Raising The Bar On Accessibility: How The Bar Admissions Process Limits Disabled Law School Graduates, Haley Moss Jan 2020

Raising The Bar On Accessibility: How The Bar Admissions Process Limits Disabled Law School Graduates, Haley Moss

American University Journal of Gender, Social Policy & the Law

Introduction

Think about the steps it takes to get from law school admission through passing the Bar exam. Not only do you have to graduate with your college degree, but you have to take the Law School Admissions Test (LSAT); enroll in law school; potentially take out student loans; do plenty of reading; pass all of your classes; survive a few internships; participate in clinics, practicums and activities; obtain the juris doctor degree; study for weeks and months on end to take the bar exam; and hope for good news to begin your journey as an attorney. While it sounds …

Not Another Tween Tweet: Social Media, Schools, And A Return To Tinker, Benjamin P. Schroff Jan 2020

Not Another Tween Tweet: Social Media, Schools, And A Return To Tinker, Benjamin P. Schroff

American University Journal of Gender, Social Policy & the Law

Introduction

In May 2017, a high school student received the news that she made the junior varsity cheerleading squad for her sophomore year. The student then learned that an incoming freshman placed on the varsity squad over her. In response to this, the student posted a picture of herself and a friend on Snapchat, displaying their middle fingers and saying “f school, f softball, f cheer, f everything.” Soon after the student’s post, the coaches of the cheer squad suspended the student for one year, citing the school’s Cheerleading Rules. After the school board refused to get involved, the student’s …

Prospects And Pitfalls: Confronting Sexual Harassment In The Legal Cannabis Industry, Alexis N. Smith, Griffon Toronjo Pivateau

American University Journal of Gender, Social Policy & the Law

I. Introduction

In the last decade, the legal cannabis industry emerged as a fast-growing and complex new market. Legal cultivation of the cannabis plant promises to create tremendous economic opportunities. Further, the new market hints at significant social consequences. Numerous women have entered the field as entrepreneurs, advocates, and employees. Early reports indicate a much higher percentage of women within the cannabis industry than the agricultural industry in general.

Nevertheless, women face challenges and obstacles. The cannabis industry bears the characteristics of a start-up entity, but this entity resides within a market skewed by the federal law banning the cultivation …

Translational Ecology And Environmental Law, Robert W. Adler Jan 2020

Translational Ecology And Environmental Law, Robert W. Adler

Utah Law Faculty Scholarship

Translational ecology is a comparatively new approach to the pursuit of ecology and other environmental sciences, the implications of which for environmental law have not previously been explored significantly. Emulating the concepts of translational medicine, proponents of transactional ecology seek to increase the relevance of their research to important environmental problems by improving how effectively they communicate research results to end users of that science, collaborating with those end users to identify research that is “actionable” rather than purely “curiosity-driven” or theoretical, recognizing that values as well as science have a legitimate role in environmental decisions, and engaging in ongoing …

Water Law And Climate Change In The United States: A Review Of The Scholarship, Robin Kundis Craig Jan 2020

Water Law And Climate Change In The United States: A Review Of The Scholarship, Robin Kundis Craig

Utah Law Faculty Scholarship

Climate change’s effects on water resources have been some of the first realities of ecological change in the Anthropocene, forcing climate change adaptation efforts even as the international community seeks to mitigate climate change. Water law has thus become one vehicle of climate change adaptation. Research into the intersections between climate change and water law in the United States must contend with the facts that: (1) climate change affects different parts of this large country differently; and (2) United States water law is itself a complicated subject, with each state having its own laws for surface water and groundwater and …

Brief Of Amicus Curiae Professor Jorge L. Contreras In Support Of Appellee And Affirmance In Ftc V. Qualcomm, Jorge L. Contreras

Utah Law Faculty Scholarship

Qualcomm participated in the development of 3G and 4G wireless telecommunication standards under the auspices of two SDOs, the Telecommunications Industry Association (“TIA”) and the Alliance for Telecommunications Industry Solutions (“ATIS”). Each of these SDOs had adopted intellectual property rights policies (IPR Policies) that required their participants to grant licenses of SEPs to implementers of their standards on FRAND terms. Yet, over the course of several years, Qualcomm refused to license its SEPs to numerous actual and potential modem chip rivals including MediaTek, Project Dragonfly (a joint venture of NTT DoCoMo, Samsung and several Japanese manufacturers), Samsung, VIA Telecom, Intel, …

