The Border Is Their Public Swimming Pool, Genevieve Negrón-Gonzales Jan 2022

The Border Is Their Public Swimming Pool, Genevieve Negrón-Gonzales

Journal of Interdisciplinary Perspectives and Scholarship

This article extends the metaphor at the heart of The Sum of Us - the decline of the public swimming pool in the U.S. - to discuss the political landscape of the US-Mexico border. The author argues that anti-immigrant whites residing on the border are so invested in white supremacy that they subscribe to an anti-immigrant politic that does not serve them. The article calls attention to society’s collective investment in white supremacy by highlighting the cost of this investment on migrants at the U.S.-Mexico border.

Own Goal Politics In The United States, Keally Mcbride Jan 2022

Own Goal Politics In The United States, Keally Mcbride

Journal of Interdisciplinary Perspectives and Scholarship

This essay explores the possibility that understanding how self-defeating racial political sentiments are in the United States will not necessarily change the public’s behavior. Drawing from the rich history of political thought, we can see that the desire for domination may be stronger than the drive for equality and/or freedom.

Dismantling The Zero-Sum Game To Co-Create A New Community With Solidarity Dividends And No Prisons, Daniela Dominguez Jan 2022

Dismantling The Zero-Sum Game To Co-Create A New Community With Solidarity Dividends And No Prisons, Daniela Dominguez

Journal of Interdisciplinary Perspectives and Scholarship

Heather McGee’s The Sum of Us: What Racism Costs Everyone and How We Can Prosper Together (2021), provides a framework for understanding how racist ideologies and profit interests drive disadvantaged white individuals to reinforce the hegemony of white and wealthy Americans. This response paper ties McGee’s conceptualization of zero-sum thinking to the carceral space.

Racism And Stress: How A Zero Sum Approach Harms The Sum Of Us, Laura Chyu, Erin Grinshteyn Jan 2022

Racism And Stress: How A Zero Sum Approach Harms The Sum Of Us, Laura Chyu, Erin Grinshteyn

Journal of Interdisciplinary Perspectives and Scholarship

Experiencing racism is a pervasive and persistent stressor that not only negatively impacts the health of people of color (POC), but all members of a population, including Whites. This essay discusses how experiencing racism over a lifetime may cause wear and tear on the body and increase risk for premature disease, disability, and death. The authors explore how racial capitalism has created a deeply flawed economic system that exploits POC and foments hostility among working-class whites towards POC. Blue collar workers of all races currently suffer from economic misery and social malaise. Recent alarming trends of increases in death rates …

Institutional Choice For Software Safety Standards, Bryan H. Choi Jan 2022

Institutional Choice For Software Safety Standards, Bryan H. Choi

Publications

The pursuit of software safety standards has stalled. In response, commentators and policymakers have looked increasingly to federal agencies to deliver new hope. Some place their faith in existing agencies while others propose a new super agency to oversee software-specific issues. This turn reflects both optimism in the agency model as well as pessimism in other institutions such as the judiciary or private markets.

This Essay argues that the agency model is not a silver bullet. Applying a comparative institutional choice lens, this Essay explains that the characteristic strengths of the agency model—expertise, uniformity, and efficiency—offer less advantage than one …

Take It With A Grain (Or More) Of Salt: Why Industry-Backed Dietary Guidelines Fail Americans And How To Fix Them, Caroline Farrington Jan 2022

Take It With A Grain (Or More) Of Salt: Why Industry-Backed Dietary Guidelines Fail Americans And How To Fix Them, Caroline Farrington

University of Michigan Journal of Law Reform

The U.S. Dietary Guidelines lack oversight and accountability. The result: Guidelines that reflect food industry interests instead of modern science. This deleterious guidance goes on to govern federally-subsidized food assistance programs and to influence dietary choices throughout the private sector and private life. Ultimately, the Guidelines significantly contribute to the endemic chronic disease they seek to address.

