Proceedings Of The Thirteenth International Humanitarian Law Roundtable, Year In Review Lecture, Mark A. Drumbl

Scholarly Articles

What I think I’d like to do is tell three stories of three things that did happen in international criminal justice over the past year, and use my time as a vehicle and doorway to think about law and also how law fits in life. One of the themes that I want to evoke through these stories is what I felt is an important vibe in international criminal law enforcement this past year. And it’s the theme of time and age and coming of age.

Rural Practice As Public Interest Work, Hannah Haksgaard Jan 2019

Rural Practice As Public Interest Work, Hannah Haksgaard

Faculty Publications

As the rural lawyer shortage continues to grow, rural states and communities must find new ways of attracting law students and graduates to rural practice. This Article explores incentives based on conceptualizing rural private practice as public interest work. Rural lawyers provide public interest lawyering through pro bono cases, mixed practices, community service, and even through providing fee-paid services in rural communities. The Article asserts that law schools and rural communities can capitalize on this view to recruit new lawyers and argues that federal loan forgiveness programs should be expanded to cover rural lawyers.

Governing The Internet Of Everything, Scott J. Shackelford Jan 2019

Governing The Internet Of Everything, Scott J. Shackelford

Cardozo Arts & Entertainment Law Journal

Since the term was first coined in the late 1990s, the "Internet of Things" has promised a smart, interconnected world enabling your toaster to text you when your breakfast is ready, and your sweatshirt to give you status updates during your workout. This rise of "smart products" such as Internet-enabled appliances has the potential to revolutionize both business and society. But the smart wave will not stop with stuff with related trends such as the Internet of Bodies now coming into vogue. It seems that, if anything, humanity is headed toward an Internet of Everything. Yet it is an open …

Blending Surnames At Marriage, Hannah Haksgaard Jan 2019

Blending Surnames At Marriage, Hannah Haksgaard

Faculty Publications

In most states, marrying couples are severely limited in their surname choices at the time of marriage. While recent scholarship has focused on men’s limited surname choices, other important problems with the marital surname process exist. For example, the increasingly popular decision to blend surnames—taking parts of both current surnames to create an entirely new surname—is generally not allowed. Four states explicitly allow for surname blending on the marriage license, and three more allow for any surname to be adopted. This article argues the remaining states should follow suit by allowing surname blending and other surname options. In addition to …

United States V. Gillette: A Tiny Prairie Case Note Opening A Window On The Enveloping Fog Obscuring The Indian Civil Rights Act Of 1968, Frank Pommersheim

Faculty Publications

United States v. Gillette is one of the first reported cases on the new post-United States v. Bryant road. As of yet, there is no reliable (legal) GPS to point the way. This "tiny prairie" casenote is not meant to focus on the answers, but rather to clarify the questions and to widen the discussion as the journey continues.

Conflict-Of-Interest-Infected Virtual Representatives And A Cure, Thomas Simmons Jan 2019

Conflict-Of-Interest-Infected Virtual Representatives And A Cure, Thomas Simmons

Faculty Publications

The general rule that a person cannot be bound by an agreement or a decree unless she received notice encounters practical difficulties where a person is missing, incompetent, a minor, unascertained, or even unborn. In many trust proceedings, all beneficiaries are necessary parties. But short of appointing a guardian ad litem to represent persons who are difficult to notice, uncertainty and inefficiencies would be encountered were it not for the doctrines of representation and virtual representation. Under these common law doctrines persons -- even if not yet in existence -- can be held to be parties to a proceeding "virtually …

Health Matrix: The Journal of Law-Medicine

The identification and arrest of the Golden State Killer using DNA uploaded to an ancestry database occurred shortly before recruitment for the National Institutes of Health’s (NIH) All of Us Study commenced, with a goal of enrolling and collecting DNA, health, and lifestyle information from one million Americans. It also highlighted the need to ensure prospective research participants that their confidentiality will be protected and their materials used appropriately. But there are questions about how well current law protects against these privacy risks. This article is the first to consider comprehensively and simultaneously all the federal and state laws offering …
