles For The Pursuit Of Economic And Community Development, James Jennings Jan 1994

Beyond The Civil Rights Agenda For Blacks: Principles For The Pursuit Of Economic And Community Development, James Jennings

William Monroe Trotter Institute Publications

Over the last several decades, this country has experimented with economic development and social welfare strategies and programs molded by liberals and conservatives, and embodied in the policies and politics of both Republicans and Democrats at the national level. However, given the continuing social and economic crisis, and gaps between African Americans and whites, it seems the approaches of both liberals and conservatives have been inadequate. Due to the failure of current policy strategies, in terms of black living conditions, debate in the black community should move from disagreements between liberals and conservatives, or Democrats and Republicans, towards the question …

The Prevalence Of Social Science In Gay Rights Cases: The Synergistic Influences Of Historical Context, Justificatory Citation, And Dissemination Efforts, Patricia J. Falk

Law Faculty Articles and Essays

Disjunctive legal change is often accompanied by a period of frantic activity as the competing forces of stasis and evolution vie for domination. Nowhere is the battle for legal change likely to be more sharply joined than when the findings of modern science, in their varied and multifarious forms, are pitted directly against prevailing moral or societal precepts. One of the latest incarnations of this trend is the battle over the legal recognition of gay "rights." In recent history, the courts have been inundated by gay litigants seeking the rights and protections already afforded other discrete groups within society. In …

Civil Liberties Constraints On Tribal Sovereignty After The Indian Civil Rights Act Of 1968, Robert Berry Jan 1993

Civil Liberties Constraints On Tribal Sovereignty After The Indian Civil Rights Act Of 1968, Robert Berry

Librarian Publications

The Indian Civil Rights Act of 1968 provided a legislative answer to the question of whether, and to what extent, fundamental civil liberties recognized in constitutional law should constrain federally recognized Indian Tribes in the exercise of their sovereign powers. In enacting this law, Congress weighed its desire to protect individuals from arbitrary and overly intrusive tribal actions against the tribes' interest in retaining their legal capacity to act as self-governing entities. Congress struck the balance between these two competing interests by drafting a bill of rights that reflected the particular circumstances of the tribes. The possibility of an appeal …

When Civil Rights Go Wrong: Agenda And Process In Civil Rights Reform, Charles F. Abernathy Jan 1993

When Civil Rights Go Wrong: Agenda And Process In Civil Rights Reform, Charles F. Abernathy

Georgetown Law Faculty Publications and Other Works

The aging of the persons leading the civil rights movement is only a metaphor for a more serious aging process that afflicts the movement. It is a sclerotic condition that has kept an old agenda and once-prodding - but now increasingly intolerant - ideas in place, a fixed way of thinking that has become more strident and resistant to change as it has become more complacent with itself. Once the opponent of conformity, some parts of the civil rights community now preach conformity within their communities. I see these not as indices of the venality of the civil rights movement, …
