In recent years, Congress has passed a number of laws that direct various government agencies to safeguard animal welfare. Our own agency has been involved principally in enforcing the Animal Welfare Act and the Horse Protection Act, and therefore we will limit this discussion to these two laws.

The Animal Welfare Act was passed in 1966 and amended in 1970 and 1976. The Act uses a system of licensing and registration to regulate a number of non-farm businesses and organizations. The federal law of wildlife has mushroomed during the past decade. Congress, in instances where certain species were suffering population crises, shed its historic reluctance to interfere with state wildlife management prerogatives. Opposition to federal intrusion has raised important constitutional issues, only some of which have been resolved definitively. Already the Congress and the courts have discarded some traditional assumptions about wildlife management, and the walls surrounding the traditional state prerogative to control resident wildlife are tumbling down. Endangered species protection has long been favored by many Americans, who watched regretfully as the numbers of American eagles, buffaloes and other species dwindled toward extinction. Only recently, however, has species protection become a matter of public controversy, subsumed in the more general "development v. environment" debate. In this Article, Professor Rosenberg surveys the federal government's role in species protection, with a special focus on the Endangered Species Act of 1973. Prompted by the much-publicized Supreme Court decision in the "snail darter case"--TVA v. Hill-Congress extensively amended the Act in 1978. The routine tasks of mammalogists whose research or curatorial activities include collecting, importing, processing, exporting, or interstate transporting of living or dead scientific specimens of mammals have become increasingly complicated by newly enacted (or more rigorously enforced) Federal regulations. These regulations were necessary largely because of the activities of non-scientists, but their provisions have had a tremendous impact on the activities of scientists (especially museum-based systematists and ecologists). Today bequests including trusts for the performance of religious services or for the care of gravesites are universally upheld, either under common law or specific authorizing statutes. In the few jurisdictions where such trusts are not regarded as charitable trusts, they are upheld as honorary trusts. When we turn to the testamentary dedication of property for the care of specific animals, we find no such general acceptance. Gifts for the care of specific animals, usually pets of the deceased testatrix, have been upheld only in England, Ohio and Kentucky, despite the fact that the scholarly literature in general favors the …
