Disclosure Of Foreign Direct Investment In United States Agricultural Property, Edward C. Brewer, Iii Jan 1979

Disclosure Of Foreign Direct Investment In United States Agricultural Property, Edward C. Brewer, Iii

Vanderbilt Journal of Transnational Law

On October 14, 1978, Congress passed the Agricultural Foreign Investment Disclosure Act, to require reports by foreign persons of their holdings in agricultural property. The Act directs the Secretary of Agriculture to compile data from these reports, and to analyze the effect of foreign investment upon the agricultural economy. In its 1976 survey of foreign direct investment in the United States, the Department of Commerce found that, although sufficient data existed in most areas of the economy to support an assessment of the effect of foreign direct investment, data on foreign ownership of real estate was insufficient. This was attributed …

A New Approach To Grain Insect Control, G D. Rimes, M. T. Sexton Jan 1977

A New Approach To Grain Insect Control, G D. Rimes, M. T. Sexton

Journal of the Department of Agriculture, Western Australia, Series 4

Western Australian farmers now have a legal responsibility to control stored grain insects on their farms.

Ten species of insects, usually referred to collectively as 'weevils', have been 'declared' under the Agriculture and Related Resources Act.

In Western Australia, grain storage insects are not found in standing cereal crops. Thus, it should be possible to set up a clean delivery "pipeline" from the paddock to the C.B.H. bin.

The Agricultural Labourer In Canada: A Legal Point Of View, Kathryn Neilson, Innis Christie

The public has recently been made aware of special difficulties affecting farm labour. In August, 1973 the Report of a Federal Department of Agriculture team entitled "The Seasonal Farm Labour Situation in Southwestern Ontario" ' emphasized the deplorable living and working conditions, on some farms at least, of the seasonal labourers hired to harvest field crops in southwestern Ontario. Heavy media coverage erupted almost immediately, and there was renewed coverage in the autumn of 1974.2 Much less sensationally, through the spring and summer of 1974, the media gave coverage to special efforts by the government at both the Federal and …

The Role Of The Court Of Justice In The Development Of Agricultural Policy In The European Communities, Stanley D. Miller Jan 1975

The Role Of The Court Of Justice In The Development Of Agricultural Policy In The European Communities, Stanley D. Miller

Vanderbilt Journal of Transnational Law

Twenty-five years ago, the center of power for agricultural policy lay firmly in the national capitals. With the signing of the Treaty of Rome, that authority began a gradual flow from the Member States to the institutions of the EEC, particularly the Commission located in Brussels. The transition is not yet complete and has not been without its setbacks, but most Europeans and all the governments of the Member States now accept and support the reality of a Common Agricultural Policy (CAP). The innovative steps taken by the EEC in attempting to weld the agricultural economies of the several states …

Development Of The Rio Grande Compact, Raymond A. Hill Apr 1974

Development Of The Rio Grande Compact, Raymond A. Hill

Publications

Thirty-six years have elapsed since the Rio Grande Compact of 1938, N.M.S.A. Section 75-34-3 (Repl. 1968), was entered into by Colorado, New Mexico, and Texas, and approved by the United States of America. Administration of the Compact since then has been the responsibility of many different persons, few of whom had personal knowledge of the circumstances of the negotiation of this Compact. Consequently, there has been a growing tendency towards interpretation of some of the provisions of the Rio Grande Compact in a manner contrary to the intent of those who participated in its negotiation.

Mr. Hill has intimately connected …

Recent Legislation, J. Rodney Johnson

Much of this legislation deals with fine points not affecting the average lawyer in his practice. However, the following items of legislation should be of general interest to the attorney whose practice involves probate work or estate planning, even though he does not hold himself out as a specialist in these areas.

Racial Discrimination In Usda Programs In The South: A Problem In Assuring The Integrity Of The Welfare State, M. John Bundy, Allen D. Evans

Washington Law Review

Allowing the rural poor to stay on the land and to better their lives would be one significant contribution to alleviating the problems of the urban ghetto. Yet, at least as regards the southern black farmer and his family, the federal government has not only allowed its welfare farm programs to fail in wholesale fashion, but has acquiesced in and even affirmatively contributed to that failure. This comment offers some empirical data on rural southern life and describes three representative U.S. Department of Agriculture programs and their failures at the local level with regard to the black farmer and his …

New York Minimum Wage Act For Migrant Workers, Karen E. Kuntz Dec 1969

New York Minimum Wage Act For Migrant Workers, Karen E. Kuntz

University of Michigan Journal of Law Reform

The abject state in which most migrant workers in this country exist has recently become a matter of national concern. The increasing stridency of the migrants, personified by César Chavez in California, has resulted in recognition of the need for legislative assistance to rescue them from their plight. The migrant worker is unable to help himself, being burdened by a low annual income and an education level of only eight and a half years in school. In New York, the migrant's situation is aggravated by the powerful position of the crew leader or "farm labor contractor," who often determines workers' …

Compensatioon For Condemnation Of Land Enhanced In Value By Agricultural Allotment, Anon

Washington Law Review

Defendant's farm, including 550 acres devoted to production of cotton under an acreage allotment from the Department of Agriculture, was condemned by the federal government for an irrigation project. Defendant retained the right under section 1378 (a) of the Agricultural Adjustment Act to transfer its cotton quota to other property under its ownership, and did so. Trial before a jury resulted in an award to defendant based on the value of its property as a cotton farm, less the value of the section 1378 right retained. The government objected on the ground that the enhanced value to the land resulting …

Selling Reclamation Water Rights: A Case Study In Federal Subsidy Policy, Joseph L. Sax Nov 1965

Selling Reclamation Water Rights: A Case Study In Federal Subsidy Policy, Joseph L. Sax

Michigan Law Review

This situation raises some interesting questions about federal reclamation policy and about subsidy policy in general. Why should a program designed to give a needed service at reasonable rates evolve into one where the original recipients, at the end of their time of need, are also rewarded by the gift of a large capital asset? Moreover, why should that reward be given at the expense of their successors on the project, who, one would think, are equally the concern of the reclamation program? These are the questions ·with which this article will be concerned.

The Common Agricultural Policy: Crisis In The Common Market, Roland L. Hjorth Oct 1965

The Common Agricultural Policy: Crisis In The Common Market, Roland L. Hjorth

Washington Law Review

The future of this common agricultural policy, as well as that of the European Economic Community itself, however, has been made somewhat uncertain by France's decree, on July 1, 1965, of a "temporary boycott" of the meetings of the Council of Ministers of the Community due to a failure to agree upon the method of financing the Community's agricultural policy. This boycott may well have "triggered the most serious crisis in the bloc's seven year history," because the dispute is thought by some to be a mere symptom of a more fundamental conflict between France and her Common Market partners. …
