Features Of Voluntary Refusal In Criminal Attempt, Dildora Kamalova Sep 2020

Features Of Voluntary Refusal In Criminal Attempt, Dildora Kamalova

Review of law sciences

Voluntary refusal is directly interrelated with the stages of the commission of the crime, since the correct determination of stage of the refusal can possibly serve as the basis for exemption from criminal liability or conviction. In this regard, the author analyzed the possibility of a voluntary refusal at the stage of a completed and/or inchoated criminal attempt, which is one of the controversial issues of criminal law. Based on the analysis of the theory of criminal law and legislation, the author suggested the possibility of voluntary refusal at the stage of the attempt of finished assassination.

Tear It All Down: Highways As Racist Monuments, Sarah Schindler

Sturm College of Law: Faculty Scholarship

In recent months, citizens and elected officials around the country have been tearing down or ordering the removal of monuments that symbolize white supremacy and subjugation. Indigenous Environmental Network And North Coast Rivers Alliance V. President Donald J. Trump, Et Al. And Tc Energy Corporation, Et Al., Kirsten D. Gerbatsch Ms.

Public Land & Resources Law Review

A single cross-border pipeline project has been the epicenter of environmental litigation for the last decade—and it is not over yet. For years, TransCanada Keystone Pipeline, LP and TC Energy have sought to construct and maintain a segment of the Keystone pipeline between the United States and Canada to connect existing pipeline infrastructure and transport crude oil. To do so, the company must first apply and be approved for a permit. Between 2008 and 2012, President Obama twice denied TransCanada Keystone Pipeline and TC Energy’s applications. Then, in 2017 and again in 2019, President Trump unilaterally invited TC Energy’s application …

Atlantic Richfield Company V. Christian, Jo J. Phippin Sep 2020

Atlantic Richfield Company V. Christian, Jo J. Phippin

Public Land & Resources Law Review

In 1983, the EPA designated roughly 300 miles of polluted mining land near Butte, Montana, as a Superfund site, which the EPA now manages. In 2008, landowners adjacent to the Superfund site brought state law claims against Atlantic Richfield, the company that owned the smelter site. In March 2020, the Supreme Court of the United States ruled that Montana state courts have jurisdiction over the landowners’ suit, and that the landowners on this Superfund site qualify as potentially responsible parties.

Real Due Process Or Charades Due Process For Economic Regulation? A Simple Textual Interpretation Of The Due Process Clause, Dustin Romney Sep 2020

Real Due Process Or Charades Due Process For Economic Regulation? A Simple Textual Interpretation Of The Due Process Clause, Dustin Romney

Nebraska Law Bulletin (Selected Issues)

Much has been written and debated about due process. In my view, most of the literature looks past the simple deductions arising from the text; that due process must have reason and objectivity; that liberty and property are best defined by sic utere; that the word “law” in the due process clause cannot logically mean any statute the legislature passes; and finally, that the separation of powers demands that judges, not legislatures, make and enforce these determinations. Even more simply, since the Court has never officially abandoned rational basis, it should stop using the phrase as a prop in a …

Montana Wildlife Federation V. Bernhardt, Henry D. O'Brien Sep 2020

Montana Wildlife Federation V. Bernhardt, Henry D. O'Brien

Public Land & Resources Law Review

A federal court in Montana vacated the lease sale of several large oil and gas developments in Montana and Wyoming because BLM’s revised guidance documents, which facilitated the lease sales, failed to prioritize development outside of sage-grouse habitat, as required by BLM land use plans. BLM adopted the prioritization requirement in 2015 as part of an effort to prevent the sage-grouse from being listed under the Endangered Species Act. The court held BLM violated the Federal Land Policy and Management Act when it essentially eliminated the prioritization requirement and approved the lease sales without properly amending the land use plans.

There is increasing concern globally about the enormity of the threats posed by antimicrobial resistance (AMR) to human, animal, plant and environmental health. A proliferation of international, national and institutional reports on the problems posed by AMR and the need for antibiotic stewardship have galvanised attention on the global stage. However, the AMR community increasingly laments a lack of action, often identified as an ‘implementation gap’. At a policy level, the design of internationally salient solutions that are able to address AMR’s interconnected biological and social (historical, political, economic and cultural) dimensions is not straightforward. This multidisciplinary paper responds by …

County Of Maui, Hawaii V. Hawaii Wildlife Fund, Rachel L. Wagner Sep 2020

County Of Maui, Hawaii V. Hawaii Wildlife Fund, Rachel L. Wagner

Public Land & Resources Law Review

The Supreme Court of the United States was recently asked to decide whether the Clean Water Act requires a permit for the discharge of pollutants that originate from a point source but are conveyed to navigable waters by a nonpoint source. Vacating the Ninth Circuit’s “fairly traceable” test, the Court held the Clean Water Act requires a permit when there is a direct discharge of pollutants from a point source into navigable waters or when there is the “functional equivalent of a direct discharge.”

A Colonial Castle: Defence Of Property In R V Stanley, Alexandra Flynn, Estair Van Wagner Sep 2020

A Colonial Castle: Defence Of Property In R V Stanley, Alexandra Flynn, Estair Van Wagner

Articles & Book Chapters

In 2016, Gerald Stanley shot 22-year-old Colten Boushie in the back of the head after Boushie and his friends entered Stanley’s farm. Boushie died instantly. Stanley relied on a hangfire defence, rooted in the defence of accident, and was found not guilty by an all-white jury. Throughout the trial, Stanley invoked concerns about trespass and rural crime (particularly property crime) that raised much evidence of limited relevance to whether or not the shooting was an accident. We argue that the assertions of trespass, without formerly raising the defence of property or trespass, shaped the trial by providing a racist, anti-Indigenous-tinged …

Special Rules Of Attribution Of Conduct In International Law, Marko Milanovic Sep 2020

Special Rules Of Attribution Of Conduct In International Law, Marko Milanovic

International Law Studies

Are there are any special rules of attribution in international law? Are there, in other words, imputational rules that are not recognized as such in general international law, but are specific to particular branches of international law? This is the first article to systematically analyze the notion of special rules of attribution in international law. In particular, it searches for such rules in international humanitarian law, the law on the use of force, and European human rights law.

The article argues that, to the extent special rules of attribution exist, they are rare and never uncontroversial. In most situations, putative …

350 Montana V. Bernhardt, Ryan W. Frank

Public Land & Resources Law Review

In its second trip before the District Court of Montana, the Bull Mountain Mine expansion was again halted, this time due to coal train derailments. The Bull Mountain Mine expansion, previously enjoined in 2015 for violating the National Environmental Policy Act, was revived in 2018 when the Office of Surface Mining Reclamation and Enforcement approved the expansion a second time. Here, the court found the Office of Surface Mining Reclamation and Enforcement did not comply with the National Environmental Policy Act on grounds that the Environmental Assessment failed to properly analyze the risk of train derailments.

Austria Joins Other European Countries In Offeringcitizenship To The Persecuted Who Never Returned, Hayley Bronner

Cardozo International & Comparative Law Review (CICLR) Blog

Since September 1, 2020, Austrian survivors of Nazi persecution and their descendants have been able to gain Austrian citizenship, allowing Austria to join a handful of other European countries in inviting back the Jewish communities that they once mistreated. Austriawas once home to thriving Jewish communities, but now only contains a fraction of its former Jewish population. In January of 1938, two months before Nazi Germany invaded Austria, there were approximately 190,000 Jews in Austria’s Jewish communities. Only about 120,000 of these Austrian Jews survived the Holocaust, and by December of 1945, eight months after Nazi Germany surrendered to the Allied …