George Perkins Marsh: Anticipating The Anthropocene, Robin Kundis Craig Jan 2020

George Perkins Marsh: Anticipating The Anthropocene, Robin Kundis Craig

Utah Law Faculty Scholarship

This chapter, part of the forthcoming volume PIONEERS OF ENVIRONMENTAL LAW, explores the vision of humanity's influence on social-ecological systems that George Perkins Marsh provided to the world in his 1964 work, MAN AND NATURE, OR PHYSICAL GEOGRAPHY AS MODIFIED BY HUMAN ACTION, republished in 1874 as THE EARTH AS MODIFIED THROUGH HUMAN ACTION. In addition to tracing how Marsh and these publications influenced nature resources and environmental law in the United States well into the 20th century, this chapter also argues that Marsh anticipated, in many respects, the environmental legal and policy issues of the Anthropocene by tracing clearly …

The Drive To Advise: A Study Of Law Students At A Pro Bono Brief Advice Project, Linda F. Smith Jan 2020

The Drive To Advise: A Study Of Law Students At A Pro Bono Brief Advice Project, Linda F. Smith

Utah Law Faculty Scholarship

Law school aims to teach lawyering skills as well as legal analysis. While all students must acquire the skills of legal analysis, research and writing, law schools may decide what other skills to teach. Students also acquire skills and habits in informal ways, through clerkship experiences or pro bono volunteer work. However, there has been almost no study of what “skills” students pick up in these informal ways, and whether there are skills that would better be learned as part of the curriculum. This study looks at the skill of legal interviewing employed by students in a pro bono brief …

Learning From Our Mistakes: Conversation Analysis Reveals Best Practices For A Student-Staffed Pro Bono Project, Linda F. Smith Jan 2020

Learning From Our Mistakes: Conversation Analysis Reveals Best Practices For A Student-Staffed Pro Bono Project, Linda F. Smith

Utah Law Faculty Scholarship

Law schools make “pro bono” opportunities available to students to introduce them to the responsibilities of the profession. Often these pro bono law students help in “brief advice” projects staffed by volunteer attorneys. This staffing-supervision structure presents challenges in ensuring clients receive competent, individualized advice and the students receive adequate oversight so that this is a positive learning experience for them. This paper analyzes transcripts from 46 recorded student-client interviews and 35 student-attorney consultations. It focuses on those cases where there were “errors or omissions” -- either the client got some erroneous advice or the client did not receive complete, …

Fair Use, The Internet Age, And Rulifying The Blogosphere, Michael Goodyear Jan 2020

Fair Use, The Internet Age, And Rulifying The Blogosphere, Michael Goodyear

Articles & Chapters

The fair use analysis in copyright law is, at present, a confusing and sometimes contradictory entanglement of four factors whose outcome is not guaranteed until it comes before a court ex post. Despite the four factors being listed as clearly delineated points in § 107, in reality, these factors have substantial overlap and courts have provided contradictory rulings even in the same circuit. This article builds on the earlier suggestions of Niva Elkin-Koren and Orit Fischman-Afori in suggesting rulification of fair use in specific creative contexts to better distinguish the legal standards for fair use for the population at large. …

Reclaiming Black Dignity, John Felipe Acevedo Jan 2020

Reclaiming Black Dignity, John Felipe Acevedo

Essays, Reviews, and Shorter Works

As American society seeks to institute police reforms in the wake of the protests following George Floyd's murder, the imperative to include communities that have been disproportionately victimized by police in those reform processes becomes increasingly apparent. For members of these communities, questions of police reform implicate not only physical violence, but violations of human dignity itself. When police discriminate against individuals from a particular community, they enact a dignity taking on that community and claim that dignity for themselves. Therefore, for reform to be meaningful, the dignity taken by the police must be restored to the communities it was …

Sabin Center Diversity, Equity, Inclusion And Anti-Racism Plan, Sabin Center For Climate Change Law Jan 2020

Sabin Center Diversity, Equity, Inclusion And Anti-Racism Plan, Sabin Center For Climate Change Law

Sabin Center for Climate Change Law

The climate crisis is a crisis of unprecedented scope and scale. It arises from everywhere, and impacts everyone. But some – some countries, some companies, some communities, some individuals – are more responsible than others; and some are more impacted, and more vulnerable, than others. Climate change has made clear that diversity increases the power of potential solutions and the resilience to adverse impacts – for ecosystems, social systems, economic systems and their various hybrids and combinations. At the Sabin Center for Climate Change Law we believe that by creating and fostering a culture of diversity, equity, inclusion, and anti-racism, …

Climate Risk In The Electricity Sector: Legal Obligations To Advance Climate Resilience Planning By Electric Utilities, Romany M. Webb, Michael Panfil, Sarah Ladin Jan 2020

Climate Risk In The Electricity Sector: Legal Obligations To Advance Climate Resilience Planning By Electric Utilities, Romany M. Webb, Michael Panfil, Sarah Ladin

Sabin Center for Climate Change Law

Electricity generation, transmission and distribution, and load are all impacted by weather patterns. Electric system assets have been designed for historic weather conditions, with the goal of ensuring reliability and quick recovery following extreme events. However, climate change is causing major shifts in historic weather patterns and more frequent and severe extremes, which are creating new risk profiles for the electric system. Proactive climate resilience planning by electric utilities to identify, respond, and rationally allocate these climate risks is thus increasingly salient. This paper argues that it is also legally required.

