Recent Decision, Duane A. Wilson
Recent Decision, Duane A. Wilson
Vanderbilt Journal of Transnational Law
The Fifth Circuit Court of Appeals has taken the instant opportunity to write an essay on the law of search and seizure on the high seas. Applying Ramsey, the majority found authority for the Coast Guard action, either under section 89(a) or through the consent of the Panamanian Government. Although both conclusions are open to dispute, the major question arises from the court's analysis of the constitutionality of the Coast Guard action. While a firm resolution of the confusion engendered by previous conflicting Fifth Circuit decisions is certainly desirable, the instant court's resolution fails to provide necessary analytical clarity. Judge …

Executive Power--President Has the Power to Block and Transfer Iranian Assets, Nullify Prejudgment Attachments, and Suspend Claims of United States Nationals in Implementing Executive Agreement for Release of Hostages
Petitioner sued the United States and the Secretary of the Treasury to enjoin enforcement of Treasury Department regulations and executive orders implementing an executive agreement with Iran that would nullify petitioner's prejudgment attachment of Iranian bank assets and prevent further litigation of its claim against Iran. The events leading up to this suit are relevant to a discussion of the legal issues.

While few commentators question the international status of the Community in relation to the Member States and those countries with which it has negotiated treaties, the question of whether the Common Market possesses a universally recognizable personality remains open. In determining the international status of the United Nations, the ICJ in the Reparations Case stated that fifty states, "representing the vast majority of the members of the international community, had the power in conformity with international law to bring into being an entity possessing an objective international personality and not only personality recognized by them alone. If this recognition standard …

Applying The International Law Of Sovereign Immunity To The States Of The Union, John M. Rogers
Applying The International Law Of Sovereign Immunity To The States Of The Union, John M. Rogers
Law Faculty Scholarly Articles
A state of the Union may preserve its immunity from suit in its own courts, and the Constitution restricts its amenability to suit in the federal courts. Yet in Nevada v. Hall the Supreme Court held that in a motor-vehicle accident case a state cannot claim a constitutional immunity from suit in the courts of a sister state. The Court indicated, however, that if a suit involved a defendant state's “capacity to fulfill its own sovereign responsibilities,” different constitutional considerations might control. In vigorous dissents Justices Blackmun and Rehnquist argued that the reasoning of the majority precluded even this possibility. …
Mining The Deep Seabed Implications For International Law And American Foreign Policy, Steven H. Fitzgerald
Mining The Deep Seabed Implications For International Law And American Foreign Policy, Steven H. Fitzgerald
Graduate Program in International Studies Theses & Dissertations
Whether or not the United States may someday face a mineral shortage, the need for a coherent, unified minerals policy is critical to national objectives and national security. Deep-sea mining may be the answer to American (and world) mineral needs in the twenty-first century. However, there are numerous problems which must be dealt with and resolved in the near future, in order to enable the U.S. (and the world community) to take advantage of vast undersea resources. Deep-sea mining requires the development of technology, tremendous capital investments, and years of labor before production can begin. U.S. policy makers must decide …

The Transfer Of Technology To Latin America, Gabriel M. Wilner
Scholarly Works
The transfer of technology to Latin America has taken place through both the licensing process and direct investments by foreign enterprises that are often transnational corporations. National law has concerned itself first with the creation of rights in technological knowledge and the protection of these rights by law. The regulation of these rights as set out in contractual relationships and the regulation of direct investment, particularly the technological component thereof, were dealt with thereafter. Other matters such as the repatriation of profits (exchange control), customs controls, and various taxes have also become a part of the national regulatory scene today. …

In determining the distribution of the invisible resources of the space environment; e.g. radio frequencies and geostationary orbital positions; through such international institutions as the UN, ITU, and UNESCO; much deference will be accorded to the prerogative of national choice. Such choice must, of necessity, be conditioned by suitable concerns for the well-being of the entire world community.

Unctad's Draft Code Of Conduct On The Transfer Of Technology: A Critique, James W. Skelton, Jr.
Vanderbilt Journal of Transnational Law
UNCTAD's fourteenth plenary meeting on May 6, 1980, produced the latest of several attempts to draft such a code. The document is entitled "Draft International Code of Conduct on the Transfer of Technology" (Draft Code), and this draft will be the primary subject of analysis in this article. The drafters of the code face a number of problems, the least of which is the ultimate determination of the code's legal character and, consequently, its legal effect. This determination and other problem areas confronting the drafters, including the code's special preferences for developing countries, the core chapter on restrictive practices, and …

Unauthorized Duplication Of Sound Recordings: Transnational Problem In Search Of A Solution, Vassilios C. Gatzimos
Vanderbilt Journal of Transnational Law
Recent estimates place the global recording industry's losses to pirates, counterfeiters, and bootleggers at $1.5 billion annually, and losses due to home taping at over $2 billion annually. Even in a thriving industry, these losses are staggering. The purpose of this Note is to survey the scope of the problem of unauthorized duplication of sound recordings and to examine international and national efforts by governments and the recording industry to eradicate this problem.

Ocean Thermal Energy Conversion: The Codification Of A Potential Technology, Maureen O`C. Walker, Murray A. Bloom
Vanderbilt Journal of Transnational Law
Rapid technological advancement has been the hallmark of post-industrial societies for more than a quarter of a century. This progress is forever disrupting our established legal systems. Nowhere is this tension more evident than in the discoveries of the developing energy industry. An exception to this process is the infant industry of ocean thermal energy conversion (OTEC). The United States Congress recently enacted legislation establishing the legal framework for the OTEC process, which has not yet been proven on a commercial scale.
OTEC is a form of solar energy that takes advantage of the vertical temperature differentials in those regions …
