Lopez V. Seccombe: The City Of San Bernardino’S Mexican American Defense Committee And Its Role In Regional And National Desegregation, Mark Ocegueda Oct 2020

Lopez V. Seccombe: The City Of San Bernardino’S Mexican American Defense Committee And Its Role In Regional And National Desegregation, Mark Ocegueda

History in the Making

This article examines Lopez v. Seccombe, one of the earliest successful desegregation court cases in United States history. The legal challenge was decided in 1944 in the City of San Bernardino, California and desegregated city parks and recreational facilities, specifically the Perris Hill “plunge” or pool. The decision of this case set precedent for other local desegregation challenges, including the much more celebrated Mendez v. Westminster decision in 1947, and eventually had influence on the landmark Supreme Court decision of Brown v. Board of Education in 1954. This study will focus on the Mexican American barrio in San Bernardino’s Westside, …

What Is Nonmarriage?, Katharine Baker Oct 2020

What Is Nonmarriage?, Katharine Baker

All Faculty Scholarship

As rates of cohabitation rise, and marriage becomes a status reserved almost exclusively for socio-economic elites, the scholarly calls for family law to recognize more nonmarital families grow stronger by the day. This Article unpacks contemporary proposals to recognize more nonmarital families and juxtaposes those proposals with family law’s contemporary marital regime. Family law’s status-based system provides a mostly simple and efficient means of distributing resources at the end of a marriage by imposing a formulaic, but distinctly communitarian, non-market-based approach to obligation, entitlement, and value. In full, the Article defends family law’s status-based system for what it does well, …

Do Lawyers Need Economists? Review Of Katja Langenbucher, Economic Transplants: On Lawmaking For Corporations And Capital Markets (Cambridge U. Press, 2017), Reuven S. Avi-Yonah Oct 2020

Do Lawyers Need Economists? Review Of Katja Langenbucher, Economic Transplants: On Lawmaking For Corporations And Capital Markets (Cambridge U. Press, 2017), Reuven S. Avi-Yonah

Law & Economics Working Papers

Katja Langenbucher’s outstanding book seeks to address the question of why and in what ways have lawyers been importing economic theories into a legal environment, and how has this shaped scholarly research, judicial and legislative work? Since the financial crisis, corporate or capital markets law has been the focus of attention by academia and media. Formal modelling has been used to describe how capital markets work and, later, has been criticized for its abstract assumptions. Empirical legal studies and regulatory impact assessments offered different ways forward. This excellent book presents a new approach to the risks and benefits of interdisciplinary …

The Invisible Web At Work: Artificial Intelligence And Electronic Surveillance In The Workplace, Richard A. Bales, Katherine Vw Stone

AI-DR Collection

Employers and others who hire or engage workers to perform services use a dizzying array of electronic mechanisms to make personnel decisions about hiring, worker evaluation, compensation, discipline, and retention. These electronic mechanisms include electronic trackers, surveillance cameras, metabolism monitors, wearable biological measuring devices, and implantable technology. These tools enable employers to record their workers’ every movement, listen in on their conversations, measure minute aspects of performance, and detect oppositional organizing activities. The data collected is transformed by means of artificial intelligence (A-I) algorithms into a permanent electronic resume that can identify and predict an individual’s performance as well as …

Introduction A Bold Agenda For The Next Steps In Health Reform, Lindsay Wiley

Scholarly Articles in Law Reviews & Journals

Introduction: In the aftermath of the largely failed Clinton-era health reform push and the build-up to Obamaera reforms, experts worried that another failed effort could cast a ten-year shadow. The tenth anniversary of the Affordable Care Act offered an opportunity for participants in the 2019 Next Steps in Health Reform conference to reflect. If the ACA proves resilient, what paths will it have paved for the next decade of reforms?

Reviews

Rick Hasen’s Election Meltdown provides a concise and scathing analysis of what ails the American electoral process. Rick identifies four “principal dangers”—namely, voter suppression, “pockets of incompetence” in election administration, “dirty tricks,” and “incendiary rhetoric” about stolen or rigged elections. He argues that these dangers have contributed to past dysfunctional elections and are sure to infect future ones. Election Meltdown closes with some proposals to temper the identified dangers so as to make voting less difficult and restore confidence in the electoral process.

Human Rights And Compliance: Organization For Economic Co-Operation & Development, Sarah Casteel

Cardozo International & Comparative Law Review (CICLR) Blog

Efforts to tackle corporate corruption and money laundering have increased exponentially in recent decades. In the United States, the USA PATRIOT Act passed in 2001, followed by the Dodd-Frank Act in 2008, have led to a significant uptick in anti-money laundering regulations and enforcement. Internationally, several entities have been created with the goal of setting global standards in compliance. For example, the Basel Committee on Banking Supervision, to which several US institutions such as the FDIC and the Board of Governors of the Federal Reserve System belong, is the “primary global standard setter for prudential regulation of banks and provides …

Jeff Trueman’S Study On Nightmares Of “Positional” Tactics In Mediation, John M. Lande Oct 2020

Jeff Trueman’S Study On Nightmares Of “Positional” Tactics In Mediation, John M. Lande

Faculty Blogs

This post reports on an excellent study about the challenges of lawyers, mediators, and insurance claims professionals in mediation. His findings are consistent with my observations about the emotional pains of positional negotiation. Many of the cases in his study involve insurance, which are supposedly “money-only cases” because the parties generally haven’t had a prior relationship and have no interest in a future relationship. But Jeff found that emotions and relationships actually can be very important in these cases – the professionals’ emotions and relationships with each other.

Articles & Book Chapters

Safe and secure water is a cornerstone of modern life in the global North. This article critically examines a set of prevalent myths about household water in high-income countries, with a focus on Canada and the United States. Taking a relational approach, we argue that household water insecurity is a product of institutionalized structures and power, manifests unevenly through space and time, and is reproduced in places we tend to assume are the most water-secure in the world. We first briefly introduce “modern water” and the modern infrastructural ideal, a highly influential set of ideas that have shaped household water …

Donna Shestowsky’S Presentation On Litigants’ Views Of Court Adr Options, John M. Lande

Faculty Blogs

This post hightlights findings from Donna Shestowsky’s research finding that litigants seem to be unaware of ADR options, and that knowing about some of these options improves their opinions of the court itself. Surprisingly, having a lawyer did not make litigants more aware of ADR options, even when those options were offered by the court system.
