How Circuits Can Fix Their Splits, Wyatt G. Sassman Jan 2020

How Circuits Can Fix Their Splits, Wyatt G. Sassman

Marquette Law Review

The desire to avoid conflicts between the regional circuits of the federal courts of appeals, commonly known as “circuit splits,” has had an immense influence on the structure and operation of the federal appellate courts for roughly a century. Over time, the Supreme Court has been assigned responsibility for resolving these conflicts. Yet as overall federal caseloads have increased, this reliance on the Supreme Court has imposed serious and well-recognized burdens on the operation of the federal courts. For decades scholars have debated bold proposals to address these problems, such as creating a new national court dedicated to resolving conflicts …

The Impact Of Incarceration On The Risk Of Violent Recidivism, Jennifer E. Copp Jan 2020

The Impact Of Incarceration On The Risk Of Violent Recidivism, Jennifer E. Copp

Marquette Law Review

Whether incarceration heightens an individual’s likelihood of recidivating is at the center of prison policy discussions. Yet rigorous empirical studies on the nature of the incarceration—recidivism link are limited. As a whole, existing research suggests that the effect of imprisonment, relative to noncustodial sanctions, is either null or slightly criminogenic. These findings call into question the ability of prisons to exert a specific deterrent effect. They also suggest that prisons are failing to address the underlying causes of recidivism among inmate populations. An important consideration, however, is the extent to which the effects of imprisonment are heterogeneous. The current discussion …

Cannabis Legalization In State Legislatures: Public Health Opportunity And Risk, Daniel G. Orenstein, Stanton A. Glantz Jan 2020

Cannabis Legalization In State Legislatures: Public Health Opportunity And Risk, Daniel G. Orenstein, Stanton A. Glantz

Marquette Law Review

Cannabis is widely used in the United States and internationally despite its illicit status, but that illicit status is changing. In the United States, thirty-three states and the District of Columbia have legalized medical cannabis, and eleven states and D.C. have legalized adult use cannabis. A majority of state medical cannabis laws and all but two state adult use laws are the result of citizen ballot initiatives, but state legislatures are beginning to seriously consider adult use legislation. From a public health perspective, cannabis legalization presents a mix of potential risks and benefits, but a legislative approach offers an opportunity …

Corporate Governance And The Omnipresent Specter Of Political Bias, Stefan J. Padfield Jan 2020

Corporate Governance And The Omnipresent Specter Of Political Bias, Stefan J. Padfield

Marquette Law Review

Subject to important qualifications, corporate decision-makers are dutybound to maximize shareholder value. However, there is reason to believe corporate decision-makers are allowing their political biases to corrupt their decision-making. This Essay posits two related fact patterns that should concern advocates of good corporate governance. The first occurs when decision-makers expressly disavow any duty to maximize shareholder value, such as when Apple CEO, Tim Cook, told shareholders, “When we work on making our devices accessible by the blind, I don’t consider the bloody ROI [return on investment],” or when Ed Stack, the chairman and chief executive of Dick’s Sporting Goods, decided …

Promise Amid Peril: Prea's Efforts To Regulate An End To Prison Rape, Brenda V. Smith

Project on Addressing Prison Rape - Articles

This Article discusses the modest aspirations of the Prison Rape Elimination Act (“PREA”) that passed unanimously in the United States Congress in 2003. The Article posits that PREA created opportunities for holding correctional authorities accountable by creating a baseline for safety and setting more transparent expectations for agencies’ practices for protecting prisoners from sexual abuse. Additionally, the Article posits that PREA enhanced the evolving standards of decency for the Eighth Amendment and articulated clear expectations of correctional authorities to provide sexual safety for people in custody.