Recently published industry studies demonstrate that accurate, specific, and …

Sabin Center for Climate Change Law

Climate change in Asia and the Pacific is deadly and impacts communities now. Regional climate litigation seeks relief in increasingly urgent ways and judges need a tool kit to respond. Report Two of this four-part series is a comprehensive review of the growing number and variety of climate lawsuits in Asia and the Pacific. It underscores the unique flavor and voice of regional jurisprudence and compares it with global approaches. No one can solve climate change alone and neither can any particular judiciary. Judges can, however, learn from each other, taking judicial excellence and applying it to the case before …

When Politics Trump Science: The Erosion Of Science-Based Regulation, Romany M. Webb, Lauren Kurtz, Susan Rosenthal Jan 2020

When Politics Trump Science: The Erosion Of Science-Based Regulation, Romany M. Webb, Lauren Kurtz, Susan Rosenthal

Sabin Center for Climate Change Law

Science is science and facts are facts. My administration will ensure that there will be total [scientific] transparency and accountability without political bias.” That was the promise made in September 2016 by then-candidate Donald Trump when asked how he would protect federal scientists from political interference in their work. Since taking office, however, President Trump has led a concerted effort to undermine federal scientific research, particularly in areas where research findings contradict his own views or undermine the basis of his deregulatory agenda.

That effort is documented in the Silencing Science Tracker, an online database that records anti-science actions taken …

After Madrid, W[H]Ither The Cop?, Susan Biniaz Jan 2020

After Madrid, W[H]Ither The Cop?, Susan Biniaz

Sabin Center for Climate Change Law

With Madrid behind us and Glasgow on the horizon, it is a good time for Parties and others to consider the future of the annual COP. (By “COP,” I mean the climate conference writ large, rather than the “Conference of the Parties,” the narrower technical name for the Parties to the UN Framework Convention on Climate Change.) Madrid, while a remarkably successful venue in terms of logistics, left many not only disappointed at the Parties’ failure to reach agreement and signal an increase in ambition but also confused:

  • Why was there such a disconnect between the scientific imperative (as well …

Compilation Of Recommendations To Reduce Greenhouse Gas Emissions In New York State, Kate Marsh, Neely Mckee, Jordan Gerow Jan 2020

Compilation Of Recommendations To Reduce Greenhouse Gas Emissions In New York State, Kate Marsh, Neely Mckee, Jordan Gerow

Sabin Center for Climate Change Law

The Climate Leadership and Community Protection Act (CLCPA) was passed by both houses of the New York State legislature and signed into law by Governor Andrew Cuomo in June 2019. It took effect on January 1, 2020. It requires total statewide greenhouse gas (GHG) emissions to be 40% below 1990 levels in 2030 and 85% below 1990 levels in 2050, with an aspirational goal of a 100% reduction in 2050. It is one of the strongest climate change laws in the world, and people everywhere are watching its implementation for models of what can be done elsewhere.

The CLCPA establishes …

Climate Change, Ferc, And Natural Gas Pipelines: The Legal Basis For Considering Greenhouse Gas Emissions Under Section 7 Of The Natural Gas Act, Romany M. Webb Jan 2020

Climate Change, Ferc, And Natural Gas Pipelines: The Legal Basis For Considering Greenhouse Gas Emissions Under Section 7 Of The Natural Gas Act, Romany M. Webb

Sabin Center for Climate Change Law

As the federal agency charged with overseeing the interstate transportation of natural gas, the Federal Energy Regulatory Commission (FERC) has recently faced growing criticism over its approval of new pipelines. Critics have lambasted FERC for failing to adequately consider the climate change impacts of pipeline development, particularly the greenhouse gas emissions associated with “upstream” natural gas production and “downstream” use. The D.C. Circuit recently weighed in, holding that the National Environmental Policy Act (NEPA) requires consideration of downstream greenhouse gas emissions, at least in some circumstances. The precise scope of that requirement continues to be debated before FERC, in the …
