Amicus Briefs & Court Filings
Brief in support of Petitioner.
SUMMARY OF ARGUMENT: This Court has “consistently held that a conviction obtained by the knowing use of perjured testimony is fundamentally unfair” because it “involve[s] a corruption of the truth-seeking function of the trial process.” United States v. Agurs, 427 U.S. 97, 103–04 (1976). Here, the Eleventh Circuit acknowledged that the state committed a Giglio violation when it permitted a jailhouse informant to falsely testify at trial that he lacked a violent criminal record despite prosecutors knowing that he did. The Eleventh Circuit deemed this violation harmless, however, based on its erroneous consideration of …

Climate change litigation has been increasingly used in different countries to fight the climate crisis through various judicial systems. As of December 2022, there have been over 2,000 climate-related cases in international courts, federal courts, and more local courthouses, with litigation taking place in 65 different jurisdictions. Climate change litigation includes “cases that raise material issues of law or fact relating to climate change mitigation, adaptation or the science of climate change.”

The Foundation’s impact is increasing yearly, evidenced by a 42% increase in scholarship awards in 2024, providing $44,000 to 15 recipients. It also provides grants to statewide organizations delivering dental care to uninsured, impoverished, and underserved populations, awarding $141,500 in 2025. A high-profile program is the biannual Michigan Mission of Mercy (MOM), which provided over $1.1 million in donated care in Flint in 2024. The revision of Law 39/2008 on State Ministries, which removes the maximum limit of 34 ministries, has become a polemic issue in society. Analysis shows that increasing the number of ministries is not urgent and runs counter to the spirit of bureaucratic reform. This policy also does not improve the effectiveness of government administration, because the main issue affecting the effectiveness of ministries lies in the quality of ministers, not the number of ministries. The addition of ministries has the potential to cause overlapping authorities, regulatory disharmony, and sectoral egos. From an efficiency perspective, this policy places a heavy burden …

Doktrin Penyalahgunaan Hak (Abus Des Droit), Syukron Salam
Jurnal Hukum & Pembangunan
The present article examines the emergence of the doctrine of abus de droit in France in the mid-twentieth century through an analysis of key judicial decisions and the debates that followed them. The study commences with an exposition of the manner in which the evolution of capitalism, concomitant with the escalating economic disparity and the propagation of societal challenges, has influenced the judicial approach to the abstract Roman-law tradition of absolute rights. In light of this, the article contends that the civil-law tradition exhibited a fundamental flaw in its conceptualisation of rights as absolute, thereby overlooking objections that were firmly …
Rethinking The Key Role Of Private Antitrust Enforcement, Filippo Lancieri
Rethinking The Key Role Of Private Antitrust Enforcement, Filippo Lancieri
Georgetown Law Faculty Publications and Other Works
This Article focuses on the institutional design of American competition policy. It argues that any long-term effective revival of U.S. antitrust policy requires a better acknowledgement of the key and irreplaceable role played by private litigation and proposes a rethink of private anti-trust enforcement policy.
To unpack the nuanced interconnection between public and private competition enforcement, the Article begins by tracing the rise and fall of private antitrust. It builds on a novel, hand-coded, and comprehensive analysis of the entire Supreme Court antitrust track record—all 474 decisions over 130 years—to outline how an ideologically …
Should The Army Be Involved In Divorce? Re-Examining The Pre-Divorce Defaults For Spousal Support, Artem M. Joukov, Thomas Godfrey
Should The Army Be Involved In Divorce? Re-Examining The Pre-Divorce Defaults For Spousal Support, Artem M. Joukov, Thomas Godfrey
MC Law Review
Army Regulation 608-99 assigns a large portion of a Soldier’s paycheck to the spouse upon marital separation. The assignment occurs without a hearing, discovery, or consideration of critical evidence which might moderate the amount of support. The obligation rests on the Soldier to obtain a court order or spousal agreement to reduce the financial burden. The adversarial nature of modern divorces renders these requirements unrealistic. Amending the regulation would ease the burden of the Soldier, which is desirable in light of the ongoing recruitment crisis and the need to attract recruits and retain those already in the service.
Using Political Privilege To Profit: Insider Trading In The Government And S. 2463'S Alleged Attempt To Stop It, Allison K. Dooling
Using Political Privilege To Profit: Insider Trading In The Government And S. 2463'S Alleged Attempt To Stop It, Allison K. Dooling
MC Law Review
Insider trading is generally illegal within the United States. However, members of Congress are notorious for regularly engaging in stock trades based on government information that mirrors insider trading. In 2023, Senators Gillibrand and Hawley proposed a bill, unlike any such proposed before, to put an ultimate ban on government insider trading: the “Ban Stock Trading for Government Officials Act” or S. 2463. On its face, S. 2463 appears to address the criticisms surrounding government insider trading. It not only increases regulation and reporting standards but also bans government officials, their spouses, and their dependents from owning any stock during …

Liening On The Court: Examining Loblolly Properties, Llc V. Le Papillon Homeowner's Association, Inc. And The Future Of Lien Priority In Mississippi, Thomas C. Jones
MC Law Review
The Mississippi Supreme Court in Loblolly Properties, LLC v. Le Papillon Homeowner’s Association, Inc. held that the nonjudicial foreclosure of a deed of trust does not extinguish restrictive covenants to pay HOA fees that were filed after the recording of the deed of trust. In doing so, the Court blatantly disregarded the fundamental understanding of lien priority in Mississippi, and also failed to explain how the policy behind lien priority would further be upheld in the future. This decision by the Supreme Court is incorrect and places Mississippi in a “super-minority” of jurisdictions on this issue. The overwhelming majority of …

