Using Mediation To Get Nhl Players Back In The Winter Olympics, Jared Brover
Using Mediation To Get Nhl Players Back In The Winter Olympics, Jared Brover
Cardozo Journal of Conflict Resolution
In the early years of the Winter Olympics ("Olympics"), participation in the games was limited to amateur athletes. That changed in 1986 when rules were put in place, which changed who determined eligibility to compete in the Olympics. Eventually, as a result of such a shift, professional athletes began participating in the Olympics and they brought greater excitement to the games as fans were given another opportunity to see their favorite athletes compete at a high level. However, giving professional athletes the opportunity to join the games created unintended conflicts. For example, the dispute between a given country's professional league …
How Mediation Between Schools And Students Will Help Students Combat Student Debt, Joshua A. Graber
How Mediation Between Schools And Students Will Help Students Combat Student Debt, Joshua A. Graber
Cardozo Journal of Conflict Resolution
By using mediation, schools can help students to no longer be crippled by their debt and instead reinvest in themselves and their future. Section II will supply a background of our country's education system, financial options for education and show how we reached this point in our student debt crisis. Section III will discuss whether colleges and educational institutions will become obsolete, whether there are sufficient programs to possibly make college tuition free, and explore whether other universities and schools will follow in some institutions footsteps and try to make their programs tuition free. Section IV will propose using mediation …
The Need For Negotiation In Water Resource Disputes Between Central Asian States, Tamiris Askarova
The Need For Negotiation In Water Resource Disputes Between Central Asian States, Tamiris Askarova
Cardozo Journal of Conflict Resolution
Negotiation can take many forms and have different structures; however, I propose that establishing meetings between each states' leaders of their energy and environmental governmental bodies along with members of The Permanent Indus Commission, as they have dealt with similar concerns, would be the most beneficial and efficient method of resolving water use disputes. In Part II, I introduce relevant background information and examples of water use treaties and agreements that have proven to be successful either at maintaining or encouraging cooperation between various states. Part III will look into each state's current legislation and entities that manage water resources. …
A Different Approach To The National Gun Control Debate: Whether Direct Negotiations Between Interest Groups Can Facihtate The Creation Of Meaningful Legislative Policy, Arielle Kraus
Cardozo Journal of Conflict Resolution
This Note aims to shed light on a different approach to the national gun debate. The Background of this Note will explore the origin of the gun debate from both sides, the evolution of both the Gun Rights Lobby, spearheaded by the NRA, and the Gun Control Lobby, and the ways in which their evolutions have impacted the national debate today. The current state of the gun debate addresses the relationship between the polarity of the extreme positions and the political climate. Moderate democratic voices have seemed to disappear altogether, and in their place, extremists on both sides have filled …

The Ongoing Speculation About Smart Contracts: Smart Enough To Replace Third Party Arbitrators, Or Is "Smart" Just A Misnomer?, Rakhil Kalantarova
Cardozo Journal of Conflict Resolution
Although there is unmatched publicity about blockchain all over the world, the purpose of this Note is to provide a narrower insight into the fundamental importance of blockchain to the evolution of smart contracts. It will also introduce a proposition that oracles should be granted the authority to serve as arbitrators in mandatory Online Dispute Resolution ("ODR") and advise a step-by-step process to achieve that end. Section II of this Note will explore the background information and intricacies of blockchain technology, along with the realm of the purposes of smart contracts. It will also attempt to explain the benefits of …

Legal Graffiti And Copyright: How The Law Falls Short In Protecting This Important Artform, Kayla Epstein
Legal Graffiti And Copyright: How The Law Falls Short In Protecting This Important Artform, Kayla Epstein
Cardozo Arts & Entertainment Law Journal
The note argues that copyright law inadequately protects legal graffiti artists, particularly due to the abstract and public nature of their work, which complicates infringement claims. It critiques the current legal framework, including the tests for substantial similarity and the idea-expression dichotomy, for disadvantaging graffiti artists. The analysis highlights the need for legal reforms, such as the use of expert witnesses and enhanced protections under the DMCA, to better safeguard graffiti art and align copyright law with its purpose of incentivizing creativity.

Policy Advocacy And Organizational Change At The Association Of University Technology Managers (Autm), Jacob H. Rooksby
Law Faculty Publications
Since its founding, the Association of University Technology Managers, Inc. (now preferentially called “AUTM” after a February 2018 rebranding) has played a critical role in national policy discussions relating to technology transfer, intellectual property (“IP”), federal research support, entrepreneurship, and innovation. The nonprofit association is comprised of individuals responsible for the management of technology portfolios and an increasing variety of related support programs. AUTM’s mission is “to support and advance academic technology transfer globally” by:
(1) providing members with knowledge, tools, and training for professional development,
(2) helping stakeholders understand the value and impact of technology transfer,
(3) developing partnerships …
Assessing The Performance Of Voluntary Environmental Programs, Luis Inaraja Vera
Assessing The Performance Of Voluntary Environmental Programs, Luis Inaraja Vera
Law Faculty Scholarship
In recent years, government agencies have increasingly relied on voluntary programs to achieve a variety of goals, from improving worker safety to creating healthier living conditions in urban areas. This type of government initiative is based on a bargain between the agency and private citizens: the government provides certain incentives—economic or otherwise—and private actors voluntarily adopt behaviors that benefit the public. One example is cleaning up a contaminated site and building an affordable housing project.
While agencies have made substantial progress since the creation of the first voluntary programs, much work remains. To move forward in this area, and especially …

