Visions For The International Decade Of Indigenous Languages 2022-2032, Kristen A. Carpenter, Andrew Cowell, Alexis Palmer

The United Nations General Assembly recently proclaimed the International Decade of Indigenous Languages ( "IDIL") from 2022-2032 to "to draw attention to the critical loss of indigenous languages and the urgent need to preserve, revitalize and promote indigenous languages and to take urgent steps at the national and international levels." The Decade is an opportunity to expose and address the severe loss of Indigenous Peoples' languages locally, regionally, and globally. It is a chance for the entire world community to gather together and commit to bringing Indigenous languages back from the brink of dormancy or extinction.

In response to the Joint Committee on Taxation’s July 2023 request for comments on application of various Internal Revenue Code sections on digital assets, we propose a consistent set of rules to apply current law to digital assets. We highlight that the underlying economics and characteristics of transactions should be the primary concern for the application of rules and the valuation of digital assets. We believe any digital asset rules should (1) treat classes of digital assets with unique characteristics differently based on their economics, (2) minimize incentives for users to engage in tax-motivated structuring of transactions, and (3) allow …
Implementing War Torts, Rebecca Crootof
Implementing War Torts, Rebecca Crootof

Under the law of armed conflict, no entity is accountable for lawful acts in war that cause harm, and accountability mechanisms for unlawful acts (like war crimes) rarely create a right to compensation for victims. Accordingly, states now regularly create bespoke institutions, like the proposed International Claims Commission for Ukraine, to resolve mass claims associated with international crises. While helpful for specific and politically popular populations, these one-off institutions have limited jurisdiction and thus limited effect. Creating an international “war torts” regime—which would establish route to compensation for civilians harmed in armed conflict—would better address this accountability gap for all …

The Internet Tax Freedom Act At 25, Walter Hellerstein, Andrew D. Appleby
The Internet Tax Freedom Act At 25, Walter Hellerstein, Andrew D. Appleby
Scholarly Works
In October 1998, Congress enacted the Internet Tax Freedom Act (ITFA), a temporary three-year “moratorium” on the enactment of new state and local “taxes on Internet access” and on “multiple or discriminatory taxes on electronic commerce.” After extending the act temporarily several times, Congress, in 2016, finally and controversially struck the language temporarily extending the act, thereby making it permanent.
With its idiosyncratic legislative history and statutory language, as well as the recent attention it has received in connection with legal challenges to digital services and analogous taxes, we thought it would be appropriate to commemorate ITFA’s 25th birthday by …
Impossibility Of Emergent Works’ Protection In U.S. And Eu Copyright Law, Mateusz Blaszczyk
Impossibility Of Emergent Works’ Protection In U.S. And Eu Copyright Law, Mateusz Blaszczyk
Scholarly Works
Protection of emergent works is impossible. Without an author, there is no expression of ideas which can be original, and thus no copyrightable work. Indeed, the whole system of copyright law, its conceptual building blocks of idea-expression dichotomy, originality, authorship, and the concept of a protectable work operate in the notation of human creativity. Emergent works fall outside of copyright’s positive ontology, being akin to ideas, facts, or subject-matter predicated by technical considerations, rather than authorial creativity. In other words, they do not exist as things in law and thus cannot as such be owned. Rather, like any idea, they …

