Inconsistencies In State Court Decisions Regarding Public School Financing Are Violating The Constitutional Rights Of Citizens: Why The Nevada Court In Shea V. State Should Have Intervened, Corinne Milnamow

University of Miami Law Review

In 1973, the Supreme Court decided the landmark case, San Antonio Independent School District v. Rodriguez, which held there was no fundamental right to education under the United States Constitution. In the years that have followed Rodriguez, state courts across the country have been left to decide issues related to public school financing. Many plaintiffs in these cases will argue that education is a fundamental right under their state’s constitution and that their respective state’s public school financing structure—one that heavily relies on local property taxes—is unconstitutional because of the discrepancies in the quality of education one will receive in …

Some Are More Equal Than Others: U.S. Supreme Court Clerkships, Tracey E. George, G. Mitu Gulati, Albert H. Yoon

Vanderbilt Law School Faculty Publications

The most elite and scarce of all U.S. legal credentials is serving as a Justice on the U.S. Supreme Court. A close second is clerking for a Justice. A Court clerkship is a prize as well as a ticket to future success. Rich accounts of the experience fill bookshelves and journal pages. Yet the public lacks a clear story about who wins this clerkship lottery. Original analysis of forty years of clerkships tells that story. New datasets detail clerks’ paths from college to the Court to careers. Research shows that Court clerkships favor educational pedigree and status over pure achievement. …

Higher Wages In A High Inflation World: What The United States Can Learn From Icelandic Unionization, Jack Berroug

Cardozo International & Comparative Law Review (CICLR) Blog

Since March 2020 when the COVID-19 pandemic shut down the entire world, inflation has slowly been on the rise. OECD countries across the globe immediately felt the effects of inflation and despite the increase in wages amongst workers globally, inflation outpaced nominal wage growth for many countries. Over the past couple years, many of the capitalist OECD countries have dealt with inflation in various ways with varying degrees of success. One capitalist country in particular has kept up with real wage growth despite inflation: Iceland. Iceland is the most unionized country in the world with 90 percent of its workplace …

A Brief Overview Of The Fair Use Analysis In The Fanfiction Context, Gabriella Fernandez Oct 2023

A Brief Overview Of The Fair Use Analysis In The Fanfiction Context, Gabriella Fernandez

Cardozo Arts & Entertainment Law Journal (AELJ) Blog

Fanfiction is a creative process where fans of an original work of fiction develop their own stories based on the characters in that original work. These stories are often shared on fanfiction websites, traditional publishing routes, or popular applications such Wattpad. Unfortunately, some authors of original works may have concerns about fanfiction. They may feel uneasy when fan-created stories gain popularity and recognition comparable to their own original works, as it involves fans benefitting financially or gaining fame from ideas that these fanfiction authors did not originally conceive of themselves. Consequently, authors sometimes resort to legal measures by filing copyright …

Oh Hot Damn, This Is How Flo Rida May Change Copyright Damages, Cameron Brody

Cardozo Arts & Entertainment Law Journal (AELJ) Blog

In the Spring of 2008, Tramar Lacel Dillard and William James Adams Jr. were exceptionally confident in the success of their latest musical venture. Atop the single “In the Ayer,” they proclaimed, “Oh hot damn, this is my jam. Keep me partying to the AM." In doing so, however, Dillard and Adams, known professionally as artists Flo Rida and will.i.am, set in motion a legal dispute that will likely have a profound impact on the music industry, and copyright infringement litigation at large. In the upcoming case Warner Chappell Music, Inc. v. Nealy, the Supreme Court is set to address …

Navigating Complexity Of Serving Displaced Communities: A Study Of Yemeni Community-Based Organizations In Egypt, Alya Mohammed Al-Mahdi

Theses and Dissertations

Forced displacement is a global crisis that poses challenges for nations like Egypt. Despite international NGO support, escalating displaced individuals have overwhelmed existing capacities. Refugee Community-Based Organizations (CBOs) have emerged as a natural response from the communities themselves to bridge the gap between the state and NGOs and the refugee community. However, CBOs in Egypt face challenges that impact their operation and continuity. Through qualitative research, this study aims to explore the experience of the Yemeni CBOs. Through interviews with seven people from six CBOs conducted through field visits and online calls, this research uncovers the dynamics of Yemeni CBOs …

Crisis And General International Law: Lessons From The Russia-Ukraine Conflict, Atul Alexander

Indonesian Journal of International Law

The ongoing Russian aggression in eastern Ukraine has instilled fear in humanity, with concerns of a possible third world war. Furthermore, international law has been criticized for its lackadaisical role in halting the Russian aggression. The United Nations Security Council (UNSC) has not been able to pass a resounding resolution condemning the attacks. Although the United Nations General Assembly (UNGA) overwhelmingly adopted a resolution demanding that Russia immediately cease military operations in Ukraine, the resolution is not binding, despite being persuasive. This brief article highlights the structural crisis in general international law to effectively combat the tragedy unfolding in Ukraine. …

