The Future Of Kinship Care: What Could Make This Ideal More Attainable For Families?, Dani Scudder

In recent years, there has been a radical shift by child protective agencies to look towards extended family before placing a child in foster care.1 Placing children with family or fictive kin, people who are not related but still important to that child's life, is called kinship care.2 This shift is a result of increased research surrounding the emotional and physical benefits of kinship care for displaced youth.3 Although professionals agree that placing children with relatives reduces trauma and enhances outcomes, the ability of relatives to care for their extended family members is hindered by financial and …

Federal legalization of marijuana has the potential to drastically reform the criminal justice system as thousands of Americans face lifelong penalties for simple drug offenses, especially communities of color who are prosecuted at much higher rates compared to white individuals.
Today, possession of marijuana is the leading drug offense for which Americans are arrested.1 Every year approximately 550,000 individuals are arrested for cannabis offenses, typically possession.2 This is because marijuana is the most common illicit drug used in the United States.3 In 2021, over 52.2 million Americans consumed cannabis in some form.4 Across the population, marijuana …

What A Waste: The Prosecution Of Hazardous Substances Crimes During The Trump Administration, Joshua Ozymy, Ph.D., Melissa Jarrell Ozymy, Ph.D.

The Trump Administration went to great lengths to roll back environmental regulatory and enforcement efforts. Yet, researchers know very little about the impact of the Administration on the criminal prosecution of hazardous substance crimes. This study utilizes content analysis of EPA criminal investigations leading to prosecution during the Trump Era to analyze charging and sentencing patterns and illustrate the greater themes that emerged during this period. Prosecutions are dominated by hazardous waste (48%), pesticide (41%), and lead-based paint (11%) crimes. Results show prosecutors were able to pursue crimes involving significant harm and culpable conduct, while securing over $90 million in …

The Procedural Justice Industrial Complex, Shawn E. Fields
The Procedural Justice Industrial Complex, Shawn E. Fields

The singular focus on procedural justice police reform is dangerous. Procedurally just law enforcement encounters provide an empirically proven subjective sense of fairness and legitimacy, while obscuring substantively unjust outcomes emanating from a fundamentally unjust system. The deceptive simplicity of procedural justice – that a polite cop is a lawful cop – promotes a false consciousness among would-be reformers that progress has been made, evokes a false sense of legitimacy divorced from objective indicia of lawfulness or morality, and claims the mantle of “reform” in the process. It is not just that procedural justice is a suboptimal type of reform; …
Big Brands Stay In Your Lane, Small Designers Made It First : An Examination Of The Harmful Effects The Lack Of Copyright Protection Has On Small Apparel Designers, Merjan Kareem
Florida A & M University Law Review
This paper aims to emphasize the importance of expanding current United States (“U.S.”) copyright law (“law”) to include protection for apparel designs, as the lack of such protection has a multitude of adverse consequences for small individual apparel designers (“small designer”).

Why I Will Not Stop Teaching Law Students To Think Critically About Race: The Attack On Teaching About The Role Of Race In Law, Leroy Pernell
Why I Will Not Stop Teaching Law Students To Think Critically About Race: The Attack On Teaching About The Role Of Race In Law, Leroy Pernell

As someone who has been involved in legal education teaching for over 40 years and as someone who was drawn to legal education as an alternative to a career more directly devoted to litigation concerning racial justice, so that others might be encouraged to explore critically both what race has meant to our legal system and how we might collectively counter its negative influence, the “Stop W.O.K.E act” presents a real and present danger. Thus, in August of 2022 I agreed to be the lead named plaintiff in Pernell, et. al. v. Florida Board of Governors of the State University …
The Roberts Court And The Unraveling Of Labor Law, Courtlyn G. Roser-Jones
The Roberts Court And The Unraveling Of Labor Law, Courtlyn G. Roser-Jones
Minnesota Law Review Vols. 106:2 onward (2021-present)
Labor law comprises several doctrines and procedures that oversee the relationships between employers, unions, and the workers they represent. These doctrines—the duty of fair representation, exclusivity, good-faith bargaining, captive-audience speech, and rights of equal access—are all component threads to a tapestry designed to facilitate widespread organizing and collective bargaining. Yet the Roberts Court has brushed aside how entwined these threads are and, in so doing, has undercut labor law’s far-reaching mandate. Likewise, this Court has disregarded the expertise of the National Labor Relations Board, the administrative agency tasked with weaving together specific legal canons in ways that reflect labor’s broad …
Making Whole, Making Better, And Accommodating Resilience, Erik Encarnacion
Making Whole, Making Better, And Accommodating Resilience, Erik Encarnacion
Minnesota Law Review Vols. 106:2 onward (2021-present)
The conventional story about compensatory damages is that they aim to make plaintiffs whole, but not better off. This make-whole ideal implies that courts should subtract material gains from compensatory awards because otherwise plaintiffs would be unjustly enriched. This Article undermines this conventional wisdom in three ways. First, it highlights an oft-overlooked point: that sometimes courts may, as a doctrinal matter, award compensatory damages that render plaintiffs materially better off than before. Second, and more surprisingly, the Article shows that awarding material “betterments” is sometimes (and paradoxically) required by the make-whole ideal itself, not merely as a limited exception to …
Can The Excessive Fines Clause Mitigate The Lfo Crisis? An Assessment Of The Caselaw, Michael O'Hear
Can The Excessive Fines Clause Mitigate The Lfo Crisis? An Assessment Of The Caselaw, Michael O'Hear
Minnesota Law Review Vols. 106:2 onward (2021-present)
The nation’s increasing use of fees, fines, forfeiture, and restitution has resulted in chronic debt burdens for millions of poor and working-class Americans. These legal financial obligations (LFOs) likely entrench racial and socioeconomic divides and contribute to the breakdown of trust in the police and courts in disadvantaged communities. One possible source of restraint on LFOs may be the Excessive Fines Clause of the Eighth Amendment. Largely ignored by courts and commentators for two centuries, the Clause has in recent years been the subject of a burgeoning volume of litigation and scholarship. The U.S. Supreme Court has decided a handful …
Throuples And Family Law, Philip De Sa E Silva
Throuples And Family Law, Philip De Sa E Silva
Minnesota Law Review Vols. 106:2 onward (2021-present)
As throuples and other forms of polyamorous relationships gain visibility and acceptance, courts will have to confront the legal issues that will likely arise when a throuple forms and when it dissolves. How should courts determine child custody for three equally situated parents? How should courts divide assets among three people who have cohabitated in a marriage-like relationship? This note_comment describes some of the legal problems throuples are most likely to encounter, especially regarding child custody and division of assets. This note_comment outlines some of the ideal solutions to these problems, such as forming contracts with the help of an …