The Immigration Implications Of Presidential Pot Pardons, Jason A. Cade

This Essay examines the immigration implications of President Joe Biden’s Proclamation on October 6, 2022, pardoning most federal and D.C. offenders who committed the offense of simple marijuana possession. A late twentieth century interpretive shift by the Board of Immigration Appeals holds that pardons only prevent deportation for certain criminal history categories, which do not include controlled substance offenses, and thus far lower federal courts have deferred to the agency’s approach.Nevertheless, according to the analysis I offer, President Biden’s cannabis pardons should be deemed fully effective to eliminate all immigration penalties. All of the immigrant pardon cases to reach the …
Brokered Abuse, Thomas E. Kadri
Brokered Abuse, Thomas E. Kadri
Scholarly Works
Data brokers are abuse enablers. These companies, which traffic information about people for profit, facilitate interpersonal abuse by making it easier to find and contact people. By thwarting people’s obscurity, brokers expose them to physical, psychological, financial, and reputational harm. To date, there have been four common legal responses to this situation: prohibiting abusive acts, mandating broker transparency, limiting data collection, and restricting data disclosure. Though these measures each have some merit, none is adequate, and several recent privacy laws have even made matters worse. Put simply, the current legal landscape is neither effective nor empathetic.
This Essay explores the …
A Worker-Centered Trade Policy, Desiree Leclercq
A Worker-Centered Trade Policy, Desiree Leclercq
Scholarly Works
What is a “worker-centered” trade policy? The Biden administration claims that it means protecting all workers—foreign and American—from exploitative working conditions in trade sectors. The administration’s vigorous enforcement of international labor rights suggests a significant departure from previous U.S. trade priorities centered on domestic interests. For economic and humanitarian reasons, various policymakers and scholars celebrate these developments. They optimistically assume that the administration’s new trade policy will influence foreign governments and facilities to comply with international labor rights in trade if the costs of noncompliance outweigh the benefits. They also assume that the policy will influence compliance with strong labor …
Building The World We Want In An Era Of Climate Anxiety, Rebecca Bratspies
Building The World We Want In An Era Of Climate Anxiety, Rebecca Bratspies
Chapman Law Review
"It is 'unequivocal' that human activity is driving climate change.2 For clarity, unequivocal means 'leaving no doubt: clear, unambiguous[.]'3 The mean global temperature is already more than 1.1ºC above pre-industrial levels.4 And the trajectory is heading in the wrong direction. Keeping temperature increases below 1.5ºC, the level generally agreed on as essential for preventing the worst climate catastrophes,5 seems increasingly out of reach.6 Moreover, even at current levels of warming, the global climate appears to have gone completely off the rails. Widespread, rapid changes ranging from extreme temperatures,7 violent storms,8 accelerating ice melt,9 and expanding wildfire zones10 have become commonplace."

A Corpus Linguistic Analysis Of “Possessions” In American English, 1760-1776, James C. Phillips
Chapman Law Review
"This article will proceed in four parts. Part I introduces the question at issue in the context of the first state constitution to include the term: the Pennsylvania Constitution. It does so, at least in part, because other state constitutions arguably copied the Pennsylvania Constitution, and thus the meaning of that constitution likely sheds light on the state constitutions that followed it. Part I also describes the litigation where the issue of the meaning of possessions comes up. Part II highlights shortcomings of the traditional tools usually employed in constitutional interpretation. Part III explains how the tools of corpus linguistics …

Ukraine’S Quest For Justice: Accountability For Atrocities Committed In The Russia-Ukraine War, Tetiana Karpus
Ukraine’S Quest For Justice: Accountability For Atrocities Committed In The Russia-Ukraine War, Tetiana Karpus
Dissertations and Theses
The Russian Federation's full-scale military invasion of Ukraine on February 24, 2022, has been marked by numerous documented atrocities, potentially falling under the categories of war crimes and crimes against humanity. This thesis aims to explore whether these apparent human rights and humanitarian law violations merit international prosecution. It also assesses the suitability and feasibility of various mechanisms, such as establishing national courts, "internationalized" or "hybrid" tribunals, or resorting to the International Criminal Court (ICC), drawing insights from past experiences in transitional and retributive justice.
Philosophical Counselling And Mediation Theory And Practice: Exploring A Pathway To Justice, Nayha Acharya
Philosophical Counselling And Mediation Theory And Practice: Exploring A Pathway To Justice, Nayha Acharya
Articles, Book Chapters, & Popular Press
This paper will demonstrate how philosophical counselling would invaluably contribute to the arena of conflict resolution via mediation and civil justice generally. Mediation is a conflict resolution process that involves a third party who facilitates disputants in arriving at a self-determined resolution. This process is being incorporated into civil justice systems globally, but how mediation should be conducted to achieve truly just outcomes needs immediate and thoughtful attention. At its best, mediation empowers parties to co-create a just and fair resolution to their conflict through a dialogical exploration of their interests, needs, and relevant norms and values. This is dramatically …

Sustainable Seabed Mining And The Phase 1 Environmental Standards And Guidelines, Keith Macmaster
Sustainable Seabed Mining And The Phase 1 Environmental Standards And Guidelines, Keith Macmaster
Articles, Book Chapters, & Popular Press
The oceans are home to a rich diversity of plant and animal life and a source of food and marine resources that drive economies. Climate change and pollution are changing ocean dynamics and the ability to support life. Seabed mining in areas beyond national jurisdiction will add to the ocean's stressors and could cause severe environmental damage. The International Seabed Authority (“ISA”) is mandated to manage access to and benefits from the seabed, its subsoil and mineral resources in areas beyond national jurisdiction (the “Area”). Although the United Nations Convention on the Law of the Sea sets out the legal …
Non-Governmental Organization (Ngo) Participation In Civil Aviation Policy And Decision Making, Goran Petrović
Non-Governmental Organization (Ngo) Participation In Civil Aviation Policy And Decision Making, Goran Petrović
Journal of Air Law and Commerce
This article discusses the role and influence of non-governmental organizations (NGOs) in civil aviation. These organizations represent a way for united citizens to realize some of their global (national) interests, that is, to realize their ideals. NGOs participate in the work of international institutions and cooperate with specialized UN agencies. For the consideration of civil aviation NGOs, which have global coverage, the relationship and influence they achieve in relation to the International Civil Aviation Organization (ICAO) as a specialized agency of the UN is important. The participation of certain NGOs in the work of the Air Navigation Commission (ANC) as …