Discourse Enterprise In Natural Resource Management For The Common Heritage Of Mankind, Ahmad Syofyan, Rudi Natamiharja, Melly Aida, Desy Churul Aini, Daryanti Daryanti, Rasti Putri Januarti

Indonesian Journal of International Law

Common Heritage of Mankind (CHM) is a principle in which all entities can manage the natural resources that exist in the world and must share the benefits of their exploitation with other entities for the common good. However, the principle of CHM has not been structurally and legally regulated in space. The enthusiasm about ‘infinite natural wealth’ that space and seabed mining can produce, particularly in developing countries, means that they can benefit from the activities carried out in order for their regional and mineral resources to be declared as the heritage of mankind. The hypothesis obtained from this research …

Market Access Obligations And Foreign Investments In Renewable Energy: An Analysis Of International Trade And Investment Law Instruments, Mohammad Akefi Ghaziani, Mostafa Fazaeli, Moosa Akefi Ghaziani, Huma Amin

Indonesian Journal of International Law

Today's development of renewable energy technologies is perceived as an essential ingredient of the world’s response to emerging challenges of energy security, global warming, and climate change. However, the global deployment of renewables needs huge financial and technological contributions that many States cannot afford. Therefore the promotion of foreign investments in this sector is at the stake. However, the global flow of investment and technology in this sector is not free from the regulations of international trade and investment law instruments. Among the prominent provisions common to these instruments are Market Access obligations. WTO agreements and IIAs provide for different …

Relevance Of The Remedial Secession Theory For Indonesia's Territorial Integrity, Heribertus Jaka Triyana

Indonesian Journal of International Law

This article aims to analyse the remedial secession theory in international law relevant to the current international armed conflict between Russia and Ukraine waged by Russia’s recognition of Donbask and Luhansk independence. It might have legal as well as political impacts on the territorial integrity of a sovereign State such as Indonesia where human rights violations in Papua have become problematic. The analysis in this paper is mainly construed using the paradigm of customary international law as the primary source of international law to find out the relevance of the remedial secession theory in terms of its area, scope, and …

Judicialization In And Around The South China Sea, Yoshinori Kodama

Indonesian Journal of International Law

This article examines why international legal dispute settlement procedures are traditionally less frequently resorted to in Southeast Asia, compared to other regions. It also analyzes why and how, since the beginning of this century, international legal cases, both judicial and arbitral, have been consistently used for settling maritime disputes in and around the South China Sea. Then, it presents prescriptive suggestions for further use of judicial and arbitral procedures. The method of analysis is based upon the examination and scrutiny of factual materials, including relevant international cases regarding the region, as well as interviews engaged by the author with officials …

Submission To Justice Canada On The Criminalization Of Coercive Control, Janet Mosher, Shushanna Harris, Jennifer Koshan, Wanda Wiegers

Commissioned Reports, Studies and Public Policy Documents

Justice Canada has been holding an engagement process on the issue of whether an offence of coercive control should be added to the Criminal Code. This offence has been proposed in a series of private members bills, most recently, Bill C-332. This submission argues that it is imperative that actors in all legal domains acquire a nuanced and contextual understanding of coercive control derived from an intersectional analysis that attends to how multiple systems of oppression interact to shape the tactics of coercion and control. However, we do not support the criminalization of coercive control, either as a standalone offence …

How Can The Internal Revenue Service Improve Its Alternative Dispute Resolution Programs To Deliver Better Benefits?, Armando Gonzalez Oct 2023

How Can The Internal Revenue Service Improve Its Alternative Dispute Resolution Programs To Deliver Better Benefits?, Armando Gonzalez

Cardozo Journal of Conflict Resolution (CJCR) Blog

Most individuals and businesses file their tax return(s) and forget about the Internal Revenue Service (“IRS”) until it’s time to repeat the process the following year. However, sometimes disputes may arise “when a taxpayer fails to agree with an IRS finding, refuses to file a tax return, or refuses to comply with an IRS request for information.” To address some of these disputes, the IRS offers six alternative dispute resolution (“ADR”) programs through its Independent Office of Appeals, where mediation is leveraged to avoid costly litigation and lengthy appeals.

This post was originally published on the Cardozo Journal of Conflict …

Walking With Shadows And Phantoms: The Presumption Of Innocence And Bail Determinations, Davis Badger Anderson Oct 2023

Walking With Shadows And Phantoms: The Presumption Of Innocence And Bail Determinations, Davis Badger Anderson

Buffalo Law Review

One-hundred and twenty-eight years after “the Supreme Court of the United States had an opportunity to clear up the confusion and ambiguity that hang[s] over the common talk about the presumption of innocence,”1 the confusion persists. This lingering confusion is at its most stringent in federal bail determinations where, despite legislative intent, precedent, and logic to the contrary, it is invoked to discount the weight of the evidence against the defendant in deciding what conditions will secure presence at trial or safety to the community. Furthermore, the presumption’s path from an instrument of proof to its status as a right …