Brief Of Edward A. And Doris Zelinsky In The Appellate Division, Third Department, New York Supreme Court, Edward A. Zelinsky, Doris Zelinsky
Amicus Briefs
To combat COVID, New York in 2020 forbade an out-of-state employee like the petitioner to commute into his New York office, forcing him to instead work at his home in Connecticut. New York now takes the remarkable position that it can tax the income Governor Cuomo forced this out-of-state employee to earn at his home exclusively outside New York. That position is as wrong as it sounds.
Both as a matter of New York law and of federal constitutional law under the Due Process and dormant Commerce Clauses, New York may not tax the income the petitioner earned exclusively at …
Did Copyright Fail Music Artists?, Rachel Landy
Did Copyright Fail Music Artists?, Rachel Landy
Articles
Music soundtracks our lives, supports over two million domestic jobs annually, and is listened to more than ever before. The record industry is thriving, having made over $17 billion in 2024. Yet, many professional artists are barely surviving. Artists signed to record deals lament royalty payments that amount to a fraction of a penny for each stream of their songs. So where is all the money going, and who, or what, is to blame? Public rhetoric and existing legislative proposals implicate copyright as a guilty party. But are those concerns justified?
This Article unpacks the music supply chain. It builds …

Divine Affirmation And The Prophet's Consolation During Times Of Trial: An Analytical Study Of The Objectives Of Tribulation In The Holy Qur'an, Ahmad Bin Ali Al-Zamli
University of Tabuk Journal for Humanities and Social Sciences
This study seeks to uncover the profound theological dimensions of the Qur'anic concept of the Prophet Muhammad's (peace be upon him) consolation, through an analytical examination of selected verses that manifest divine psychological support and reinforcement during moments of missionary adversity and intellectual challenge. It investigates the mechanisms of divine affirmation as a central means of cultivating doctrinal steadfastness and safeguarding the prophetic message in the face of evolving trials. Adopting an integrative, textually grounded analytical methodology, the research is anchored in the thematic pillars of monotheism, divine decree, faith in the unseen, and the Hereafter. It draws upon the …

Beautiful Articulation In Confirming Ali's Commendation Of The Companions In Nahj Al-Balagha: An Inductive-Analytical Study, Ghazwa Suliman Awad Alanazi
University of Tabuk Journal for Humanities and Social Sciences
This study investigates Ali ibn Abi Talib's (may Allah be pleased with him) perspective on the Companions, particularly the Muhajirun and Ansar, as presented in Nahj al-Balagha, aiming to clarify his relationship with them and address a central point of Sunni-Shi'a divergence. Employing inductive and analytical approaches, it scrutinizes narrations attributed to Ali. Key findings reveal: (1) Nahj al-Balagha, compiled by al-Sharif al-Radi, holds prominence among Shi'a, yet Sunnis question its authenticity due to the lack of verifiable chains of transmission; (2) Ali consistently praised the Companions as exemplars of devotion and asceticism; (3) He specifically extolled the Muhajirun for …

The Rhetoric Of Conceptual Metaphors In The Textbook Al-'Arabiyya Bayna Yadayk For Non-Native Speakers: A Cognitive Approach, Fawzi Ali Ali Soileh
University of Tabuk Journal for Humanities and Social Sciences
This research, entitled The Rhetoric of Conceptual Metaphors in the Textbook Al-'Arabiyya Bayna Yadayk for Non-Native Speakers: A Cognitive Approach, aims to examine the textbook prescribed for non-native learners at King Khalid University. The study explores the communicative dimension and the cognitive power that contributed to the construction of the book, in an attempt to answer a fundamental composite question: How did the cognitive mind construct its own metaphorical world within Al-'Arabiyya Bayna Yadayk? And what conceptual metaphors extended their influence in shaping this textbook? The key finding is the experts' sound awareness in addressing the needs of this diverse …

University of Tabuk Journal for Humanities and Social Sciences
This research aims to identify the methodology adopted by Abu Hayyan al-Andalusi in his book "Al-Tadhiyal wa al-Takmil" for correction, through a descriptive and analytical study that traces the mechanisms of correction and weighting in his treatment of grammatical issues, and the extent of his adherence to the methodological controls he set for himself. The research begins with an introduction explaining the importance of the research, its problems and objectives, and previous studies, followed by a preface on the importance of judgmental terms in Arabic grammar. The first section focuses on defining the concepts of "correct" and 'weighting' in grammatical …

University of Tabuk Journal for Humanities and Social Sciences
In this research, I studied one of the letters of the scholar Shihab al-Din al-Khafaji (1069 AH), related to the interpretation of verse 21 of Surat al-Jathiya. In it, he - may God have mercy on him - took care to explain the readings and ways of parsing in the verse upon which the meaning depends, and he conveyed the statements of scholars on that, and he was concerned with highlighting the rhetorical aspect of the verse. In my study, I followed the scientific method followed in investigation, and I came out with a number of results, the most important …