Regulating The Concussion Crisis In Sports: Canada’S Initiative To Bring Prevention Into Focus, Marcus Moore
All Faculty Publications
The twenty-first century has revealed the existence of a concussion crisis in sports. The crisis is of global reach, and Canada is no exception. In recent years, the Canadian government joined citizens in recognizing sports concussion as a major public health issue. A parliamentary committee investigated the crisis, reported findings, and made recommendations which the government accepted. As far as legal responses to the sport concussion crisis, new among the recommendations was a callto- action on prevention (Recommendation 13). Since there remains no medical cure for concussions, the government agreed with the view of injured former athletes and injury prevention …
Bottom-Rung Appeals, Merritt E. Mcalister
Bottom-Rung Appeals, Merritt E. Mcalister
Fordham Law Review
There are “haves” and “have-nots” in the federal appellate courts, and the “haves” get more attention. For decades, the courts have used a triage regime under which they distribute judicial attention selectively: some appeals receive a lot of judicial attention, and some appeals receive barely any. What this Article reveals is that this triage system produces demonstrably unequal results, depending on the circuit handling the appeal and whether the appellant has counsel or not. Together, these two factors produce significant disparities: in one circuit, for example, an unrepresented appellant receives, on average, a decision less than a tenth the length …

Access To Medicines And Pharmaceutical Patents: Fulfilling The Promise Of Trips Article 31bis, Ezinne Mirian Igbokwe, Andrea Tosato
Fordham Law Review
The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) has long stood accused of reducing access to medicines for the poorest and most vulnerable nations. Enacted in 1994 as one of the founding pillars of the World Trade Organization, TRIPS has enabled pharmaceutical companies to enforce their patent rights in almost every country, precluding cheaper generics from being distributed, save for very limited exceptions.
But in 2001, TRIPS was amended expressly to address this issue, allowing countries with limited resources to lodge a formal request to obtain patented medicines at a sustainable cost. Generics manufacturers worldwide can answer this …
Command And Control: Operationalizing The Unitary Executive, Gary Lawson
Command And Control: Operationalizing The Unitary Executive, Gary Lawson
Fordham Law Review
The concept of the unitary executive is written into the Constitution by virtue of Article II’s vesting of the “executive Power” in the President and not in executive officers created by Congress. Defenders and opponents alike of the “unitary executive” often equate the idea of presidential control of executive action with the power to remove executive personnel. But an unlimitable presidential removal power cannot be derived from the vesting of executive power in the President for the simple reason that it would not actually result in full presidential control of executive action, as the actions of now-fired subordinates would still …
Beyond Removal, Jane Manners
Beyond Removal, Jane Manners
Fordham Law Review
The contemporary debate over presidential power often assumes that removal is the primary tool through which a President exercises control over executive branch officers to fulfill the Constitutional duty to “take Care that the Laws be faithfully executed.” This must be so, the logic goes, because without this authority, “the President could not be held fully accountable for discharging his own responsibilities.” The power to remove, the U.S. Supreme Court has reasoned, also endows the President with the power to supervise. To be sure, other scholars and jurists have pointed out the ways that this fails to capture the range …

This Essay addresses three structural aspects of immigration law that have shifted in recent years and present important challenges for delivering adequate representation. Although the Katzmann study group’s many initiatives have shored up access to counsel in immigration courts and for immigration applications, the ground has been shifting under our feet. This Essay discusses three (of many) phenomena that make it harder than ever to lawyer on behalf of noncitizens. The first is the rise of red-state lawsuits that lead to enormous unpredictability about the agency rules under which lawyers can expect to operate. The second is the individuation and …

The Crisis Of Unrepresented Immigrants: Vastly Increasing The Number Of Accredited Representatives Offers The Best Hope For Resolving It, Michele R. Pistone
Fordham Law Review
The U.S. immigration system is exceedingly complex, and access to legal representation is the primary determinant in obtaining a just immigration outcome. Immigrants must navigate a byzantine, burdensome, and high stakes legal process, conducted in a language they often do not speak. They often must do so without any legal representation. Unlike criminal defendants, immigrants are not entitled to government-funded lawyers. Legal services organizations, such as Legal Services Corporation, that receive any federal funding are prohibited from providing legal representation to most immigrants. Faith-based and charitable legal services organizations provide some legal representation to immigrants through attorneys, staff members, and …
