Overcoming "Stigmas": Lesbian And Gay Districts And Black Electoral Empowerment, Darren Rosenblum

Elisabeth Haub School of Law Faculty Publications

This Article argues that the renewed disenfranchisement of blacks from districting remedies may be curbed through the use of community-based evidence similar to that used by lesbian and gay activists. Section One will explore the current position of blacks in the districting system, scrutinizing recent changes in the law that deprive blacks of their previously “protected” status under the Voting Rights Act. In 1995, the Miller v. Johnson decision notably held that race cannot be the predominant factor in the drawing of district lines. Blacks wishing to ensure that their interests are represented in the political process will therefore need …

The Right Of Participation In Development Projects, Celia R. Taylor

Sturm College of Law: Faculty Scholarship

The concept of popular participation is "the principal means by which individuals and peoples collectively determine their needs and priorities and ensure the protection and advancement of their rights and interests." In the context of political and civil rights, popular participation encourages involvement in the formation and conduct of political institutions on all levels, as proponents of the burgeoning "govemance" movement recognize. For example, participation enforces the rights of free speech, free assembly, and free press, as those who take part in political debates and discussion share information and beliefs. In addition, popular participation enforces economic, cultural, and social rights, …

The Place Of Religious Argument In A Free And Democratic Society, Robert Audi Nov 1993

The Place Of Religious Argument In A Free And Democratic Society, Robert Audi

San Diego Law Review

This Article provides an account of the notion of a religious argument, distinguishes several roles of religious arguments in a liberal democracy, and defends a set of principles for their proper use in such a society. The author argues that it is appropriate that citizens apply a kind of separation of church and state in their public use of religious arguments, especially in advocating laws or public policies that restrict liberty. More specifically, the author contends that whatever religious arguments one may have in such cases, one should also be willing to offer, and be to a certain extent motivated …

J.L. Brierly And The Modernization Of International Law, Carl Landauer Feb 1993

J.L. Brierly And The Modernization Of International Law, Carl Landauer

Vanderbilt Journal of Transnational Law

In this Article, the author provides an analysis of a classic of international law, The Law of Nations, by J.L. Brierly. The author describes Brierly as an international legal scholar whose modernization of international law involves an emphasis on fact and complexity, an emphasis that is ultimately little more than a gesture. The author then examines the narrative structure of The Law of Nations and indicates the normative messages disclosed in Brierly's telling of the story of international law. Finally, the author describes Brierly's effort to describe international law as occupying a political realm while Brierly's evolutionary optimism made him …