The Guidelines Advisory Committee is notoriously rife with conflicts of interest, and thus most Guidelines scholarship has focused on reforming the Committee. But the 2015 and 2020 Guidelines show that these reforms are insufficient and agency-level change is necessary. In 2015, the Committee …

A Machete For The Patent Thicket: Using Noerr-Pennington Doctrine’S Sham Exception To Challenge Abusive Patent Tactics By Pharmaceutical Companies, Lisa Orucevic Jan 2022

A Machete For The Patent Thicket: Using Noerr-Pennington Doctrine’S Sham Exception To Challenge Abusive Patent Tactics By Pharmaceutical Companies, Lisa Orucevic

Vanderbilt Law Review

Outrageous drug prices have dominated news coverage of the American healthcare system for years. Yet despite widespread condemnation of skyrocketing drug prices, nothing seems to change. Pharmaceutical companies can raise drug prices with impunity because they hold patents on their drugs, which give them monopolies. These monopolies are only supposed to last twenty years, and then competing lower-cost drugs like generics can enter the market, driving down the costs of pharmaceuticals for all. But pharmaceutical companies have created “patent thickets,” dense webs of overlapping patents surrounding one drug, which have artificially extended the companies’ monopolies for years or even decades …

Virtuous Prosecutors?, Steven Zeidman Jan 2022

Virtuous Prosecutors?, Steven Zeidman

City University of New York Law Review

A movement is building for President Biden to rewrite the book on judicial appointments and look to civil rights lawyers and public defenders instead of the usual crop of federal prosecutors. While the movement is grounded in the need to diversify the breadth of experience on the bench, it could also be interpreted as, or lead to, an effort to reexamine the exalted role of the prosecutor. Prosecutors were historically seen as noble and righteous protectors of virtue and morality. Their prominence led to increased resources, power, and influence and over time they began to fill the ranks of the judiciary, …

Decarceration Means Funding The Incarcerated, David Campbell Jan 2022

Decarceration Means Funding The Incarcerated, David Campbell

City University of New York Law Review

While there are varied assertions as to what “defunding the police” and “reinvesting in communities” mean, I propose that one step towards this goal would be to redistribute the funds from Corrections Offices and bureaucratic management to incarcerated workers to ensure they are paid a suitable wage. If an increase in inmate pay appears outrageous to some, it is only because it entails beginning to treat inmates as full-fledged human beings and, in doing so, upsets the power dynamic between the incarcerated and their keepers.

The Correctional Institute Of Nothing, Frank Pruitt Jan 2022

The Correctional Institute Of Nothing, Frank Pruitt

City University of New York Law Review

Rehabilitation programs are crucial to address the conditions that lead people to commit crimes. Currently, effective rehabilitation programs are not offered in prisons; instead, the carceral system relies upon the erroneous assumption that incarceration itself fixes individual and social problems. In fact, prison conditions further entrench problematic behaviors. True rehabilitation allows incarcerated individuals to confront the offenses they committed, adopt new ways of thinking, and heal underlying trauma. The author, who has been incarcerated since 1989, identifies the lack of rehabilitation opportunities in prisons and offers a better, more humane way forward.

Restorative Justice In Cases Of Sexual Harm, Alexa Sardina, Alissa R. Ackerman Jan 2022

Restorative Justice In Cases Of Sexual Harm, Alexa Sardina, Alissa R. Ackerman

City University of New York Law Review

Restorative justice for cases of sexual harm offers a trauma-informed and evidence-based approach to healing and prevention that current criminal legal options do not. The literature is clear that current sex crimes policies and practices have been ineffective at reducing rates of sexual violence. Similarly, current criminal legal practices fail to hold people accountable for the sexual harms they’ve caused and do little to support survivors who come forward. Unlike the criminal legal system, restorative justice provides survivors with a safe platform within which to talk about their experience(s) of sexual harm on their terms and voice their individual needs …