Thomas Jefferson Health System Medical Legal Partnership, Theresa Clark Rihn, Ema, Jd, Martha Romney, Rn, Ms, Jd, Mph, Rickie Brawer, Mph, Phd, Mches, Jennifer Roman, Bsn, Rn, Ccm
Phase 1
Introduction: Medical-legal partnerships (MLPs) provide civil legal services in concert with healthcare services to mitigate complex social conditions with health-harming effects. Currently, there are 333 MLPs in 46 states. Thomas Jefferson Health System (TJHS) does not have a systemwide MLP. (Magee Rehabilitation Hospital does have an MLP used by qualifying Magee patients). This project sought to identify the core components of an MLP and to demonstrate the value an MLP would provide TJHS.
Methods: Assessed existing literature. Interviewed an existing MLP director. Patients from the Jefferson Hospital Ambulatory Practice (JHAP) clinic completed a written survey regarding health-harming social-legal …
Internet Jurisdiction: Using Content Delivery Networks To Ascertain Intention, Patrick Lin
Internet Jurisdiction: Using Content Delivery Networks To Ascertain Intention, Patrick Lin
LL.M. Essays & Theses
Specific jurisdiction in civil litigation centers on the rather general, yet immutable, concept of intention. Although the word “intention” does not surface prominently in the personal jurisdiction case law, it is clearly intrinsic to the concept of “purposeful availment”. On the Internet, however, intention is hard to ascertain: how does a court, for example, determine whether the defendant intended that its website, application, or advertisement within a mobile application should end up in the forum state? In answering such a question, courts have historically used one of two approaches to establish intent: (i) a targeting test or (ii) a degree of …
Constitutional Rights Before Realism, Jud Campbell
Constitutional Rights Before Realism, Jud Campbell
Law Faculty Publications
This Essay excavates a forgotten way of thinking about the relationship between state and federal constitutional rights that was prevalent from the Founding through the early twentieth century. Prior to the ascendancy of legal realism, American jurists understood most fundamental rights as a species of general law that applied across jurisdictional lines, regardless of whether these rights were constitutionally enumerated. And like other forms of general law, state and federal courts shared responsibility for interpreting and enforcing these rights. Nor did the Fourteenth Amendment initially disrupt this paradigm in ways that we might expect. Rather than viewing rights secured by …
The Hidden Value Of Abandoned Applications To The Patent System, Christopher A. Cotropia, David L. Schwartz
The Hidden Value Of Abandoned Applications To The Patent System, Christopher A. Cotropia, David L. Schwartz
Law Faculty Publications
Some inventors abandon their patent applications without ever receiving a patent. Although patent scholars view such abandoned patent applications as essentially worthless, we question that conventional wisdom. Conducting an empirical analysis of a recently released patent application dataset in light of a 1999 change that requires publication of most abandoned applications, we find that the United States Patent and Trademark Office (USPTO) often uses abandoned applications as “prior art” when examining future patent applications. Abandoned applications thus generate an “administrative disclosure” that prevents the issuance of broader patent rights to later applicants. By narrowing the scope of new patents, abandoned …
Toxic Floodwaters: Strengthening The Chemical Safety Regime In The Climate Change Era, Noah M. Sachs
Toxic Floodwaters: Strengthening The Chemical Safety Regime In The Climate Change Era, Noah M. Sachs
Law Faculty Publications
Extreme flooding linked to climate change has caused toxic chemical spills across the United States, yet policymakers are not prioritizing industrial chemical safety in planning for climate change. Many scholars and industry executives have argued that existing private law mechanisms, such as insurance and tort-based deterrence, can adequately manage the risk of flood-induced chemical releases from industrial sites. But private law mechanisms have failed to prevent past incidents of mass contamination, and there is little evidence that tort law deters industrial firms from the practices that put communities at risk. In this Article, I engage in a comparative analysis of …

I am delighted to have participated in the Second Annual Intellectual Property Redux Conference and to publish this essay. I rarely look back at my older articles, but in Fall 2018 I was asked to give a keynote address at a conference held by the Biotechnology Innovation Organization (BIO), where the organizers asked me to speak about 35 U.S.C. § 101 and patent-eligible subject matter. In preparing my remarks, I had the opportunity to refer back to one of my earliest scholarly pieces—a 2007 article entitled Ants, Elephant Guns, and Statutory Subject Matter, published in the Arizona State Law Journal.1 …
The Law Of High-Wealth Exceptionalism, Allison Anna Tait
The Law Of High-Wealth Exceptionalism, Allison Anna Tait
Law Faculty Publications
No family is an island. But some families would like to be – at least when it comes to wealth preservation – and they depend on what this Article calls the law of high-wealth exceptionalism to facilitate their success. The law of high-wealth exceptionalism has been forged, over the years, from the twinned scripts of wealth management and family wealth law, both of which constitute high-wealth families as sovereign entities capable of self-regulation and deserving of exemption from the rules that govern ordinary-wealth families. Consequently, high-wealth families take advantage of complicated estate planning techniques and highly favorable wealth rules in …
Overrepresented Yet Overlooked: Lgbtq Survivors Of Trafficking And The Imperative For The Nordic Approach To Sex Trafficking Laws In The United States, Claire Mooney
Cardozo Journal of Equal Rights & Social Justice
The note argues that LGBTQ survivors of human trafficking are disproportionately affected by inadequate legal frameworks and societal discrimination. It advocates for the adoption of the Nordic Model in the U.S., which criminalizes the purchase of sex while decriminalizing its sale, to better address the needs of LGBTQ survivors and align with international human rights standards.

