Respecting Parents' Fundamental Rights In The Adoption Process: Parents Choosing Parents For Their Children, Teri Dobbins Baxter Jan 2014

Respecting Parents' Fundamental Rights In The Adoption Process: Parents Choosing Parents For Their Children, Teri Dobbins Baxter

Scholarly Works

The Supreme Court has a long history of recognizing parents’ fundamental right to direct the upbringing of their children. While courts have recognized that this right requires deference to parents’ decisions regarding education, religion, and medical decisions, little attention has been paid to parents’ fundamental rights in the adoption process. Specifically, relatively few courts or scholars have addressed parents’ right to choose adoptive parents if the biological parents voluntarily agree to terminate their rights and place the child for adoption. Because choosing adoptive parents for their child is an exercise of the right to control the care and custody of …

Intercultural Human Rights Law Review

I am grateful to Mr. Mathias Nebel for the invitation to take part in this Parallel Event organized by the "Fondation Caritas in Veritate," addressing the topic of "The Role for Religions in the Fight against Contemporary Forms of Slavery." I also thank H.E. Archbishop Silvano Tomasi for moderating today's event, and Ms. Urmila Bhoola for offering what I'm certain will be thoughtprovoking concluding remarks. Human Trafficking In Finland, Sari Latomaa Jan 2014

Human Trafficking In Finland, Sari Latomaa

Intercultural Human Rights Law Review

Human trafficking is one of the largest criminal industries in the world. Human trafficking, also referred to as modem-day slavery, ruthlessly intervenes with a person's freedom and human dignity. It is a widespread phenomenon all over the world and no country is completely immune to it. Countries can act as places of source, transit or destination. The perpetrators take control of the victims and take away their freedom for the purpose of exploitation, prostitution and other sexual abuse, forced labor or trade in bodily organs. Victims have no control over their work, living conditions or movement, and cannot choose whether …

Rules Of Disengagement: "Low Skill" Migrant Workers, Law And The Social Dimensions Of Exclusionary Inclusion, Brendan Breckman Jowett Jan 2014

Rules Of Disengagement: "Low Skill" Migrant Workers, Law And The Social Dimensions Of Exclusionary Inclusion, Brendan Breckman Jowett

LLM Theses

This thesis interrogates social exclusion among migrant workers under the NOC C & D (“low skill”) occupational stream of Canada’s Temporary Foreign Worker Program, a relatively new, fast-growing, and highly diverse stream which brings migrant workers into industry sectors and social settings where they were never seen before. The author develops a framework for understanding law’s role in producing social exclusion, and applies it to ethnographic data collected through interviews with migrant justice advocates and migrant workers in Brandon, Manitoba. This thesis ultimately establishes that migrant workers need not face spatial separation, discrimination from the community, or a historically gendered …

Adjudicating Human Rights In Transitional Contexts: A Nigerian Case-Study, 1999-2009 , Basil Emeka Ugochukwu Jan 2014

Adjudicating Human Rights In Transitional Contexts: A Nigerian Case-Study, 1999-2009 , Basil Emeka Ugochukwu

PhD Dissertations

While transitional justice and democracy literature bristles with the expectation that human rights conditions would improve with the progression from the “darkness” of a dictatorship to the “light” of democratic rule, Nigeria’s transition to civil rule in 1999 would seem to provide a sobering contra-reality. Democracy does not seem to have produced a better human rights environment in the post-transition Nigerian context. This dissertation answers the question why the restoration of civil rule in Nigeria has not translated to results in human rights practices that come close to matching the expectations of its citizens and the predictions of transitional justice …

The Death Knell Of Issue Certification And Why That Matters After Wal-Mart V. Dukes, Andrey Spektor Jan 2014

The Death Knell Of Issue Certification And Why That Matters After Wal-Mart V. Dukes, Andrey Spektor

St. Thomas Law Review

This article begins by examining the effect of Dukes, detailing in Section I how the Court's pronouncement has been felt most acutely by class plaintiffs seeking to certify Rule 23(b)(3) classes. Section II explains why that is significant in light of the Court's most recent cases and orders. It profiles Comcast's unusual trip through the appellate process and offers two competing interpretations of the Court's opinion around which distinct camps at the lower court level have already coalesced. Neither camp, however, the Section argues, understands the disagreement between the majority and dissenting views in Comcast or the Court's other 2013 …

