Private Liability For Public Health, Jerrold Soh Sep 2020

Private Liability For Public Health, Jerrold Soh

Research Collection Yong Pung How School Of Law

As at this writing, COVID-19 continues to spread around the world. Most disease transmissions, one hopes, are unintentional. But could one nonetheless be liable for unintentionally, yet carelessly, transmitting the disease? If so, when would liability arise, and how wide may its scope be? If X transmits the disease to Y who in turn transmits it to Z, can Z claim against X? If not, why should liability escape one who carelessly spreads a deadly and highly contagious virus when courts have historically found liability for more innocuous harms?154 This short essay discusses how private liability might complement public regulation …

Trading Through A Pandemic: The Singaporean Experience, Henry Gao, Dhiraj G. Chainani, Siu Farn Chew

Research Collection Yong Pung How School Of Law

Being a small country with one of the highest trade-to-GDP ratios in the world, Singapore faced seemingly insurmountable challenges at the onset of the Coronavirus disease 2019 (COVID-19) pandemic. As countries around the world scrambled to fight the pandemic, they imposed restrictions on exports and imports, suspended international transportation of both goods and people, and invoked emergency power and exceptions to justify their actions. All these presented unprecedented challenges to Singapore, a country which relies on international trade not only for its prosperity but also for survival. This article discusses how Singapore tries to meet these challenges through various initiatives …

Reversing The Decriminalization Of Sexual Violence, Lisa Avalos Sep 2020

Reversing The Decriminalization Of Sexual Violence, Lisa Avalos

Nevada Law Journal

Sexual violence has largely been decriminalized in the United States through disbelief of victims, apathy on the part of law enforcement officers, and inaction on the part of institutions. Indeed, these mechanisms are so effective at burying the problem that most people are not aware of the extent of unprosecuted sexual violence, the woefully deficient law enforcement response, and the need for sweeping reform.

The Article proceeds in two parts. Part I maps the extent of this problem and argues that the weakest link in the societal response to sexual assault lies at the juncture between victim and law enforcement. …

Secret Algorithms, Ip Rights, And The Public Interest, Meghan J. Ryan Sep 2020

Secret Algorithms, Ip Rights, And The Public Interest, Meghan J. Ryan

Nevada Law Journal

The secrecy surrounding the algorithms that play a central role in American life today is proving to have alarming effects. Judges and juries are convicting defendants based on secret evidence. Major advertisers like Facebook are discriminating against minorities seeking housing. And Russians may very well be hacking our voting machines to change election outcomes. The algorithm secrecy underlying these results obscures whether such legal outcomes are actually accurate and fair or whether they were based on faulty evidence, affected by bias, or manipulated by outside influences. These are just a handful of the public-interest perils of algorithm secrecy. This Article …

Pardoning Dogs, Sarah Schindler Sep 2020

Pardoning Dogs, Sarah Schindler

Nevada Law Journal

In 1994, the Governor of New Jersey pardoned a dog. In 2017, the Governor of Maine did the same. Each of these dogs had been ordered to be euthanized after killing another dog. While the Governor of New Jersey relied on the property status of the dog in issuing her order, the Governor of Maine relied on his standard pardon power, despite the fact that the being to be pardoned was a dog rather than a human. Both of these cases generated a great deal of popular press and attention, and a few months ago, a New York state senator …

Implicit Disability Bias Disinterred By Zombie Factors In Social Security Disability Determinations, Frank Griffin Sep 2020

Implicit Disability Bias Disinterred By Zombie Factors In Social Security Disability Determinations, Frank Griffin

Nevada Law Journal

Social Security Administration (SSA) disability determinations rely on discriminatory and prejudicial factors to deny people with real disabilities crucial benefits. “Zombie factors” (coined here) are judicial requirements for activity restrictions in defining disability that could virtually only be met by fictitious zombies—such as living without food, personal hygiene, exercise, social interaction, and other necessities for human life. Administrative law judges (ALJs) often fail to recognize critical differences between activities of daily living (necessary for survival) and work activities—penalizing people with disabilities for activities like eating, bathing, and living alone, and supporting a prejudicial stereotype that people with work disabilities must …

A Contemporary Approach To Ride-Through, Ipso Facto Clauses, And The Nondefaulting Debtor, Lawrence Ponoroff Sep 2020

A Contemporary Approach To Ride-Through, Ipso Facto Clauses, And The Nondefaulting Debtor, Lawrence Ponoroff

Nevada Law Journal

Prior to enactment of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, one of the most vexing and controversial questions in the consumer bankruptcy arena was whether a debtor who was current on her payments to a secured lender could retain the collateral both during and after the bankruptcy case by continuing to make the scheduled payments on the loan and otherwise avoid any act or omission that might pose a threat to the value or security of the collateral. No fewer than nine of the eleven circuit courts of appeals addressed this question and split as evenly …

Calming Down And Waking Up: An Empirical Study Of The Effects Of Mindfulness Training On Law Students, Charity Scott, Paul Verhaeghen

Nevada Law Journal

This Article discusses efforts to address directly the crisis in the mental health and well-being of law students by providing training in mindfulness. It describes an empirical study of three offerings of mindfulness training at a law school and reports its results in reducing law students’ stress (“calming down”) and providing other benefits, such as increased self-awareness (“waking up”) and its corollaries in various aspects of emotional, personal, and interpersonal well-being. Key findings include positive benefits in: lowering perceived stress and reactivity to triggers causing stress; increasing self-reported focus and concentration; improving the ability to reframe one’s outlook (and thus …

