The opportunity for private sector investment in space technology has increased dramatically in very recent times. The commercialization of this technology places new stresses not only on the technical skills of nations, but also on their legal and political institutions. New technologies such as remote sensing, which are inherently global in their effect, suggest the need for laws and legal institutions which have a similarly global perspective. Yet, the commercialization of space technology remains a high risk, long-term endeavor. Communications play a key role in the flow of information, data and ideas. They are one of the chief element of infrastructure, leading to social changes and economic development. The role of communications increased tremendously with the advent of direct TV broadcasts through satellites which are a powerful means of diffusing information, knowledge and education, as well as of recreation and fun.
An important characteristic of direct TV broadcasts is that various states can broadcast programmes to be received by anyone in the world. In other words these broadcasts do not reckon with state borders and political systems.

The paper describes the manner in which the United States is meeting its responsibilities under international law and treaty, including the Outer Space Treaty and the International Liability Convention, for national activities in outer space undertaken by means of launch vehicles or payloads launched from U.S. territory or facilities by private commercial enterprises organized or existing under the laws of the United States.
The paper refers to the international legal framework under which the Government of the United states is organizing to discharge its legal responsibility for such activities, and describes the basis in U.S. municipal law for the actions …

The Large Civil Aircraft Industry: Applying Legal Policy-Making Tools To Accommodate A Changing Industry, Dennis G. Terez

This note first examines the emergence of Airbus Industrie (Al or Airbus) and identifies some of the legal and policy instruments which the European governments have employed to make Al a successful competitor. After a brief discussion of the growing difficulties with subsidy policies, the note considers European Community legislation for a common European industrial policy and the creation of a European Export Bank as possible alternative solutions for maintaining Al's competitiveness. The note finally argues that international industrial agreements are necessary legal tools for effective regulation of the manufacture and sale of large civil aircraft. This article will propose several plans for allocating a common resource of the earth-the international orbit spectrum--among nations through mechanisms designed to introduce market incentives. The rights to orbital "parking places" are so defined as to permit their subdivision, recombination, and assignment in lease markets. The lease market approach accommodates the interests of both developed countries (DCs), who have the technology and domestic demand to establish satellite systems today, and less-developed countries (LDCs), who seek long-range planning to guarantee them access to the orbit spectrum at a time in the future when they, too, possess the capability and need. This article is a progress report, written at the beginning of 1983. It is about the unfolding of a new communications medium, satellite broadcasting, in Europe. It is very probable that by the time of publication, many new developments will have taken place.