Diminished Returns: The Exorbitance Of Collecting Dna From All Arrestees, Carlos Jordi Jan 2014

Diminished Returns: The Exorbitance Of Collecting Dna From All Arrestees, Carlos Jordi

St. Thomas Law Review

This comment will examine the effects of a criminal justice system where DNA is collected from everyone who is arrested, regardless of the seriousness of the charge. Part L.A will begin with an analysis of King to provide an understanding of how the Supreme Court decision may permit states to collect DNA from all arrestees. DNA is used in the criminal justice system because of its ability to effectively identify people. Part I.B discusses DNA science and provides a cursory understanding of how information is gathered from an individual's genetic code. Part I.C displays how law enforcement uses DNA for …

The Judicial Vision Of Contract - The Constructed Circle Of Assent And Printed Terms, John E. Murray Jr. Jan 2014

The Judicial Vision Of Contract - The Constructed Circle Of Assent And Printed Terms, John E. Murray Jr.

St. Thomas Law Review

The perennial dilemma of modern contract law is the effect to be accorded standardized terms, the printed "boilerplate" terms that appear in the overwhelming majority of contracts and are typically ignored. The dilemma has been exacerbated by recent decisions addressing the operative effect of standardized terms that appear after the contract has been formed. The confusion emanating from such "terms-later" cases has made even the chronology of contract-making uncertain.

Comparative And Normative Analysis Of Damages Under The Sga And The Cesl, Reza Beheshti Jan 2014

Comparative And Normative Analysis Of Damages Under The Sga And The Cesl, Reza Beheshti

St. Thomas Law Review

This article strives to analyze the rules concerning monetary damages under two different legal regimes for the sale of goods: the Sale of Goods Act of 1979 ("SGA") and the Proposal for a Common European Sales Law in 2011 ("CESL"). It is not the purpose of this article to provide an exhaustive exposition of the doctrines of either regime. Instead, the focus will be on the central aspects of monetary damages, such as the aim of damages and general rules governing the measure of damages. It should be noted that inevitably there will be some references to the commentaries on …

Ghosts Have Rights Too! A New Era In Contractual Rights: Third-Party Invocation In Forum Selection Clauses, Monika L. Woodard Jan 2014

Ghosts Have Rights Too! A New Era In Contractual Rights: Third-Party Invocation In Forum Selection Clauses, Monika L. Woodard

St. Thomas Law Review

In the wake of non-party adhesion becoming an increasingly large problem for the federal and state courts, this comment proposes a modification to the test set forth by Judge Posner in Raintree. This comment also makes a call to the Supreme Court for action in determining a ceiling standard for non-party invocation of forum selection clauses. Part II of this comment considers the direction of the Supreme Court in past decisions on forum selection clauses in general and the implications of these decisions on the future of the clauses. Part III discusses the relatively new question surrounding forum selection clauses …

Getting Species On Board The Ark One Lawsuit At A Time: How The Failure To List Deserving Species Has Undercut The Effectiveness Of The Endangered Species Act, James Jay Tutchton Jan 2014

Getting Species On Board The Ark One Lawsuit At A Time: How The Failure To List Deserving Species Has Undercut The Effectiveness Of The Endangered Species Act, James Jay Tutchton

Animal Law Review

This Article, presented by a former general counsel for WildEarth Guardians, discusses the organization’s attempts to protect imperiled species under the Endangered Species Act (ESA). By comparing extinction patterns from the past, we can see that the human impact on the Earth’s biodiversity is similar to that caused by past geological catastrophes. The ESA is the Noah’s Ark of our time, providing the best opportunity to help stem the tide of extinction. In analyzing the ESA, it is clear that the Act serves important human interests and is effective when utilized as intended. However, the United States Fish & Wildlife …

The Eureka Myth: Creators, Innovators, And Everyday Intellectual Property, Jessica Silbey Jan 2014

The Eureka Myth: Creators, Innovators, And Everyday Intellectual Property, Jessica Silbey

Books

Are innovation and creativity helped or hindered by our intellectual property laws? In the two hundred plus years since the Constitution enshrined protections for those who create and innovate, we're still debating the merits of IP laws and whether or not they actually work as intended. Artists, scientists, businesses, and the lawyers who serve them, as well as the Americans who benefit from their creations all still wonder: what facilitates innovation and creativity in our digital age? And what role, if any, do our intellectual property laws play in the growth of innovation and creativity in the United States?

Incentivizing …