อิทธิพลของความคิดทางพุทธศาสนากับความผิดอาญาสมัยรัตนโกสินทร์, พีรยา กุลทอง

Chulalongkorn University Theses and Dissertations (Chula ETD)

Greening The Old New Deal: Strengthening Rural Electric Cooperative Supports And Oversight To Combat Climate Change, Gabriel Pacyniak Jan 2020

Greening The Old New Deal: Strengthening Rural Electric Cooperative Supports And Oversight To Combat Climate Change, Gabriel Pacyniak

Faculty Scholarship

New Deal cooperatives succeeded in electrifying rural America when for-profit utilities would not. Today, however, rural electric cooperatives are lagging behind when it comes to meeting the challenge of climate change. Cooperatives have collectively been slower to embrace the shift to low-carbon electricity than for-profit and municipal utilities and have served as a drag on state and federal clean energy and climate policies. This is partially because of the structural differences between cooperatives and other utilities, but also because of a weak and under-determined federal and state regulatory structure. A few cooperatives in Colorado and New Mexico are seeking to …

Why And When Discrimination Is Discordant With Charitable Status: The Problem With “Public Policy”, The Possibility Of A Better Solution, Adam Parachin Jan 2020

Why And When Discrimination Is Discordant With Charitable Status: The Problem With “Public Policy”, The Possibility Of A Better Solution, Adam Parachin

Articles & Book Chapters

When courts have considered when and why discrimination renders an institution ineligible for charitable status, they have resorted to the doctrine of public policy to explain the non-charitableness of discrimination. Public policy is not, though, up to the task. It is undisciplined, inspires courts to consider irrelevant factors and offers no principled explanation as to when and why discrimination should and should not vitiate charitable status. A better approach would be to address this issue using the traditional analytical tools of charity law — charitable purposes, charitable activities and public benefit. But this is a deceptively difficult task, which perhaps …

The Reform Of The Compensation System For Ecological And Environmental Damage In China: Natural Resources, Environmental Enforcement, And Legislation, Weiyu Wu Jan 2020

The Reform Of The Compensation System For Ecological And Environmental Damage In China: Natural Resources, Environmental Enforcement, And Legislation, Weiyu Wu

Natural Resources Journal

The establishment of the Compensation System for Ecological and Environmental Damage promises to be a milestone development in China’s environmental regulations. Historically, China has used two main legal tools—direct regulation and public interest litigation—to cope with the ecological and environmental damage under its current environmental laws and management systems, but they are unable to effectively break the paradox of “polluted by the enterprises, suffered by the public, paid by the government.” China’s new Compensation System for Ecological and Environmental Damage is becoming a feasible method to comprehensively remedy China’s damaged environment by imposing negotiation and litigation against liable parties that …

The novel coronavirus COVID-19 has profoundly disrupted life in the United States. Schools and universities have closed throughout much of the country. Businesses have shuttered, and employees are working from home whenever possible. Cities and states are announcing lockdowns in which citizens may leave their homes only for vital errands or exercise.

Medical experts advise that at least some of these restraints will continue for 18 months or more—until a vaccine is developed, tested, and administered widely. It is possible that localities will be able to lift some of these restrictions (such as lockdowns and school closures) intermittently during those …

Low-Income Household Adults Sustaining Affordable Housing In Affluent Neighborhoods, Edward Brian Flournoy Jan 2020

Low-Income Household Adults Sustaining Affordable Housing In Affluent Neighborhoods, Edward Brian Flournoy

Walden Dissertations and Doctoral Studies

Public housing policy continues to exacerbate the concentration of poverty for low

income household adults (LIHA), preventing their mobility to achieve or sustain

affordable housing in low-poverty affluent neighborhoods. Successful design and

implementation of public housing policy for LIHA has been elusive for policymakers

seeking to address socioeconomic self-sufficiency problems in the United States.

Wilson’s spatial mismatch theory on social transformation of the inner city was the

theoretical framework for this study. This qualitative study utilized policy analysis and

key interviews to explore the importance of public policy design and implementation in

how the Moving to Opportunity (MTO) program influenced …