E-Regulation, Sharon Yadin
E-Regulation, Sharon Yadin
Cardozo Arts & Entertainment Law Journal
The new face of the regulatory state is digital. In this era of e-regulation, administrative agencies use social media, web platforms, and mobile applications for regulatory purposes. New forms of online communication now allow regulators to harness public opinion as an enforcement mechanism in such diverse areas as product safety, environmental protection, workplace injury prevention, customer satisfaction in financial services, child safety, restaurant sanitation, and healthcare quality. The use of internet-based naming-and-shaming and data-sharing practices-through tweets, online posts, rankings, scores, star ratings, and other methods-serves to enforce compliance and promote corporate social responsibility. E-regulation constitutes a paradigm shift in government …
Governing The Patent Commons, Dirk Auer, Julian Morris
Governing The Patent Commons, Dirk Auer, Julian Morris
Cardozo Arts & Entertainment Law Journal
Thousands of patents underpin the technologies that power the digital economy. Coordination among firms developing and implementing these novel technologies has notably been facilitated in large part by Standards Developing Organizations (SDOs). Despite the evident benefits of standardization in general and SDOs in particular, certain aspects of these processes have come under severe scrutiny from scholars, antitrust authorities, and courts. These critics argue that the standardization space suffers from two crippling market failures, namely "patent holdup" and "royalty stacking." They thus conclude that opportunistic firms will squeeze their rivals 'profits, harming consumers and stifling innovation in the process. However, recent …
Copyright Infringement Standards As They Relate To Appropriation Artists, Kimberly Pallen
Copyright Infringement Standards As They Relate To Appropriation Artists, Kimberly Pallen
Cardozo Arts & Entertainment Law Journal
The article examines the application of the "total concept and feel" test established in Roth Greeting Cards v. United Card Co. to determine copyright infringement, particularly in cases involving appropriation artists like Jeff Koons and Richard Prince. It argues that while this test is effective for analyzing substantial similarity in visual arts, it faces limitations when applied to appropriation art, where the original work's mood or feel is not significantly altered. The article highlights the subjective nature of the test and its reliance on visual comparison, which may not adequately address the transformative aspects of appropriation art.
One Consumer’S Trash Is Another’S Treasure: Upcycling’S Place In Trademark Law, Jolie Brett Schenerman
One Consumer’S Trash Is Another’S Treasure: Upcycling’S Place In Trademark Law, Jolie Brett Schenerman
Cardozo Arts & Entertainment Law Journal
The note argues that upcycling, the process of creating new, high-value products from salvaged materials, should be protected under trademark law's fair use doctrine. It contends that upcycling, unlike traditional infringement, does not confuse consumers about the source of goods and instead creates transformative works that benefit both sustainability and brand relevance. The analysis draws parallels between upcycling and parody, advocating for similar legal protections, and highlights the evolving relationship between luxury brands and upcyclers, from litigation to collaboration.
Law, Structural Racism, And The Covid-19 Pandemic, Ruqaiijah Yearby, Seema Mohapatra
Law, Structural Racism, And The Covid-19 Pandemic, Ruqaiijah Yearby, Seema Mohapatra
All Faculty Scholarship
Racial and ethnic minorities have always been the most impacted by pandemics because of: disparities in exposure to the virus; disparities in susceptibility to contracting the virus; and disparities in treatment. This article explains how structural racism, the ways in which laws are used to advantage the majority and disadvantage racial and ethnic minorities, has caused these disparities. Specifically, this article focuses on how employment, housing, health care, and COVID-19 relief laws have been manipulated to disadvantage racial and ethnic minorities, making minorities more susceptible to COVID-19 infection and death. This article uses Blumenshine’s 2008 framework to outline how structural …

All The World’S A Platform?: Some Remarks On 'Marketplace Platform' Employment Laws, Michael C. Duff
All Faculty Scholarship
This paper addresses the enactment of marketplace platform laws, which have arisen as a remarkable feature of the "gig" economy in recent years. A marketplace platform law decides the question of whether an individual worker is an independent contractor or an employee — an ongoing controversy in all employment law, including workers’ compensation law — by emphasizing factors other than those normally considered in traditional legal analyses. As of this writing, seven states appear to have enacted marketplace platform laws.
In short, marketplace platform laws — developed substantially and lobbied aggressively by the company Handy, Inc. — make it much …