Digging Into Algorithms: Legal Ethics And Legal Access, Carla L. Reyes, Jeff Ward Sep 2020

Digging Into Algorithms: Legal Ethics And Legal Access, Carla L. Reyes, Jeff Ward

Nevada Law Journal

The current discussions around algorithms, legal ethics, and expanding legal access through technological tools gravitate around two themes: (1) protection of the integrity of the legal profession and (2) a desire to ensure greater access to legal services. The hype cycle often pits the desire to protect the integrity of the legal profession against the ability to use algorithms to provide greater access to legal services, as though they are mutually exclusive. In reality, the arguments around protecting the profession from the threats posed by algorithms represent an over-fit in relation to what algorithms can actually achieve, while the visions …

‘Moules & Frites’: De Valtònyc A Josep Miquel O La Transformació D’Un Bandoler Adolescent, Antoni Pizà

Publications and Research

The Preemptive Effect Of The Cisg On Tort Claims Under Us Law, Phutchaya Numngern Sep 2020

The Preemptive Effect Of The Cisg On Tort Claims Under Us Law, Phutchaya Numngern

Maurer Theses and Dissertations

This thesis emphasizes a core concept of the preemptive effect that uniform law may have on other domestic norms. It exemplifies the situation in which the laws and principles of contracts, particularly the uniform laws and principles formulated for transnational sales, can exclude or limit tort liability. This study does not object to the recognition of concurrency of claims under contract and tort law. On the contrary, it accepts that the contracting party’s right to both contract and tort actions is commonly recognized in many legal systems, especially the common law system. Tort liability could be actionable insofar as the …

Improving Climate Change Mitigation Analysis: A Framework For Examining Feasibility, Michael P. Vandenbergh, Kristian S. Nielsen, Et. Al. Sep 2020

Improving Climate Change Mitigation Analysis: A Framework For Examining Feasibility, Michael P. Vandenbergh, Kristian S. Nielsen, Et. Al.

Vanderbilt Law School Faculty Publications

Limiting global warming to 2`C or less compared with pre-industrial temperatures will require unprecedented rates of decarbonization globally. The scale and scope of transformational change required across sectors and actors in society raises critical questions of feasibility. Much of the literature on mitigation pathways addresses technological and economic aspects of feasibility, but overlooks the behavioral, cultural, and social factors that affect theoretical and practical mitigation pathways. We present a tripartite framework that ‘‘unpacks’’ the concept of mitigation pathways by distinguishing three factors that together determine actual mitigation: technical potential, initiative feasibility, and behavioral plasticity. The framework aims to integrate and …

Primer On Risk Assessment For Legal Decision-Makers, Christopher Slobogin Sep 2020

Primer On Risk Assessment For Legal Decision-Makers, Christopher Slobogin

Vanderbilt Law School Faculty Publications

This primer is addressed to judges, parole board members, and other legal decisionmakers who use or are considering using the results of risk assessment instruments (RAIs) in making determinations about post-conviction dispositions, as well as to legislators and executive officials responsible for authorizing such use. It is meant to help these decisionmakers determine whether a particular RAI is an appropriate basis for legal determinations and whether evaluators who rely on an RAI have done so properly. This primer does not take a position on whether RAIs should be integrated into the criminal process. Rather, it provides legal decision-makers with information …

Forward: State Enforcement In An Interstate World, Margaret H. Lemos

BYU Law Review

“State Enforcement in an Interstate World” is an important topic—fully deserving of all the attention it has received. Past commentators on this topic have generally treated the federal government as a unitary entity. Building on prior work on the subject, this Article explores the polycentric nature of federal regulatory authority and shows how cooperation and rivalry have long been dominant realities of the modern administrative state. The Article discusses how these dynamics complicate analysis of state enforcement in an interstate world and identifies strategies for reducing the frequency and magnitude of the seemingly inevitable conflicts.

The (Surprisingly) Prevalent Role Of States In An Era Of Federalized Class Actions, Linda S. Mullenix Sep 2020

The (Surprisingly) Prevalent Role Of States In An Era Of Federalized Class Actions, Linda S. Mullenix

BYU Law Review

In enacting the Class Action Fairness Act of 2005 (CAFA), Congress intended to expand access to the federal courts for interstate class actions by creating minimal diversity and removal jurisdiction. In Section 2 of the Act, “Findings and Purposes,” Congress stated that class action abuses undermined “the concept of diversity jurisdiction as intended by the Framers of the United States Constitution” in that state courts kept cases of national importance out of federal court and sometimes demonstrated bias against out-of-state defendants. Congress stated that a purpose of CAFA was to “restore the intent of the framers of the United States …

Presidential Selection: Historical, Institutional, And Democratic Perspectives, James A. Gardner

Contributions to Books

Published as Chapter 1 in The Best Candidate: Presidential Nomination in Polarized Times, Eugene Mazo and Michael Dimino, eds.

It has been nearly two centuries since an American presidential election has evoked a crisis of confidence like that following the election of 2016. Not since the election of Andrew Jackson in 1828 has there been such a public display of anxiety concerning the methods by which we choose our chief executive. As in the contest of 1828 pitting the Democrat Jackson against his Federalist opponent John Quincy Adams, the presidential nominating process of 2016 produced a contest between a celebrity …
