Beyond Constitutional Frontiers: Tribal Rights, Resources, And Reform, Monte Mills
Faculty Journal Articles & Other Writings
The current era arguably poses the most complex and challenging environmental dilemmas in human history. With climate change, increasingly scarce resources, and exponentially expanding demand, traditional legal notions of standing, harm, and liability are being stretched and reshaped to accommodate a shifting set of values regarding natural resources and potentially respond to the moment. While these novel and innovative approaches are modestly reshaping the fields of natural resources and environmental law, however, the historical and time-honored claims of Indian tribes are also presenting avenues for rethinking the foundations of those areas of law. Arising both within and outside of the …

Marine Insurance Prohibitions In Contemporary Economic Warfare, Richard L. Kilpatrick, Jr.
Marine Insurance Prohibitions In Contemporary Economic Warfare, Richard L. Kilpatrick, Jr.
International Law Studies
As States and supranational actors increasingly employ economic sanctions to promote security objectives, a recent trend has focused on the regulation of commercial shipping activities. These maritime sanctions have restricted port access for designated vessels, banned the import and export of certain cargo classes, enhanced authorization for vessel inspections, and even justified vessel seizures. Critically, these techniques have also included targeted prohibitions on marine insurance covering designated vessels and cargo. Designed to frustrate sanctioned actors in their attempts to utilize maritime assets for malign purposes, marine insurance prohibitions thwart these efforts and also blunt the ability to generate revenue through …

Protection of personal data in recent decades became more crucial affecting by emergence of the new technologies especially computer, internet, information and communications technology. However, Europeans felt this necessity at time and provided for up-to-date and supportive laws. The General Data Protection Regulation (GDPR) is the latest legislation in EU to protect personal data of individuals based on the recent technological advancements. However, its’ domestic and international output still is debatable. This doctrinal legal study by using descriptive methods, aimed to evaluate the GDPR through analyzing and interpreting its’ provisions by especial focus on its’ innovations. The results show that …
The Continuing Validity Of The Electoral College: A Quantitative Confirmation, Audrey J. Lynn
The Continuing Validity Of The Electoral College: A Quantitative Confirmation, Audrey J. Lynn
ConLawNOW
In recent years, efforts to undermine or discard the Electoral College have gained substantial momentum, leading to a need for objective answers about how the system affects presidential elections. Using accessible quantitative techniques, this article answers three essential questions about the purposes and effects of the Electoral College using a unique approach that measures the electoral system’s success and potential in terms that correspond to its raison d'être, parameterizing the problem in terms of satisfaction and population instead of voters. This article dispenses with arcane, voter-based statistical models. It recognizes the Electoral College as a discrete mathematical system and applies …

Applying The Plan-Do-Study-Act (Pdsa) Approach To Community Health Worker Job Satisfaction: Local And Global Perspectives, Wendy R. Thal, Rosalinda Jimenez
Journal of Refugee & Global Health
Community Health Workers (CHW) have been a continuing presence in the world health care arena for several decades. While the work they do is diverse, all abide by local social and cultural “norms” and are stakeholders within the population they serve. [1] While much literature is available on the importance of community health workers in the provision of care in regions with limited access to health care, there is little known on what inspires someone to engage in the role. The World Health Organization purports that building value for these lay health care providers within their community via training, support, …

Suing Guns Out Of Existence?, Scott R. Thomas, Mystica M. Alexander
Washington and Lee Law Review Online
In an effort to address gun violence, activists and victims’ families have filed lawsuits against the firearms industry seeking damage awards for violence committed by third party unrelated actors. Although Congress passed the Protection of Lawful Commerce in Arms Act (PLCAA) in 2005 intending to foreclose such lawsuits, since the time of the law’s passage, plaintiffs have brought claims against the firearms industry seeking refuge in an exception embedded in the statute. In a March, 2019 decision, Soto v. Bushmaster Firearms International, LLC, the Connecticut Supreme Court found that the Connecticut Unfair Trade Practices Act fell within an exception …

The Semisecret Life Of Late Mao-Era International Law Scholarship, James D. Fry, Huang Yining
The Semisecret Life Of Late Mao-Era International Law Scholarship, James D. Fry, Huang Yining
Pace Law Review
This Article is delimited by a focus on international law scholarship during the late Mao era, not on the PRC’s actual approach to or pronouncements on international law, mainly in order to respond directly to the assertion of U.S.-based international law scholars on late Mao-era scholarship. Of course, considerable ambiguity surrounds what constitutes scholarly work; no legal or even consensus definition generally exists. To be clear, definitions might exist in specific contexts such as the Foreign Agents Registration Act (“FARA”) of the United States, which prohibits foreign lobbying except for “bonafide religious, scholastic, academic or scientific pursuits or the fine …
