This study examines Lebanon’s Law on the Organization of the Judicial Court System, adopted by the Chamber of Deputies on July 31, 2025, and returned to the Chamber by the President of the Republic for further discussion, on September 5, 2025. It represents one of the most significant judicial reform initiatives since the Taif Agreement of 1989. The study traces the evolution of the Law’s provisions in successive drafts in light of the recommendations of the Venice Commission – the advisory body to the Council of Europe – and international standards regarding both institutional and individual judicial independence. The independence of the judiciary in Lebanon, as constitutionally guaranteed, carries a particular meaning that is embodied exclusively in the judicial function performed by any sitting judge issuing rulings in the name of the Lebanese people. The Constitution that elevates the judiciary to the level of a power does not provide itself for guarantees akin to the legislative and executive branches. Rather, it entrusts the determination of judicial safeguards to the legislature, under the oversight of the Constitutional Council. The Council has consistently interpreted these safeguards as measures that protect judges in the exercise of their functions by removing any …

The Lebanese administrative judiciary is undergoing a profound crisis, exacerbated by the broader institutional disintegration affecting the country. This crisis appears rooted in deeper and more specific causes: an alleged original illegitimacy of the institution and the recurrent instabilities that have marked its development. Today, this branch of justice operates at a minimal level, remains dependent of the executive, and struggles to fully guarantee the right to a fair trial. Two reform proposals aim to address this situation. A subsistence hunt in Kake, Alaska, during the COVID-19
pandemic sparked a lawsuit from the State of Alaska Department of Fish
and Game challenging the authority of the Federal Subsistence Board to
open the hunt. This lawsuit is a recent addition to a long history of the
State of Alaska’s resistance to federal enforcement of the Alaska National
Interest Lands Conservation Act provision establishing priority for rural
subsistence users. The Ninth Circuit ultimately affirmed the Federal
Subsistence Board’s authority to open the subsistence hunt.

Amicus curiae brief submitted by the American Immigration Lawyers Association and immigration law scholars in support of the respondents in Mullin v. Doe and Trump v. Miot before the Supreme Court of the United States. The brief argues that the Temporary Protected Status (TPS) statute strictly limits the Executive Branch's authority to terminate TPS designations and requires continuation of protection unless the statutory conditions justifying designation no longer exist. The amici further contend that TPS serves a critical humanitarian function by protecting individuals from removal, detention, and loss of work authorization while conditions in designated countries remain unsafe.

The anticipated demise of the independent agency is a saga that implicates Congress as much as it does the President or the Supreme Court. By capitulating to presidential initiatives and failing to defend their institutional prerogatives, Congress has facilitated presidential control of the administrative state. Indeed, irrespective of whether the Court formally repudiates Humphrey’s Executor, Congress has largely acquiesced to a regime whereby presidents essentially control independent agencies. By highlighting the competing incentives of Congress and the White House, this Essay explains the rise of presidential unilateralism vis-à-vis independent agencies. The Trump Administration has been prone to brazen power plays. These actions have three basic characteristics: they are dramatic deviations from conventional governance, generating headlines and online clicks; their legal (and sometimes factual) foundations are tenuous; and they are potentially effective even if they are ultimately held lawful. This Essay analyzes this phenomenon. It argues that such power plays can be a rational strategy for a president under certain circumstances. Power plays can help dominate the news flow and energize the political base. They can also cause behavior shifts in their targets, even when litigation would be likely to overturn …

Article III’s heightened concreteness standard for statutory harms takes federal judges deep into legislative terrain, jeopardizing statutory damage provisions and confining Congress to post hoc solutions rather than preemptive strikes. The Supreme Court has insisted that creating a cause of action is a legislative function. At the same time, its recent standing cases instruct lower federal courts to permit suit on statutory injuries only when they find actual harm that bears a tight connection to injuries recognized at common law. Arbitrary and capricious review under the Administrative Procedure Act (APA) operates as an important agency-accountability tool when invoked as intended. But the recent U.S. Supreme Court case Department of Homeland Security v. Regents of the University of California and subsequent lower federal court cases have opened the floodgates to a more searching and potentially activist review. The U.S. Supreme Court now has vast control over its agenda: It has the power to pick and choose not only what cases it will hear through writs of certiorari, but also what specific legal questions within those cases it will consider. As a result, the Court never revisits a precedent unless it has made a prior, discretionary choice to put the viability of a precedent on its agenda. The brief supports rehearing en banc and argues that 8 U.S.C. § 1225(b)(2)(A) does not authorize mandatory, no-bond detention of noncitizens apprehended within the interior of the United States. Drawing on statutory text, legislative history, and the historical development of immigration detention, the amici contend that such detention authority has historically been limited to individuals seeking admission at the border.

Recent developments, including reductions in the federal workforce, effective suspension of certain enforcement activities, and attempted centralization of independent agency rulemaking in the White House, have significantly weakened administrative agencies. This administrative retrenchment is concerning as private enforcement of a number of consumer protection statutes has been simultaneously curtailed through the Supreme Court’s decisions in Spokeo, Inc. v. Robins and TransUnion LLC v. Ramirez, which dramatically narrowed plaintiffs’ standing. These decisions rely in part on a vision of strong executive authority, positing that broad private standing conflicts with an Article II framework where a politically accountable President faithfully implements laws …
